In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. I spoke to the caller, Mr. Swenson earlier this morning. The property is actually 102 Nye's Neck Rd East. It is an island. He said there is a female resident and a young boy that live there without power, septic or town water. He says her looked into this matter and the town has no record of a well or septic for this property. Ultimately, his complaint can be reduced to that of a noise complaint resulting from consistent use of a generator as a substitute for a permanent power source. Mr. Swenson advised me that he has researched this matter extensively and he (and the neighbors he claims he represents)will not go away until the generator is permanently turned off.. He has consulted with an attorney as well as our police chief. Mr Swenson says the island resident is required to connect to power if it is available and he knows the power was cut a number of years ago so power is obviously available! He is adamant that she should be made to connect and discontinue her reliance on a (noisy) generator. He indicated that the neighbors have offered to help her to re-connect but she refuses. Now, Mr. Swenson says they(him and his neighbors) are demanding that the generator be silenced once and for all and we should make her do what is required. "It's very simple", he said.. First, I told him just because there is no record of a septic or well does not mean they are not present. I explained that noise violations are usually addressed by the PD because we are not available at night. As a result of my comments, Mr Swenson started to explain the law and the ordinances to me and repeat what his interpretation of what was told to him by the Chief and his attorney. stopped our conversation at that point and said I would put him in touch with you. I did not want to debate the nuances of enforcement with someone who thinks he knows how to do our jobs. It was quite obvious that he was closed to hearing anything that he did not want to hear. He complained about being shifted from one department to another when I referred him and then he again (politely) demanded enforcement and reiterated that it is very simple- make her connect and the need for the generator will go away and they will be happy. When someone tells me they know and understands our laws and ordinances, then proceeds to explain them to me and tell me how simple it is, I have no choice but to refer the matter to someone higher on the food chain. He originally called you because someone told him you are the director for all of the disciplines involved with this complaint-health, conservation, &zoning, wiring and building, etc. He asked me to explain and forward what he told me about the complaint and as such I am providing you with that information in this email. FYI: I believe the woman may have some mental health issues if I remember correctly. I think DCF may have investigated her as well. It is my recollection that Health staff was met at the door by the female resident and politely but firmly ordered to immediately leave the property. Tim (Haz Mat) may have been out there-status unknown. Mr. Swenson stated he spoke to Wiring Inspector recently- status unknown. I am contacting COMM FD to see if they want to check on the storage of fuel for the generator. Robin C. All connections and nailing must meet the requirements herein and as illustrated in the booklet in order to be in compliance with the building code. The contractor is responsible to ensure all connections, , nailing,and anchor bolts are visible to the inspector at the time of the framing inspection/foundation.inspection.The contractor must reference the Simpson Strong Tie C-2011 catalog for all strap,hangar,and tie installation requirements and limitations. This document and the attachments as well as a copy of the WFCM booklet must accompany all sets of plans submitted to the building department and issued to the contractor/subcontractors unless the plans are updated with notes and details that reflect the requirements stated in this document and attachments. Swenson requested a special permit to construct an addition to an existing single-family dwelling that would encroach on the required 35 foot setback to wetlands and 50 foot setback from mean high water on a Great Pond. The subject property was located on the peninsula of land between Wequaquet Lake and Bearse Pond in Centerville. The lot was one acre in area and developed with a single-family dwelling. According to the Assessor's record, the dwelling was constructed in 1975. It is a two story,three- bedroom house with 1,100 square feet of living area. The construction of the dwelling predates adoption of the wetland setback and Great Pond setback requirements in 1983 and 1979 respectively. The house was served by a three bedroom on-site septic system. The lot had significant wetland impacts along the Bearse Pond frontage. There was also a wetland delineated on the southwest portion of the lot. The lot and surrounding areas are designated by the National Heritage Endangered Species Program as a Priority Habitat of Rare Species. The dwelling was accessed from Nyes Neck Road East by a paved driveway. The driveway was shared with the lot to the south; a recorded easement agreement grants access rights over the driveway as shown on an ANR plan. Procedural & Hearing Summary i Special Permit No. 2012-033 to allow expansion of a preexisting nonconforming single-family dwelling was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on May 8, 2012. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on June 27, 2012 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were Board Chair Laura F. Shufelt, Craig G. Larson,Alex M. Rodolakis, Brian Florence, and George T. Zevitas. Christian Swenson represented himself before the Board. Also present were Heather Swenson and Steve Wilson from Baxter Nye Engineering and Surveying. Mr. Swenson explained that his family had recently purchased the single-family home and was looking to add storage areas. He explained that the addition had no foundation and portions would be located on top of the existing driveway. Mr. Swenson indicated that their house was the smallest in the neighborhood and that the house would still be smaller than average after the addition. In response to questions from the Board, Mr. Swenson indicated that no part of the addition would be habitable and there would be no plumbing in the new building. He confirmed that there no interior partitions are proposed,just large open storage areas. Public comment was requested and no one spoke in favor of, or in opposition to the request. Two letters of support from direct abutters were submitted for the record. Findings of Fact At the hearing of June 27,2012, the Board unanimously made the following findings of fact for Appeal 2012-033, a request for a special permit tiled by Christian H. Swenson to expand a preexisting nonconforming dwelling at 110 Nyes Neck Road East, Centerville: 1. Christian H. Swenson petitioned for a Special Permit in accordance with Section 240-92(B) Buildings or Structures used as single-or two-family residences. The petitioner is proposing to construct an attached garage/storage addition that encroaches into the required setbacks to wetlands and Great Ponds. 2. The subject property is located at 110 Nyes Neck Road East, Centerville,MA as shown on Assessor's Map 323 as Parcel 011-001. It is in a Residence D-1 Zoning District. 3. A Notice of Intent for the project was approved by the Conservation Commission on March 13, 2012. To mitigate the encroachment Into the 50 foot wetland buffer,the Petitioner is required to restore an area delineated on the plan of record as'proposed mitigation area'to a natural state. Extensive invasive species will be removed from the area and replaced with native vegetation. 4. Section 240-92(B)of the Barnstable Zoning Ordinance allows for expansion of a preexisting nonconforming structure used as a single-family residence by special permit where the expansion intensifies the degree of the preexisting non-conformity and does not conform with the bulk regulations in the district. The existing structure was constructed in 1975, prior to the adoption of the setback regulations from wetlands and Great Ponds. 5. Site Plan Review is not required for alteration or expansion of a single-family residential structure. 6. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 7. That the proposed expansion will not be substantially more detrimental to the neighborhood than the existing building or structure. The addition shall be constructed in substantial conformance with the plan entitled"Wetlands Permit Plan—Proposed Addition"drawn and stamped by Baxter Nye Engineering and Surveying, last revised April 25, 2012 and the construction drawings entitled `Swenson—110 Nyes Neck Road East' dated April 28, 2012. 3. Provided that the property is connected to an on-site septic system, the number of bedrooms on the property shall be limited to three. 4: The development, use, and maintenance of the property shall be in compliance with the Order of Conditions issued by the Conservation Commission. 5. Further expansions or additions to the dwelling and non-water dependent accessory structures shall be prohibited within 35 feet of wetlands or 50 feet of mean high water on Bearse Pond. 6. The decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division prior to issuance of a building permit.
