Crossen Building Commissioner Town of Barnstable 367 Main Street Hyannis, MA 02601 RE: Request for Determination of Buildability of Undersized Lot Locus: Lot 50, Plan Book 272, Page 58 279 Monomoy Circle, Centerville, MA Parcel 1D#: Map 190, Parcel 208 Land Area: .44 Acres ''\\ Zoning District: Residence B (RB) Dear Mr. Crossen, I am writing to request a determination from you that for zoning purposes, the above-referenced lot is a "non-conforming lot" exempted from the current minimum lot size provisions of the Barnstable Zoning Ordinance. The facts regarding the lot are as follows: 1. The.lot was established on a plan of land dated February 12, 1973. The plan is recorded at the Barnstable County Registry of Deeds in Plan Book 272, Page 58. Locus is shown as Lot 50 on said plan. The subject locus has 19,208 square feet of land (440 acres) and 93.06 feet of frontage on an approved way. 2. The northerly abutter of Lot 50 is Lot 51. Lot 51 on plan at Plan Book 272, Page 58 was conveyed to ownership separate fi-om the subject Lot 50 on August 30, 1974 by a deed from the developer, Allan E. Small, Inc., to Theodore John Gumienny and Ethel Elizabeth Gumienny by deed dated August 24, 1974 and recorded in Book 2090, Page 149. Ethel E. Gumienny changed her name to Arleen Ethel Gumienny by decree of the Probate Court dated Ralph M. Crossen Building Commissioner February 18, 1999 Page 2 of 4 February 24, 1987 and recorded in Book 6612, Page 301. Theodore Gumienny died February 27, 1988 (see Death Certificate recorded at Book 6618, Page 192). Arleen E. Payne, formerly known as Ethel Elizabeth Gumienny, conveyed Lot 51 to Robert J. Payne, Sr. and Arlene E. Payne by deed dated August 10, 1994 and recorded in Book 9318, Page 224. A copy of these documents are attached for your reference. Since August 24, 1974, Lot 51 has remained in ownership separate from the subject Lot 50. 3. The norwesterly abutter of Lot 50 is owned by Harry E. Capozzi and Gloria M. Capozzi. This parcel was conveyed to them by Allan E. Small, Inc. by deed dated July 2, 1971 and recorded in Book 1517, Page 1023, a copy of which is attached. Since at least July 2, 1971, the ownership of this parcel and Lot 50 has been separated. 4. The southwesterly abutter of Lot 50 is currently owned by John W. Stobbart, []I and Marion A. Stobbart. Allan E. Small, Inc. conveyed this parcel to Chester L. Vogler and Elizabeth A. Vogler by deed dated September 7, 1971 and recorded in Book 1526, Page 247. Certain title problems were cleared up by Final Disposition of the Land Court dated January 10, 1973 and recorded in Book 1791, Page 69. Chester L. Vogler and Elizabeth A. Vogler conveyed these premises to John W. Stobbart, III and Marion A. Stobbart by deed dated August 19, 1997 and recorded in Book 10927, Page 275. -A copy of these documents are attached for your reference. Since at least September 7, 1971, this parcel has remained in ownership separate from the subject Lot 50. 5. The parcel of land currently belonging to Louis E. Vuilleumier, which is the southerly abutter to locus, is shown on the plan at Plan Book 272, Page 58 as Lot 49. The developer, Allan E. Small, Inc., conveyed Lot 49 to William G. Crowley and Maureen Crowley by deed dated September 17, 1976 and recorded in Book 2399, Page 170. The Crowley's conveyed Lot 49 to Olivia It. Vuilleumier by deed dated April 15, 1982 and recorded in Book 3468, Page 213. When Ms. Vuilleumier died July 18, 1992, Lot 49 passed through her Ralph M. Crossen Building Commissioner February 18, 1999 Page 3 of 4 estate (Barnstable Probate#92-0852A1). Ms. Vuilleumier's heirs, Louis E. Vuilleumier, Pierre Vuilleumier and Virginia M. Vuilleumier, conveyed Lot 49 to Louis E. Vuilleumier by deed recorded in Book 8985, Page 175. A copy of these deeds are attached for your reference. Since at least September 17, 1996, Lot 49 has remained in ownership separate from the subject Lot 50. 6. Therefore, Lot 50 has been held in ownership separate from adjoining lots since at lease September 17 1976. 7. On February 28, 1985 by Article 1 of the Town Meeting of the Town of Barnstable, the minimum lot size for the subject area was increased to 43,560 square feet. Based on the foregoing, it is my opinion that under Section 4-4.2(l) of the Town of Barnstable Zoning Ordinance, this lot was not held in common ownership with any adjoining land at the time of the Zoning change which made it non- conforming; and has a minimum of 5,000 square feet of area and 50 feet of frontage, and conformed to the existing zoning when legally created; and was separately owned at the time of every zoning change which made it non- conforming. Therefore, it is my opinion that this lot is "grand fathered" and may be built upon for residential purposes because the lot conforms with Section 4-4.2(1) of the Zoning Ordinance. Please inform me by signing a copy of this letter and mailing; it back to me as to whether or not in your opinion this lot may be build upon for residential purposes. Ralph M.
