The facts regarding the lot are as follows: 1. The lot was established on a plan of land dated June 12, 1984 . The plan is recorded at the Barnstable County Registry of Deeds in Plan Book 388, Page 74 . Locus is shown, as Lot 1 on said plan. The subject locus has .38 acres and 144 . 14 feet of frontage on an approved way (a copy of the plan is enclosed for your records) . 2. Lot 1 was conveyed on November 2, 1984 from Earle C. Williams and Beverly L. Williams to Earle C. Williams, Trustee of E.C.W. Realty Trust, the current owner of locus. This deed is recorded in Book 4307, Page 13. A copy of this deed is attached for your reference. 3. The only abutting lot, Lot 2, was also conveyed on November 2, 1984 by Earle C. Williams and' Beverly L. Williams to Beverly L. Williams, Trustee of B.L.W. Realty Trust. . Mr. Ralph N. Crossen Building Commissioner December 8, 1997 Page 2 4 . B.L.W. Realty Trust is the current owner of Lot 2 . On November 13, 1995 R. Arthur Williams was appointed Trustee of B.L.W. Realty Trust. A copy of this appointment, recorded in Book 9927 , Page 288, is attached for your review. 5. The beneficiaries of E.C.W. Realty Trust and B.L.W. Realty Trust were different. An Affidavit in support of this statement is attached hereto and incorporated herein by reference. 6. On February 28, 1985 by Article 1 of the Town Meeting of the Town of Barnstable, the minimum lot size for the subject area was increased to 43,560 square feet. 7 . At the time of the change of zoning to 43,560 square feet the lot was not held in common ownership with any adjoining land; had an area in excess of 5,000 square feet and greater than 50 feet of frontage; conformed to the existing zoning when it was created; and has been separately owned at the time of every zoning change which made it nonconforming. Based on the foregoing it is my opinion that under Section 4- 4 .2 ( 1) of the Town of Barnstable Zoning Ordinance this lot was lawfully laid out on a plan which complied at the time of recording with the minimum area, frontage, width, and depth requirements of the zoning by-law in effect at that time. The lot was transferred into separate ownership prior to the change in Zoning that made it non-conforming. There has been no common ownership with that of adjoining land located in the residential district since the change in minimum lot size impacted this lot. Therefore, it is my opinion that this lot is "grandfathered" and may be built upon for residential use because the lot conforms with Sections 4-4 .2 ( 1). of the Zoning Ordinance.
