Background &Staff Review:
On October 9, 1996,the Board denied the applicants request for a 100 foot amateur radio tower. That
decision was appealed by the applicant to the Barnstable Superior Court on the grounds that Section 3 of
MGL Chapter 40A exempts the amateur radio tower from regulation. That section states that:
No zoning ordinance-or by-law shall prohibit the construction or use of an antenna structure by a
federally licensed amateur radio operator. Zoning ordinances and by=laws may reasonably
regulate the location and height of such antenna structures for the purposes of health, safety, or
aesthetics; provided, however, that such ordinances and by-laws reasonably allow for sufficient
height of such antenna structures so as to effectively accommodate amateur radio
communications by federally licensed amateur radio operators and constitute the minimum
practicable regulation necessary to accomplish the legitimate purposes of the city or town
enacting such.ordinance.or by-law."
On September 03; 1997, the Board heard the remand petition of the applicant. During that hearing, it
appears to staff that the Board determined that although the use is exempt under MGL Chapter 40A,
Section 3,the height of the tower did require.relief if it exceeded the 30 foot height limitation imposed
under Section 3-1.3(5)-Bulk Regulations, Maximum Building Height, and that reasonable restrictions
could be imposed on the tower and antenna equipment under both the Town of Barnstable Zoning
' Ordinance and in accordance with MGL Chapter 40 A, Section 3 criteria(see attached -Zoning Board of
Appeals Minutes of.September 03, 1997).
During that hearing'.the Board failed to resolve the issue as required in the Order of Remand and the
appeal was rescheduled to the November 05, 1997 Hearing of the Board.

The applicant should be prepared to assist the Board in resolving these issues by submitting a plan,
including an elevation drawing of the proposed tower and equipment to be located upon it and the location
of any guyed wires and anchors. Staff has made some recommendation at the end of this report that the
applicant may wish to review and consider in his plans for the tower.
Some Possible Findings:
In consideration for a Variance, the Board may wish to consider some of the following in its findings;
1. MGL, Chapter 40A, Section 3, provides that no zoning ordinance may prohibit the construction or use
of an antenna structure by a federally licensed amateur radio operator.
2. The applicant, Philip G. McNamara has submitted a copy of his amateur radio operator license issued
by the Federal Communications Commission. That license expires on July 27, 2004.
3. In accordance with MGL Chapter 40A, Section 3, the amateur radio operator license restricts use of
the tower to non-commercial amateur radio communication.
4. The Town of Barnstable Zoning Ordinance, Section 3-1.3(5) Bulk Regulations, Maximum Building
Height, limits the height of all structures to 30 feet within the RC Zoning District.
5. The applicant presently has an antenna and tower attached to the dwelling that is approximately 52
feet from which he is operating his amateur radio communications.
Staff Recommendations:
If the Board should find to grant the Variance, it may wish to consider some of the following conditions and
staff recommendations.
1. Development of the tower shall be as represented in the plan submitted titled (if plans
are submitted and acceptable to the Board)
2. The maximum height of the tower inclusive of all antennas shall not exceed 85 feet as measured from
grade and shall be built as represented to the Board.
�3. No antenna shall extend more-than-llffeet from the tower measured for the center of the structure to
the outer most edge of the antenna. L�
4. All guyed wires and anchors shall be located within the required setbacks. The setback requirements
for the RC Residential C Zoning District are 20 feet in the front, 10 feet in the rear and 10 feet on the
side.
5. - -
6. The tower shall be painted in a neutral color so as to best blend into the sky.
7. No lights or reflectors shall be installed in the tower.
8. The tower shall be maintained in good structural condition at all times, free of rust and all older
antennas. When any equipment becomes antiquated (not used), it shall be immediately removed.
9. The Variance is issued to Philip McNamara for an antenna tower at 44 Maureen Drive and is not
transferable.
10. The Variance will expire upon the transfer of the property or the termination of the FCC amateur radio
operators license held by Mr. McNamara, and the antenna tower must be removed at that time.
11. The antenna tower shall be used for amateur radio use only by Philip McNamara. No commercial use
shall be made of the tower.

