Background: The lot was created in August 1984 as Developer Lot No.685 within Subdivision 348A. The lot was originally released along with all lots within the subdivision on May 13, 1995 and re-released again on January 13, 1986. The 8 year protection afforded the subdivision would have expired in August 1992. Records of the subdivision show it was complete to the satisfaction of the Department of Public Works, Engineering Section in 1990,inclusive of as built plans. A review of the file did reveal several subdivision changes occurred that triggered recordings and re- recordings. Procedural Summary: This appeal was filed on Jan 17. 1995 and scheduled for Public Hearing before the Zoning Board of Appeals on March 01, 1995. Board members sitting on these appeals are:Ron Janson,Emmett Glynn, Dexter Bliss,Tom DeRiemer and Chairman Gail Nightingale. Attorney Michael Same representing the petitioner agreed to have both cases(1005-24 and 1995-25) heard together. The Daviaus purchased the subject property in 1986 from the Smalls hoping that their daughter would move back to the Cape. That did not happen so they would like to sell one of the lots. The Building Commissioner wrote to Attorney Stusse on January 6, 1995 regarding the buildability of lot 178 on map 170 and said it was not grandfathered as it had been held in common ownership with an abutting lot. Mr. Stusse argued that there had been a title error making it appear that it had becn held in common ownership and a confirmatory deed to prove this was.submitted which had been recorded in j Book 9481,Page 258 at the Registry of Deeds. Said deed does go back to the original deed and supersedes it. Unfortunately the eight(8)year protection afforded the subdivision would have expired in August 1992. Therefore a variance is necessary for an undersized lot. He bought it as a buildable lot. Many other lots on and around Michael Hamblin Rd.have the same problem. There are no lots abutting he can buy and so Attorney Stusse thinks relief can be granted. All lots around it are built upon. The intent was to have this lot buildable. FINDINGS: Ron Janson In Appeal Number 1995-25A--Daviau for an appeal of the Building Commissioner's decision. I. The subdivision was created by the petitioner on August 20, 1984. 2. In 1996 Mr. Small as trustee of White Pine Realty Trust deeded the property to Mr.Daviau for $45,000 3. At the time Mr. Small did not have the authority to do so as the lot was owned by a separate trust. 4. This title problem was not corrected until December of 1994, 5. In the interim the subdivision had expired but it is non-pro tunct only as to the title and not as to zoning therefore the protection under Chapter 40A,Section 6 was lost and accordingly the Building Commissioner acted correctly. The lot in issue was purchased in good faith and for reasonable consideration. 2. There is a confirmatory deed on record dated December 1994 which effects the original deed dated 1986. 3. There was no knowledge of the mistaken identity which made the title error and therefore it is an excusable error. 4. To deny this application would cause significant hardship and would render the lot non buildable. 5. The petitioner has been paying taxes at a buildable rate for this lot 6. with reference to the lot in issue Map 170,panel 17M,all the lots off Michael Hamblin Road appear to have been built upon and there is no opportunity to buy adjoining land 7. In granting this variance it would not be detrimental to the neighborhood nor would it be in derogation to the spirit or intent of the zoning ordinance. 8. Specifically there are no findings regarding Chapter 40A,Section 10 for soil,shape or topography. It appears the applicant is seeking to modify an existing Use Variance No.1975-57 that was issued for the restaurant function only. The applicant now is seeking to add an addition to the existing restaurant, increase the number of seats and exterior signage. Use Variance No. 1975-57 appears to have been issued due to questions raised by the Building Commissioner' and confusion over the interpretation of a then recent amendment to the zoning ordinance which permitted as a conditional use golf courses within residential zoning districts2. According to information supplied in the ZBA File (Appeal No. 1975-57) The Dining Room seating was 70 seats, the Grill Room seating was 44 seats, and the lounge 36 seats, for a total seating capacity of 1503, food service use of 114 sets Today the applicant is.seeking to add 2,280 sq.ft. to the existing club house and increase the food service seating to 144 seats. The on site parking is to be expanded to 163 parking spaces. The present Variance No. 1975-57 has several conditions that although at the time may have been needed, today appear a little restrictive, somewhat impractical and hard to enforce. Specifically conditions No. 2, 3, and 4. • Condition No. 2 that.restricts food service to the hours between 2 hours after sunrise and 2 hours after sundown is a little impractical, especially for a year round facility. • ' See ZBA Application dated August 6, 1975 Question 12. 2 See ZBA Decision Variance No. 1975-57, page 3. 3 From building Inspectors Letter dated July 2, 1975 to Mr. Joseph Williams, Chairman Zoning Board of Appeals. 1 Planning Department-Staff Report Appeal No. 1996-35-lyanough Hills Golf Club • Condition No. 3 prevents any advertising of the food and beverage facilities on site, including posting of a sign for the restaurant. • • Condition No. 4 further restricts functions such as weddings and social events. As most residents and visitors know, a sign for the restaurant exists, food service continues past the two hour after sunset restriction and social and wedding function have occurred on-site. These activities have become normal functions associated with most golf course facilities although in this particular case would technically be a violation of the Use Variance. During the summer months it can be difficult to find large facilities for weddings and the need for this exists. The fact that the facility already exists and does provide and support year round tourism should be considered in appraising the proposal. Encouraging and facilitating year-round tourism is a goal of the Draft Local Comprehensive Plan. The average daily traffic in this area of Route 132 is estimated by staff to be between 30,000 to 34,000 vehicle per day4. This particular section of Route 132 was not apprised as to the level of service in the 1992 Route 28 & 132 Traffic Circulation Study. Given the other level of services along the roadway, staff would suggest that this particular section is at a Level of Service D or perhaps C given the limited number of curb cuts in the area. Additional Note: At the Request of Licensing Authority, the applicant is reminded that any change in the floor plan can not occur without notification and approval to the Licensing Authority. Also Please Note: • It has been brought to the staffs attention that the taxes for the fiscal year 1996 that were mailed on 12/20/95 are still outstanding. The bill that was mailed on 4/1/96 shows a balance of -$27,718.88 due by May 1, 1996. The applicant should be aware of Article 2 of the Town of Barnstable General Ordinance and MGL Ch. 40, Section 57 that provides for the withholding of local permits in instances where taxes are not paid. The applicant should make arrangements with Tax Collector, Maureen McPhee @ 790-6353. Site Plan Review Committee has found the plan approvable. The department is concerned that the berm identified along the new parking area to the west side appears to be located within the right of way of Route 132. The applicant must secure permission for any grading within the State layout from the Massachusetts Highway Department. Any approval from the town does not supersede this requirement. The applicant should also present the plans to Commonwealth Electric for their approval for the development within the power line transmission easements. Recommendation: Should the Board find to grant this, it should consider the following: 1. The applicant shall landscape the area between the right of way of Route 132 and the parking area.
