Ryan Barber rbarber@capecodonline.com September 05,2013 2:00 AM CENTERVILLE—From a distance,the signs looked like they could be advertising a lemonade stand or yard sale outside Maria Cholanian's home. But as the red lettering came into focus, it quickly became clear that 258 Phinney's Lane is not a quaint summer home. "Home sweet'crack'house,"read one sign,with the word"home"circled and crossed out. "Family under siege by heroin,"read another. For about eight hours Tuesday, Cholanian sat beside those signs in a cushioned lawn chair, speaking to anyone who would listen about the 20-year-old tenant she is accusing of being abusive, addicted to heroin and three months behind on his rent. "I have been threatened, and it seems to me there's nothing anyone can do about it. Right now,we don't even feel safe in our own home,"she said."This here, it this chair, is where I feel safe right now." Her message seemed to resonate from that chair Tuesday,as drivers pulled over to,thank her or share their' concerns about the Cape and Islands'drug problem—which some passers-by and the police said spills over into many landlord-tenant disputes. On Wednesday,the sign on her mailbox read,"Thank you neighbors!" Cholanian, 53, lives at the house with her ex-husband and their 17-year-old son. In October, Cholanian said she made a verbal agreement with the tenant to pay$650 a month in rent. She alleges she discovered her tenant was using'drugs after he overdosed early in the morning of June 1.. Barnstable police records from that morning show an emergency medical response to her address shortly after 3 a.m. Since then, Cholanian said the tenant has refused to pay rent—even after she lowered it to$600 per month— and has terrorized her household with verbal threats. Cholanian is trying to sell her house but said she has been unable to show it because hypodermic needles are in plain sight inside the tenant's room. Cholanian tried to obtain an abuse prevention order against the tenant, but it was denied Aug. 28,according to court records. On Aug. 23,tensions boiled over when Cholanian was charged with assault and battery with a dangerous weapon, assault and battery and resisting arrest after,according to police, she kicked in the tenant's door,which struck him in the head. Barnstable police allege Cholanian also-.punched the tenant's girlfriend and pulled her hair. The Times is withholding the names of the tenant and his girlfriend because neither has been charged. In an interview Wednesday,the tenant admitted that he has struggled with addiction since age 14 and overdosed on cocaine June 1. But the tenant,who said he works two jobs, said he has faithfully paid his rent, has copies of his rent checks and has been actively searching for a new place to live in recent months. Cholanian pleaded not guilty and is scheduled to appear in court Sept.27. She said she plans to file a formal complaint against the police for not allowing her to explain her side before being arrested. In the weeks leading up to her arrest, Cholanian said she had called twice and visited Barnstable police headquarters up the street on at least three occasions to ask for help. The police were unresponsive, she said. But on Tuesday, Cholanian's display earned her face time with four members of the Barnstable police force, including Chief Paul MacDonald. "Obviously it raised the eyebrows of a lot of people driving by,"MacDonald said. MacDonald said the department is investigating how it responded to Cholanian's dispute with her tenant. "We are looking into that.We have the names of the officers who she did call and speak with. I have no idea what she told them,"MacDonald said."But,obviously, if she's alleging some type of drug activity in that house,we have an extremely proactive narcotics division in this department. But you don't do a narcotics investigation in one,two or three days. Usually it takes weeks,if not months,to do a narcotics investigation." MacDonald would not confirm or deny if there was an ongoing drug investigation. A landlord's report on a tenant does not immediately trigger an investigation because the homeowner has no right to provide access into a leased room, MacDonald said. - The department handles landlord-tenant disputes"quite often,"MacDonald said,"and we always advise them to go through the civil process." That process has begun. On Friday, Cholanian filed a 14-day notice to quit, citing the tenant's failure to pay rent. Barnstable County Special Sheriff Jeffrey Perry said the tenant was served the notice the same day,giving him until Sept..13 to leave or face court action. "Tenant at will"agreements still entitle the tenant to the rights spelled out under state law, said attorney Herb Lach, of Brewster,who helped found the Cape Cod Property Owners and Managers Association. Lach said tenants served with 14-day notices can stay at a property if they pay what they owe within 10 days. Either the landlord or tenant can terminate a verbal agreement by giving notice 30 days or one month before the next rent payment is due, "whichever is longer,"according to the state attorney general's"Guide to Landlord/Tenant Rights." But Cholanian said the notice is just part of the eviction process, providing no guarantee that the tenant will move out. And,feeling that her efforts thus far have been futile, Cholanian decided to call attention to a problem she said is often kept behind closed doors. "This is a different place now.This is a different Cape Cod,"she said Wednesday."And I'm not the only one going through this."
