A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building_permit. (Section 109.1.1) The undersigned"homeowner" assumes responsibility for compliance with the State Building Code and other applicable codes,bylaws,rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and,requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 Licensing of construction Supervisors); provided that if the homeowner engages a persons)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware'that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require, as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. ARCHITECTURAL DESCRIPTION: Describe architectural features. Evaluate the characteristics of this building in terms of other buildings within the community. 117 Lake Elizabeth Drive(BRN-2235) is a one-and-one-half-story wood-frame Cottage. The building adopts a rectangular plan on a concrete block foundation. The five-by-two bay building.faces west along the Pleasant Avenue footpath that parallels Lake Elizabeth Drive to the east and Summerbell Avenue to the west. The terrain slopes to the east toward Lake Elizabeth. The building terminates in a front gable roof sheathed with asphalt shingles. Two gable roof wall dormers are featured on the north elevation. Each dormer features a single 6/6 double-hung wood sash window set within a simple wood surround. The residence is clad with wood shingles. A wrap-around hipped roof porch is featured on the north and west elevations. A portion of the porch along the north elevation is infilled. The porch features chamfered wood posts resting on a wood deck. 117 Lake Elizabeth Drive is a modest late-nineteenth century wood frame residence. HISTORICAL NARRATIVE Discuss the history of the building. Explain its associations with local(or state)history. Include uses of the building, and the role(s) the owners/occupants played within the community. In 1871 The New England Convention of the Christian Church purchased and established a camp meeting known as Camp Christian on the 160 acre Perry Farm in Centerville. In 1872 the Christian Camp Meeting Association(CMMA)was established with the purpose: "to hold and encourage others to hold religious services."Camp Christian was renamed Craigville in 1881 in honor of the life and ministry of Dr. J.Austin Craig, a prominent leader of the Christian Church(Christian Camp Meeting Association Brochure). Situated on a bluff overlooking Nantucket Sound, with the Centerville River to the west and Lake Elizabeth and Red Lilly Pond on the east, it served as a spectacular spot for a retreat from everyday life. Families were able to buy or lease the 288 small lots, with clergy getting theirs free. They initially erected tents or built small shelters, and as time and means allowed, small cottages were constructed. Today,the area is densely developed,with many cottages occupied year round. Craigville attracts a variety of visitors,both religious and secular,to its Conference Center throughout the year,one being the Cape Cod Writers' Center Annual Workshop. The conference Center is owned by the Christina Camp Meeting Association and managed by the Massachusetts Conference of the United Church of Christ. 117 Lake Elizabeth Drive(BRN-2235)was constructed between 1899-1909 by George W.Hoar(B. 1861),a merchant,and his wife, Eva(B. 1864). The Hoars,who resided in Fall River,purchased two parcels of land,the first in 1885 from George and Sarah Chase and the second, from Caleb and Sarah Tillinghast in 1899. The Hoar's sold the property in 1909 to Edith A. Biddulph(B. 1875)and her husband, Clarence(B. 1876). Clarence was a paper and cardboard salesman. The Biddulph's son, C.Ashmead(B. 1908) eventually sold the property in 1954 to William A.Plunkett. The Plunkett family continues to own the property in 2009. In Appeal 2014-010, Robert and Lauren Crory sought a Special Permit under Section 240-131.4(D), which allows for expansion and alteration of existing dwellings. The proposed alterations and additions did not conform to the current setback requirements of the district, and thus a special permit was required. The Applicant proposed to renovate, expand and alter the existing dwelling at 117 Lake Elizabeth Drive by constructing an 82 square foot, approximately 6' by 14' addition to the lower level of the dwelling, under the existing covered porch..The addition allowed for reconfiguration of the lower level of dwelling and included the conversion of unfinished utility/storage space to living space. Further the Applicant sought to enclose the existing covered porch on the first floor, consisting of 105 sq.ft, to be a three-season enclosed porch; add a second-floor dormer to the north side of the dwelling resulting in 160 gross square feet of additional living area; and renovate the dwelling, include some changes to fenestration and general upgrades. The footprint of the dwelling was to remain unchanged. The subject property was 3,600'sq.ft in area. The lot was improved with a four bedroom, single-. family dwelling, built circa 1900. It was a one and a half story, wood frame dwelling. The topography of the lot dropped'off towards the lake, resulting in'a ground level walkout elevation on Lake Elizabeth Drive. The dwelling had a gross floor area of 1,886 sq.ft, in addition to unenclosed, covered porches on the front and rear,and a basement crawl space. The lot was also improved with a one car garage, accessed from Lake Elizabeth. The dwelling was served by the shared Craigville Christian Camp Association .wastewater treatment system. The property fell outside of the Craigville Christian Camp National.Register Historic District. It was within the Craigville Beach District, an area designated bythe Cape Cod Commission as a District of Critical Planning Concern. Procedural & Hearing Summary Special Permit No. 2014-010, filed by Robert and Lauren Crory, to allow for expansion and alteration of an existing dwelling at 117 Lake Elizabeth Drive was filed at the Town Clerk's office. and office of the Zoning Board of Appeals on February 3, 2013. