Merithew, Registered Land Surveyor, presented his petition for variance relief at Map 246, Lot 198 Pena Way, West Hyannisport in an RB zoning district for a parcel containing a foundation and 8,230 square feet. The existing foundation was staked according to an older site plan and is only 17 feet from the front yard setback in an area requiring a 20 . foot setback. There were several revisions to the. site plan and that is how the error came about. A foundation certification has been submitted to the file dated March 13, 1987. There was no one present at the hearing in opposition or support of the petitioners request for a variance of three feet. Dexter Bliss made a motion to grant the relief as requested, on the basis that there is some uniqueness about this particular lot which abutts part of an- old bog - to grant this relief would not be substantially detrimental to the neighborhood nor in derogation of the spirit and -intent of the zoning by-law the motion was seconded by James McGrath.
