At the conclusion of the hearing, the Board took said petition under advisement. A view of the

On __ May 28, _ _ 19 Al—, The Board of Appeals found
Paul A. Merithew, Registered Land Surveyor, presented his petition for
variance relief at Map 246, Lot 198 Pena Way, West Hyannisport in an RB
zoning district for a parcel containing a foundation and 8,230 square feet.
The existing foundation was staked according to an older site plan
and is only 17 feet from the front yard setback in an area requiring a 20 .
foot setback. There were several revisions to the. site plan and that is how
the error came about. A foundation certification has been submitted to the
file dated March 13, 1987.
There was no one present at the hearing in opposition or support of the
petitioners request for a variance of three feet.
Dexter Bliss made a motion to grant the relief as requested, on the basis
that there is some uniqueness about this particular lot which abutts part of
an- old bog - to grant this relief would not be substantially detrimental to
the neighborhood nor in derogation of the spirit and -intent of the zoning by-law the motion was seconded by James McGrath.
The Board voted unanimously to grant the relief with the condition that
the encroachment be no greater than three feet as indicated on the Plan, and
the building comply with the footprint, as desigriatted on the foundation
certification submitted with the filing.