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on February 26, 2014 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding•this appeal were Craig G. Larson, Alex M. Rodolakis, George T.Zevitas, and Herbert K. Bodensiek. Michael Gaspard represented the Applicants before the Board. Mr. Gaspard provided a summary the proposed project and the relief request. He clarified that the height of the.dwelling would not increase and the ridge of the new dormer would be no higher than the existing ridge. Findings of Fact At the hearing on February 26, 2014, the Board unanimously made the following findings of fact for Appeal 2014-010, a request for a.special permit filed for expansion and alteration of an existing dwelling within the required setback at 117 Lake Elizabeth Drive, Centerville: 1. Robert and Lauren Crory have petitioned fora Special Permit pursuant to §240-131.4(D)(2) to remodel and construct a new addition to an existing single-family dwelling. The property is located at 117 Lake Elizabeth Drive, Centerville, MA as shown on Assessor's Map 226 as Parcel 053. It is in the Craigville Beach Zoning District— Craigville Beach Neighborhood. . 2. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-131.4(D)(2) allows for expansion of an existing lawfully established structure in existence as of January 19, 2011 with a special permit from the Board. . . 3. Site Plan Review is not required for single-family residential dwellings. 4. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 5. The proposed alterations and expansions are not substantially more detrimental to the environment, community and/or historic character of the neighborhood than the existing building or structure. 6. The redevelopment contributes to and respects the character and historic development patterns of the area and minimizes inconsistent development and redevelopment impacts to the historic and community character resources in this area. The Applicant is preserving the existing historic dwelling, as opposed to demolishing and rebuilding .the structure. Preserving the dwelling contributes to maintaining the neighborhood's historic building stock and preserving community character resources. 7. The proposal protects and preserves scenic views and vistas and ways to.the water. The Applicant is working within the existing footprint of the dwelling and the overall height of the dwelling will not increase; thus, views and vistas to Lake Elizabeth should not be adversely affected. 8: The proposal protects and improves natural resources, including but not limited to the barrier beach and groundwater and coastal water quality and minimizes development and redevelopment impacts to the natural,resources and ecosystems in this district. The redevelopment will not adversely affect natural resources or ecosystems in the district. 9. The development complies with the setbacks and lot coverage requirements set forth herein, and is in character with surrounding structures, particularly structures that predate it. Relief is being requested for.expansion of the structure in accordance with § 240-131.4D. The proposed development does not intensify any of the existing setbacks. The redevelopment is in character with the surrounding structures. 10. The redevelopment complies with. the height limitations set forth herein. The redevelopment does not increase the height of the existing structure over what is there today and complies with the other requirements of§240-131.5, including required second-story setback and limitations on second story floor;area. - 11. The second floor addition is set back a minimum of two feet from the front and rear facades. The additions are proposed within the footprint of the existing building. 14. -The second-floor dormered addition is set back from the dwelling facades that face Lake Elizabeth Drive and Pleasant Avenue. The original roof form is preserved and the roof line is extended by the second floor addition. The lower level addition does not extend beyond the - footprint of the existing dwelling. 15. The proposal works with modest massings. .The proposed additions are modest in size and are designed and scaled to be in character with the existing structure. The second-floor addition is not higher than the existing roofline. 16. The proposed dormered addition is designed to complement the roof pitch of the existing dwelling. The gable end on the north elevation is similar in design.to the original cottage-style facade that faces Pleasant Avenue. The proposed roof pitch is at least six over 12. 17. The proposal retains original architectural details and unique forms. The original cottage-style fagade on Pleasant Avenue is maintained.
