At that time, the record owners of Parcel 31-1, 31-2 and 31-3 were William F. O'Toole and Dorothy J. O'Toole. On June 18, 1987, the Town of Barnstable Zoning Board of Appeals granted a variance to Dr. William F. O'Toole from area requirements for Lots 2 and 3 and to allow the entire parcel (parcels 31-1, 31-2 and 31-3) to be divided into three lots as shown on a sketch plan dated November 24, 1986. The variance is recorded at Book 5869, Page 343. See Tab No. 1. The sketch plan filed with the petition for variance divides the land into three lots as follows: Lot 1 - 44,149 square feet with dwelling Lot 2 - 36,056 square feet Lot 3 - 33,136 square feet Total 113,341 square feet' 'See Tab No. 2 f i 21020e1.1tr On February 8, 1988, a plan of land dividing the property into three (3) lots was endorsed by the Town of Barnstable Planning Board as "Approval Not Required." This plan was recorded in the Barnstable Registry of Deeds on September 27, 1988, in Plan Book 453, Page 78. See Tab No. 3. The recorded plan differs slightly from the sketch plan in the following respects: 1. The sketch plan indicates a total area of 113,341, while the recorded plan indicates a total area of 112,387, a difference of 954 square feet.' 2. Lot 1 on the recorded plan is slightly larger than Lot 1 on the sketch plan, with fifteen more feet of frontage. 3. Lot 2 on the recorded plan is slightly smaller than Lot 2 on the sketch plan, with about fifteen feet less frontage. 4. Lot 3 on both plans have the same dimensions, including frontage, but the areas on the two plans differ slightly in area.' By deed dated January 26, 1990, recorded in Book 7044, Page 256, William F. O'Toole and Dorothy J. O'Toole conveyed Lot 3 to Dorothy J. O'Toole, individually. See Tab No. 4. Dorothy O'Toole individually is the present owner of Lot 3. Lot 2 is presently owned by William F. O'Toole, Trustee of The O'Toole Family Trust, by deed dated January 26, 1990, recorded in Book 7044, Page 257. See Tab No. 5. Since January 26, 1990, Lot 3 has been held in ownership separate from any adjoining land. Massachusetts General Laws, Chapter 40A, Section 10, provides, in part that.. "If the rights authorized by a variance are not exercised within one year of the date of the grant of such variance such rights shall lapse; .... .. The variance issued by the Zoning Board of Appeals authorized the subdivision of three lot and a variance form area requirements for Lot 2 and Lot 3. The plan was endorsed by the Planning Board within one year of the date of grant.' Under the authority 'The sketch plan was based on areas from old recorded plans. This could account for discrepancy in area between the sketch plan and recorded plan. 'See Footnote 1 for possible explanation of discrepancy. 4The variance was approved on June 18, 1987 and the plan was endorsed on February 8, 1988. 21020e1.1tr of Hogan v. Hayes, 19 Mass. App. Ct. 399 (1985) and Asack v. Board of Appeals of Westwood, 47 Mass. App. Ct. 733 (1999), it is my opinion that the variance was sufficiently exercised by endorsement of the plan by the Planning Board on February 8, 1988. and has not lapsed, even though the plan was not recorded within one year after the grant of the variance. I did not consider the recording date of the deed material, where no subsequent zoning change occurred prior to the recording. See Asack v. Board of Appeals, supra. Gail Nightingale found that due to the shape and site of the parcel, variance conditions do exist.
