address. Unfortunately,the application can not be approved at this time because the work
is closer to a nearby river than allowed by local zoning. A variance would have to be
granted by the Zoning Board of Appeals before a building permit could be issued.If you

Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for+heir eu�ployees.
Pursuant to this statute, an employee is defined as"...every person in the service of another under any contract ofhiie,
express or implied, oral or written."
An employer is defined as "an individual,partnership;association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise, and including the legal representatives of a-deceas-d employer, or The
receiver or tm tee of an individual,part;aership,association or other legal entity,employing employees. However the
owner of a d>Yeling house harm;not more than three apazfinenis and who resides therein;or the occupant of.�e
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant aereto shall not because of such employment b e deemed to be an employer."
MCTL chapter 152, §25C(6).also states that"every state or local llceiving agency shall withhold the issuance or
renewal of a license or.per`nut to'operafe a business or to construct buildings in the commonwealth for any
applicant who has not produced;acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapteL.152,§25C(.)states`Neither the commonvvealth nor any of is political subdivisions shall
enter into any contract for,the performance of pub lic•work until acceptable evidence afcompl aLee zvith'the insurance'
requirements of this chapter have been presented to the contracting authority.."

insurance. Limited Liability Companies'(LLC) or Limited Liability Partnerships(LLP)with no employees other than the
members*or partners, are not required to carry workers' compensation insurance. If an LLC or LLP does have
employees, a policy is required. Be advised that this affidavit may be submitted to the Department of Industrial
Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The affidavit should
be returned to the city or town that the application for the permit.or license is being requested,not the Department of
Industrial Accidents. Should you have any questions regarding the law or if you are required to obtain a workers.'

Appeal 2007-085 was filed in conjunction with Appeal 2007-084. The two appeals sought to alter
and expand one of the residential units located in the multifamily building within the required 35-foot
to wetlands. The unit to be expanded is Unit#3 of the four condominium units known as Portledge
by the Sea located at 306 Long Beach Road in Centerville. The property is a 0.26-acre lot and its
development dates back to the 1920's.
According to the application submitted the petitioner seeks to construct an addition of a three season
room to the rear of the existing building. From the plans submitted there-is an existing footing and an
upper level deck that is to be partly restructured into a three season room.
The area to be enclosed measures approximately 15 by 10 feet overall and is calculated to be
approximately 129 sq.ft. in gross area. The location of the addition is 34.4-feet from the wetlands as
defined on the plan as the "Top of a Coastal Bank", that is more correctly a "river bank."
Procedural & Hearing Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
August 9, 2007. A public hearing before,the Zoning Board of Appeals was duly advertised and notice
sent to all abutters in accordance_with MGL Chapter 40A. The hearing was opened October 10,
2007, at which time the Board found to grant the Special Permit subject to conditions. Board
Members deciding this appeal were, Ron S.Jansson, James R. Hatfield,John T. Norman, Kelly Kevin
Lydon, and Chairman, Gail C. Nightingale:
.The petitioner, Attorney, Richard M. Rougeau, was present during the hearing and represented by Mr.
Roy Brown, the general contractor. Mr. Brown presented the plans for the proposed three-season
enclosure noting that the location was based upon an existing foundation wall that was located only
some 4 feet from the back wall of the unit. He noted that it would be no further out from the

foundation wall. The Board noted that is was a very small addition and the intrusion into the setback
from wetlands was approximately 7 inches.
The Board reviewed the plans and noted that the 7-inch intrusion into the required setback from the
wetlands was de minimis. However, it was noted that the proof of the pre-existing legally created
nonconformity in the setback had not been established and that relief from the required setback may
be required. Mr. Brown cited that relief was sought in this appeal, 2007-085, which was intended to
be a variance.
The Board discussed the issue and determined to make a finding that the intrusion is de minimis;
therefore, no relief is required.
Chairman Nightingale asked for.public comment and Mr. Rougeau submitted a letter from Demetrios
and Yeota B. Haseotes of 309,Long Beach Road supporting the grant of the relief requested. No-one
spoke in favor or in opposition at the hearing.
Findings of Fact:
At the hearing of October 10, 2007, the Board unanimously made the following findings of fact:
The proposed location of the expansion is situated 34.4 feet off the wetlands where a 35-foot setback
is required.- The difference amounts to a 7-inch intrusion into the required setback from the wetlands
which is de minimis; therefore, no relief is required.

Findings on Appeal 2007-085 indicate that no relief is necessary as the intrusion is de minimis. This
decision must be recorded at the Barnstable Registry of Deeds for it to be in effect and notice of that
recording submitted to the Zoning Board of Appeals Office. The relief authorized by this decision
must be exercised within one year. Appeals of this decision, if any, shall be made pursuant to MGL.
Chapter 40A, Section 17, within twenty (20) days after the date of the filing of this decision. A copy of _
which must be filed in the office of the Barnstable Town Clerk.

This letter is to follow-up on an application submitted to do work at the above referenced
address. Unfortunately, the application can not be approved at this time because the work
is closer to a nearby river than allowed by local zoning. A variance would have to be
granted by the Zoning Board of Appeals before a building permit could be issued. If you
decide, at a later date, that you wish to go forward with the project you must apply again
