MGL chapter 152, §25C(6) also states that "every state or local licensing agency shall withhold the issuance or

Additionally, MGL chapter 152, §25C(7) states "Neither the commonwealth nor any of its political subdivisions shall

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to''engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.

Person(s)who owns a parcel of land on which he/she reside`s'or intends to reside, oii which there is, or is intended to-
be, a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A
person who constrgcts more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be
responsible for all such work performed under the buildings permit. (Section 109.1.1)
The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other
applicable codes, bylaws,rules and regulations.

HOMEOWNER'S EXEMPTION
.The Code states that: "Any homeowner performing work for which a building permit is required shall be excrrrpt from the provisions
Of this scction.(Scetian ID9.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption an unaware that they arc assuming the responsibilities of a supervisor(see Appendix Q,
Rulcs&Regulations for Licensing Construction Supervison,Section 2.15) Ibis lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is u)timatcly responsi'b)e.
To ensure that the homeowner is fully aware of his/her rtsponsibilitics,many communities require,as part of the permit application,
that the homcowmcr certify that he/she understands the rrsponsibilitics of a Supervisor. On thc last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a form/ccrtification for use in your community.

to conform with all terms and conditions stated herein.

applicable authorizations necessitated due to the provisions hereof shall be secured

3. Any change in use or any substantial structural alteration of any structure or
fill authorized herein shall require the issuance by the Department of a new waterways
` License in accordance with the provisions and procedures established in chapter 91

4. This Waterways License shall be revocable by the Department for noncompliance with

those persons who have filed a written request for such notice with the Department
and afforded them a reasonable opportunity to correct said noncompliance. Failure
to correct said noncompliance after the issuance of a written notice by the Department
shall render this Waterways License void and the Commonwealth may

Licensee, its successors and assigns as an unauthorized and unlawful structure and/or