Board.Members hearing these appeals were Richard Boy,Ron Jansson,Gail Nightingale,Tom DeRiemer and
Chairman Emmett Glynn. Attorney Bruce Gilmore represented the applicant,Phil McNamara,who was present.
Attorney Gilmore gave the.history of this appeal and explained that Mr.McNamara was before the Zoning Board of
Appeals last year for this tower seeking a variance to the height regulations. The Variance was denied. This appeal
is now being heard by order of remand from the Barnstable Superior Court(Docket No.96-761). Attorney Gilmore
cited MGL Chapter 40A;Section,3 which exempts the amateur radio tower from regulations and stated that the
town can not prohibit construction or use of an antenna.by a federally licensed operator. Mr.McNamara is a
licensed operator and a copy of his license was submitted to the file.
In Attorney Gilmore's opinion the.local Zoning Ordinance for the Town can not overrule the FCC regulations and
therefore,he is requesting that the Board allow this tower to be constructed up to 100 feet as it is exempt from
zoning.
Board Member Ron Jansson agreed that Section 3 does allow for the use but since it states "...zoning ordinances
may reasonably regulate the location and height of such antenna structures...",the Board has the authority to
regulate the height. Mr.Jansson questioned why the tower needed to be 100 feet high.
Attorney Gilmore stated the height is needed to allow for communication with Boston. The tower is currently 50
feet and the applicant.intends to.go up in increments of 5-10 feet and when he gets a clear signal to Boston,he will
stop. .
While,the Zoning Ordinance for the Town of Barnstable does not specifically address the height of an amateur
radio towers,it does limit the height of.structures. The Board felt a tower should be considered a"structure". The
Building Commissioner agreed and stated that is why he told the applicant he needed to seek a Variance for the
requested height. Attorney Gilmore is of the opinion,that the Town can not regulate height because the ordinance
does not have a section specifically for amateur radio antennas.
The Board asked the applicant about the height now,the proposed height,and what type of antennas and/or dishes
would be on this tower: .
Mr.McNamara answered by stating that there are various types of antennas,both directional and nondirectional and
he is intending to have a variety. Right now there is a metal tower that is approximately 35 feet and a metal pole
(antenna)on top of that for atotal of approximately 51-52 feet. He is requesting the tower height and the antenna
height be allowed to a maximum of 100 feet. The height is needed to reach Boston. The tower is a standard Rohn-
25;a commercial quality tower.. It is a 10 foot sectional tower,and the sections can be added in ten foot increments.
The structure may need guy.wires because of the wind. The principal tower is a fiberglass pole and some of the
antennas span up to 12 feet. Mr.McNamara did not know if any guy wires would touch the side line or if they
would stay within the.setbacks.
When asked if there would be any danger to the neighbor's property if the tower were allowed to be to 100 feet,the
Building Commissioner stated he was not sure because no plans have been presented as of yet.
Mr. McNamara stated that now the tower is bolted to the house. It is the most practical location because the house
acts like a support and the tower is further away from the power lines. If it were to fall,there are no structures(right
now)near it,so it would land on the trees and ground.

Public Comment: Stan Lane,a Federally Licensed Engineer,stated the FCC allows him to have a 200 foot of
tower. No one else spoke in favor or in opposition to this appeal.
The hoard still questioned whether or not the tower was exempt from zoning. The Building Commissioner felt the
exemption was for use only and not the height. The Zoning Ordinance has a 30 foot height limitation for structures.
Attorney Gilmore stressed that the absence of any regulations in the Zoning Ordinance makes this tower exempt.
The applicant is agreeable to having the tower height capped at 100 feet.
Gail Nightingale again requested a plan be presented showing the height and exactly what will be on the tower. The
Board reviewed the only diagram in the file(from the previous appeal). Mr.McNamara indicated there will be
attachments to the tower that will go above the roof line. He explained that he is licensed to operate a number of
bands and his license allows him to pick up additional bands if he wants,but that requires additional height He
stated the height will not impact other things in the area because of adequate filters.
Ron Jansson suggested that the applicant proceed with the construction and go up only to the height he needs to
reach Boston and then come back to the Board and tell the Board that height. Gail Nightingale stated she would like
to see plans showing what devices would be attached to the tower.
Attorney Gilmore asked the Board for a 90- 120 day time-frame to work on the suggestion and during that time the
applicant would work with the Building Commissioner.
The Board discussed the proposal/suggestion made and decided they would like some type of drawing.to help
clarify the way this would look in the neighborhood since this is a residential area. It was suggested that a brochure
from the tower company or a photograph of a similar tower be submitted. To help with the visual aspect,the
applicant suggested his antenna would look similar to the antenna at the Red Cross Building on South Street
(Hyannis).
Before making a motion,Gail Nightingale suggested the applicant come back to the Board with design information,
including pictures. Since the applicant has requested a continuance for 90-120 days,he should come to the Board
during that time frame.

