The property that is the subject of this appeal consists of a 0.04 acre lot addressed as 109 Lake Elizabeth
Dr., Centerville. It is improved with a three-story, 5 bedroom wood frame single-family residence. The
dwelling contains 1,696 sq.ft. of living area and dates to 1875.
The applicant is seeking to add a second floor area of approximately 5 by 20 feet over an existing first floor.
The area of the addition is located within the required side yard setback. Although the building is a pre-
existing legal non-conforming structure with regards to setback, Section 44.3-Nonconforming Buildings or
Structures Used as a Single or Two-Family Residence-requires a special permit to expand within 10 feet of
the side property line. The applicant has applied for a special permit in accordance with Section 4--4.3(2).
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October
23, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all
abutters in accordance with MGL Chapter 40A. The hearing was opened November 29, 2000 at which time
r d the special permit subject to conditions.

Board Members hearing this appeal were Tom DeReimer, Dan Creedon, Gail Nightingale Jeremy Gilmore
and Chairman Ron Jansson. Attorney G. Arthur Hyland, Jr. represented the applicant John Troy, who was
also present. Mr. Hyland presented the plans for the expansion noting that the first floor was already in place
and there would be no further intrusion into the established setbacks.
The Board discussed the nature.of relief being sought and it was determined that this was an intensification
and that relief from the Board was required. The Board noted that this was a very small lot of approximately
2.,500 sq. ft. and that the established non-conforming setback was only about 2.5 feet.
Public comment was requested and no one spoke in favor or in opposition to this appeal. Board Chairman,
Ron S.Jansson noted that two letters in support were submitted to the file, one from the neighbor most
affected by this expansion.
Findings of Fact:
At the hearing of November 29, 2000 the Board unanimously found the following findings of fact:
1. In Appeal 2000-105, the Applicant is John Troy seeking a special permit for an expansion of an existing
structure. The property is addressed 109 Lake Elizabeth Dr., Centerville,MA, as shown on Assessor's
Map 226, parcel 052, in an Residential C Zoning District.
2. The applicant is requesting a special permit in accordance with Section 4-4.3(2), Non-Conforming
Buildings Used as a Single-Family or Two-Family Residences, for the construction of a 5 by 20 and 1/4
foot addition to the second floor of an existing single family dwelling.
3. The second floor addition is located over an existing first floor area and does not infringe into the side,
front or rear setbacks any more than what exists today. The construction is only on the second floor and
does not increase the area of the first floor footprint of the building.
4. The proposed addition will conform to the Zoning Ordinance in terms of height.
5. From the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would
not represent a substantial detriment to the public good or the neighborhood affected.
Decision:
Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in
Appeal No. 2000-105, subject to the following terms and conditions:
1. The addition shall be in accordance with the proposed plan entitled "Site Plan of Land in Centerville, MA
for John Troy" scale 1"=20', originally dated 11-1-94, revised date of 11-24-00.
2. The locus shall comply with all regulations of the Board of Health and State Building Codes.
3. The addition to the second floor shall be in conformance with the plans submitted to the Board at this
hearing, entitled "Troy Residence, Lake Elizabeth Drive, Centerville, MA, Terry C. Kenyon, AIX dated
February 10, 2000, a copy of which are so indicated in the file. This condition is applicable only to the
second floor addition.
4. Given the small size of the lot and its location,there shall be no future expansion of this structure.

Ordered:
Special Permit 2000-105 has been granted with conditions. This decision must be recorded at the Registry

Background Information:
The subject of this appeal is an undersized lot of 0.04 acres,addressed as 16 Pleasant Avenue,Craigville,
MA. The lot is developed with a 1,369 sq.8.two story single-family dwelling,built in the late 1800's,
with 5 bedrooms, 1 bathroom. Pleasant Avenue is an undeveloped"paper road"20 feet wide. Access to
the property is via Lake Elizabeth Drive.
According to plans submitted,the lot measures approximately 50 feet deep by 36 feet wide. The existing
structure measures 30.5 feet wide by 27.5 feet deep. The applicant is proposing to add a 6 foot by 5 foot
addition to the home at the north west comer which will be in line with the established side yard setback
of the existing structure.
Procedural Summary:
This appeal was filed on February 10, 1995. A public hearing duly noticed and advertised in the
Barnstable Patriot in accordance with MGL Chapter 40A was held before the Zoning Board of Appeals on
April 05, 1995,at which a decision to grant the request was made. Board members hearing this appeal
were;Tom DeRiemer,Gene Burman,Ron Jansson,Elizabeth Nilsson and Chairman Gail Nightingale.
Appeal Number 1995-38 for a variance was also filed in the alternative to Appeal Number 1995-37 for a
Special Permit for extending of the non-conformity in structure setback.
Attorney Arthur Hyland represented the petitioner before the Board. Plans for the addition to the single
family residence were submitted with the application. The plan documents the existing structural setback
of about 5 feet from the sideline. The proposal is for a 6 by 5 foot addition for a bath,shower and closet
aligned with the existing setback established by the non-conforming structure. The addition will not
intrude further into the sideline than now existing.
The Board questioned other permitting needs and Attorney Hyland cited that the Conservation
Commission has issued an Order of Conditions for the proposed project and that the Board of Health has
16 homes along Lake Elizabeth Drive on a community septic system that meets Title V requirements.
Attorney Hyland noted the history of development in the area. In the late 1890's these small parcels were
tent lots for religious retreats. Intermittent roadways and walks were designated at about 20-25 feet

between the lots. Today this is a year round residence. This home is not a rental unit and is used by the
owner and his guests.
The Board requested public comment: There was none.
FINDINGS:
At the conclusion of the hearing the Board unanimously made the following findings of facts as related to
Appeal No. 1995-37 for a Special Permit in Accordance with Section 4-4.2-Change of a Non-conforming
structure to permit an addition:
1. The property is located on Pleasant Avenue,Lot 52 in a RC-Residential C Zoning District
which currently requires a one acre lot minimum. The lot is 0.04 acre in size and was created
prior to zoning in the area.
2. The Lot is developed with a single family residence built in the late 1800's and has five
bedrooms and one bath.
3. The property is non conforming and it existed prior to zoning.
4. The proposed addition is 60 sq.ft.on two floors located in line with the existing established
setback of approximately 5 foot from the adjoining property. _
5. The proposed addition of 6 by 5 feet is not substantially objectionable to the neighborhood.
6.. This property is owner occupied and is not used for rental.
DECISION:
Based upon the affirmative findings a Motion was duly made and seconded that Appeal Number 1995-37
-Troy be granted with the following condition:
1. The addition shall be constructed as per plans presented to the Board.
