HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that helshe understands the responsibilities of a Supervisor. It.is improved with a two-story, colonial style single-family residence with a,living area of approximately 2,150 sq. ft., according to assessor's records dated 09/24/99. The,property,is located in an RD-1 Residential Zoning District and is serviced by.public water and a,private.,septic system. ,There is..a minimum 30' front yard, 10' side yard and 10' rear yard setback required in RDA...Districts. The petitioner is proposing to construct a 384 sq. ft. addition to the northwest side of the existing dwelling which will encroach into the minimum required front yard. The existing dwelling is currently nonconforming, being situated approximately 14 feet from the front property line off Ladd Road. The petitioner is applying for a Special Permit pursuant to Section 4-4.3(2) Nonconforming Buildings or Structures Used as Single and Two-Family Residences, to permit the proposed addition to be located 6.5 feet from the front property line; an additional encroachment of 7.5 feet into the minimum required 30 foot front yard. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 14, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 03, 1999, at which time the Board granted the requested Special Permit with conditions. Hearing Summary: Board Members hearing this appeal were Ron Jansson, Richard Boy, Gene Burman, Dan Creedon, and Chairman Emmett Glynn. Attorney Michael Stusse represented the applicant, Philip E. Meany, Jr. Also present was Craig Short, P.E. Attorney Stusse explained the house has existed since at least 1953 because the foundation is shown on the original subdivision plan. The applicant is proposing to add a garage (facing Ladd Road). The house as it now sits is located within the front yard setback and is pre-existing nonconforming. The applicant is applying for a Special Permit to allow the addition to be located within the front yard setback. a Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-136-Meany Special Permit,Section 4-4.3(2)Expansion of a pre-existing nonconforming residence Attorney Stusse submitted photographs of the house looking down Ladd Road which is a narrow 12-15 foot wide gravel road. Photographs showing the proposed location of the garage were also submitted. This is the only place the garage can be placed because of the location of the wetlands in relationship to this property. The Petitioner has an Order of Conditions from the Conservation Commission for the proposed garage at this location. For the record, there will be a new septic system installed but they will not be increasing the number of bedrooms on site. The lot is nonconforming (since it is less than the required one acre) and the proposed garage addition is in keeping with style of the other houses on the road. This addition will make the house more attractive and has the support of the neighbors in the area. No view of the river will be impeded by this construction with respect to any existing property. The project engineer, Mr. Short reviewed the plans and explained there is a small jog in the rear of the addition which is needed because of the 50 feet wetland setback requirement. The garage will be 20' x 20'minus the four foot jog out of the side required to meet the conservation setbacks. Public Comment: No one spoke in favor or in opposition to this appeal. Seven letters of support from adjoining property owners were submitted to the file. The building is a nonconforming structure by virtue of the 1953 subdivision plan that shows the foundation plan. This house was built on that foundation so it is a legal pre-existing nonconforming structure and . thus the proper relief is an expansion of a nonconforming structure pursuant to a Special Permit and a Variance is not required. Findings of Fact: At the hearing of November 03, 1999, the Board unanimously,.found the-following findings of fact as related to Appeal No. 1999-136 1. The applicant, Philip-E. Meany, Jr., is seeking a Special Permit pursuant to Section 4-4.3(2) Nonconforming Build,i.ngs or Structures Used as Single and Two-Family Residences.. The property is located at 78 Ladd Road, Centerville, MA as shown on Assessor's Map 206, Parcel 057. The site is 0.31 acres in size and is improved with a two-story, colonial style single-family residence with a living area of approximately 2,150 square feet, according to assessor's records dated 09/24/99. According to the assessor's records, the house was built in 1954. 2. The property is located in an RD-1 Residential D-1 Zoning District and is serviced by public water and a private septic system. There is a minimum 30'front yard, 10' side yard and 10' rear yard setback required in the RD-1 Residential D-1 Zoning District. The petitioner is proposing to construct a 384 square feet addition to the'northwest side of the existing dwelling which will encroach into the minimum required front yard. .. 3. The proposed addition is a one-car garage with one room over the garage area and will be situated 6.5 feet from the front property line. The location of the coastal bank limits the area where the proposed garage addition can be built because of the minimum required 50 foot separation required from the top of the coastal bank. 5. The petitioner is also proposing a new septic system which will be located to the south of the existing dwelling. Presently there is a cesspool on this site, located on the north side of the house. Maintaining the required separation between the building and proposed septic system leaves very little space for the proposed addition on the south side. 6. The petitioner put a jog in the garage in order to meet the 50 foot setback requirement from the coastal bank. 7. Staff Review: The property fronts on the.Centerville River. The abutting property to the south is developed with a single-family home. The remainder of the abutting property is presently vacant. The property that would be most affected by the proposed addition is the abutting lot to the north, which is presently vacant. r Town of Bamstable-Planning Department-Staff Report Appeal Number 1999-136-Meany Special Permit,Section 4-4.3(2)Expansion of a pre-existing nonconforming residence The location of the coastal bank limits the area where the proposed garage addition can be built because of the minimum required 50 foot separation required from the top of the coastal bank. The petitioner is also proposing a new septic system which will be located to the south of the existing dwelling. Presently there is a cesspool on this site, located on the north side of the house. Maintaining the required separation between the building and proposed septic system leaves very little space for the proposed addition on the south side. This proposal was approved by the Conservation Commission on July 20, 1999(see attached Order of Conditions). Special Permit Requirements: For the alteration or expansion of a pre-existing nonconforming building used as a single-family residence, the Board must find that the proposed expansion and/or alterations are not substantially more detrimental to the neighborhood than the existing building.
