The property is within the Residence F Zoning District and the Resource Protection Overlay District that today requires all new lots to be a minimum of two acres. According to the Assessor's record,the dwelling was built in 1900. The Board asked about standing,noting that the applicant is James Quigley and the owner is identified as SMT Realty Trust. Mr.Kirrane stated that Mr. Quigley is the builder. The Chairman noted that the applicant,the person to whom the permit is to be issued,must be the owner of the property or a person with an interest in it the applicant must have standing. Mr.Kirrane stated that the trustee of the trust will convey the property to Mr. Quigley and then the permit can be issued to Mr. Quigley. Public comment was requested and no one spoke in favor or in opposition to the request. Upon receipt of that document the Board determined that the applicant had standing. Findings of Fact: At the hearing of July09,2003,the Board unanimously made the following findings of fact: 1. Appeal 2003-76 is that of James Quigley seeking a Special Permit in accordance with Sections 4-4.3 Non- Conforming Building Used as a Single or Two-Family Residence and findings under MGL Chapter 40A Section 6 for the demolition and reconstruction of a single-familydwelling on an undersized lot. The property is shown on Assessor's Map 173,Parcel 029 addressed 50 Oak Street,Centerville,MA in a Residential F Zoning District. 2. The subject property is a 0.69-acre lot located at 50 Oak Street in Centerville just north east of the intersection with Race Lane. The property is within the Residence F Zoning District and the Resource Protection Overlay District that today requires all new lots to be a minimum of two acres in size. According to the Assessor's record,the dwelling was originally built in 1900. It is a one-story,two-bedroom single- familydwelling of 682 sq.ft. of living area. 3. In Appeal 76 of 2003 the applicant seeks to demolish the existing structure on the undersized lot and reconstruct a larger structure in compliance to the required setback of the district. Demolition and reconstruction requires a finding under MGL Chapter 40A section 6 to permit the demolition of the existing structure and reconstruction of a new dwelling. 4. According to plans presented the new dwelling is to be a two-story,four-bedroom structure estimated to be 2,352 sq.ft. of living area. The entire gross area of the structure including the garage and covered porch is estimated at 3,044 sq.ft. A 12 by 12 foot open-air deck is also being proposed. Total lot coverage by structures is estimated at 6.26% of the lot area. 5. The Assessor's record indicates that the existing structure is over 75 years old. If so,it is subject to the Historic Commission demolition delay ordinance (General Ordinance Article XLIX—Protection of Historic Properties). 6. According to the application submitted,the applicant is a James Quigley.Mr. Quigley has provided the Board with a deed to the property to establish that he has standing to be before the Board and is owner of the property. 2 r 7. In accordance with MGL Chapter 40A,Section 6,the proposed new dwelling does not intensify the alleged nonconformitynovis it substantially more detrimental to the neighborhood than the former dwelling. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the appeal to permit the demolition and reconstruction with expansion of a single familydwelling on an undersized non-conforming lot. The reconstruction shall eliminate all structure nonconformities and the new building shall conform to the required setbacks and is subject to the following conditions: 1. The dwelling shall be located and site improved as shown on a plan entitled"Proposed Sewage Disposal System prepared for James Quigley House No. 50 Oak St.Centerville,Mass." dated August 16,2002 and drawn by Cape&Islands Engineering. 2. The dwelling shall be built substantiallyin conformance to plans presented to the Board entitled"Quigley Builders" as drawn byDevin Custom Designs,and two sheets.
