Atty. Richard C. Anderson represented the petitioner who seeks permission
to construct a boathouse on a lot adjacent to his residence on Long Beach
Rd. , Centerville in a residence D zoning district. Application is made
under Sec. P. AM which allows accessory use on .a lot adjacent to the lot
having thereon the principal building to which it is accessory. The petitioner's
residence is directly across the street from the locus . Application for a
boathouse at this same' location was made under appeal no. 1978-8 which the Board
denied based on a plan which showed a multi-level bui.iding. . Accessory use under
Sec. J. of the zoning by-laws refers to one-story buildings of accessory use, and
the Board found in the previous appeal (1978-8) that the petitioner would construct
a two-story building. The petitioner appealed the Board's decision to the Superior
Court and the Court upheld the Board based on the plan showing a multi-level-
building. The Board did find under appeal 1978-8 that a boathouse is a permitted
accessory use in this district and also that the locus is adjacent_ to the main
dwelling. This area has many boathouses due to its accessibility to the water.
There would be no plumbing, septic system,etc. in the proposed boathouse and
there would be no habitable space in this building. Its sole use would be for
boat storage and the maintenance of .boats. The new building would be smaller
than the one previously applied for and allowing a special permit for the boathouse
would not be detrimental to the-neighborhood nor in derogation of the spirit and
intent of the zoning by-laws. `
Mr. Richard Cardullo spoke .in objection to the petition and said that he represented
his parents who own property on Main St. which would be affected by the construction
of the boathouse. Mr. . Cardullo felt that the boathouse would be used for parties etc.
and said that there have been many problems in the area with noisy parties on, the
waterfront. . Mr. Cardu llo asked that the petition be denied.
In rebuttal , Mr. Anderson said that the boathouse would be used only for the
storage and maintenance of boats and there would be a ramp for winching the boats
in and out of the water. The petitioner must also appear before the Conservation
Commission on the proposed structure. No one spoke in favor of the petition and
the matter was taken under advisement. (cont. on. page 3)

The Board voted unanimously to grant the petitioner a special permit under
Sec. P. AM of the zoning by-laws for the construction of a boathouse on a
lot adjacent to the lot having thereon the principal use to which it is
accessory at Long Beach Rd. , Centerville. The following restrictions are
imposed on this special permit.
1 . A11 construction shall be in accordance with the plans submitted
showing a one-story boathouse and cited„as follows:
"Proposed Boathouse for Mr.. & Mrs. D. B. 1laseotes,
Centerville, Mass. , Gaffney Associates, Inc. Hyannis , Mass.
Date: April , 1981 , Drawn by GPC, Job No. 8031 ."
2. The boathouse shall have as its sole use, the storage and
maintenance of ,boats.
3. If any use .is made of the boathouse, other than the permitted
use for. the storage and maintenance of boats, this special
permit shall be void and the building must be removed from the
site.