A motion was made to allow the Petitioner to design the antennae so that it does not exceed an overall height of 100
feet as is proposed. This antenna should compare in overall appearance with the antenna located at the Red Cross
Building. There will be no reflectors,parabolic or of any other type,and with no apparatus on the tower that would.
disfigure the antenna and which would cause people to be concerned with.visual pollution.

Discussion: Ron Jansson clarified the motion should say design and built. Gail Nightingale would like to
see the applicant design the structure and then come back before the Board to get permission to build the.
structure.

discussion Attorney Gilmore interrupted and stated that the motion was unacceptable to him. Mr.Gilmore stated
the applicant had wanted to work with the Board but this was not acceptable and the applicant will take the decision
of the Board and go back to Superior Court.

Background:
The property is located at 44 Maureen Rd., Centerville, in the RC Residential C Zoning District. It consists
of a 0.25 acre lot improved with a 1.,116 sq. ft. wood frame single family dwelling built in 1966. There
presently is a thin radio tower,estimated by staff to be approximately 50'tall attached to the northern side
of the garage. Because of surrounding tall cedars and pines, the tower is not especially visible in the
neighborhood except directly in front of 44 Maureen Dr.
The applicant has requested a Special Permit to increase the height of the antenna tower to 100'. Staff
also cited Variance relief in the public notice for this appeal.
Zoning Relief Requested:
If the applicant can demonstrate that the present tower is a legal pre-existing nonconforming structure in
terms of height, (as per MGL Chapter 40A-Section 7-6 or 10 Year Statute of Limitations) a Special
Permit may be issued in accordance with Section 4-4.3(2)of the Town of Barnstable Zoning Ordinance. If
the tower existed for the requisite number of years, the tower may be considered a pre-existing
nonconforming structure. If the tower structure can not satisfy the requirements for status as a non-
conforming structure, then the appropriate relief may be a Variance to the Barnstable Zoning Ordinance,
Section 3-1.3 (5)-Bulk Regulations Maximum Building Height. For this district the maximum height is 30
feet.
The applicant should be prepared to present to the Board the history of the antenna and any permits that
may have been issued for height. This is needed for the determination by the Board as to the appropriate
relief needed.
Staff assumes that the use of the antenna- amateur radio-would be considered an accessory use to the
principal use of the locus as 6 single family dwelling and no relief would be required for the use..

Variance:
In consideration for a Variance, the applicant must substantiate those conditions unique to this lot that
justify the granting of the relief being sought.
Special Permit:
If the appropriate relief is the of a Special Permit, the applicant should present that the expansion of the
antenna will not be substantially more detrimental to the neighborhood nor would it be in degradation of
the Zoning Ordinance.
Staff Review/Recommendation:
While a 50' tower is relatively unobtrusive, a 100' tower will extend above the trees and will be much more
visible. The Board may wish to request elevations or plans showing the shape and width of the tower. If
the Board finds to grant the Variance/Special Permit, they may wish to consider the following conditions:
1. The Special Permit/Variance issued to Philip McNamara for"an antenna tower at 44 Maureen Dr. and
is not transferable.
2. The Special Permit/Variance will expire upon the transferred of the property and the antenna tower
must be removed at that time.
3. The antenna tower shall be used for amateur radio use only by Philip McNamara. No commercial use
shall be made of the tower.
4. The antenna tower shall not exceed 100' in height and shall be built as represented to the Board.
