The Board of Appeals found ... _......._..___._.. _. , T Attorney Albert Schulz represented the petitioners, Guy M. Weyl and Eveline M. Weyl, who are the owners of LOTS 3A and 3B on a plan prepared by Baxter & Nye, Inc. , which is recorded in Plan Book 421, Page 42. The house on an abutting parcel of land, owned by Stanley A. Tucholski, is encroaching slightly on petitioner's property. Petitioners have agreed to convey to Mr. Tucholski LOT 3B as shown on the Baxter & Nye, Inc. plan. Depending on how Section J. Paragraph C is interpreted, LOTS 3A and 3B combined could be a nonconforming use because its shape number of 33 exceeds the required number of 22. By conveying LOT 3B to the abutter Tucholski; the shape : number of the remaining parcel owned by Petitioner, i.e. LOT 3A will be 29. Since the-shape number changes, a Special Permit is required under Section P, Paragraph A.6. The petitioner proposes only to change the boundary line between their property and the abutter's property in order to accumulate the encroaching structure. No one spoke in favor of or against the petition. The hearing was closed and the Board took the matter under advisement. The' Board found that the conveyance of LOT 3B will change the shape nuinber -of the petitioner's property from 33 to 29 and thus falls within Section P, Paragraph 6 of the By—Law.
