According to Gloria, your office had received numerous complaints, sometimes as many as two a day, prior to her June telephone call about the motor home. When Gloria came by this morning, she told me that your office has received recently one or more additional calls. Your office is aware that I suffer from physical disabilities which, among other things, make it difficult for me to walk. The Commonwealth of Massachusetts has assigned me handicap plaque #80156 which, as you know, allows qualified individuals to park in areas that would otherwise not be appropriate. From time to time, I display the plaque in the motor home as I often use it as my primary vehicle. I will do what I can to park the motor home away from the front of the house, but because of my disability, it is often necessary for me to leave it close to the front door and I believe this supersedes zoning by-law section 4-8. Although my wife and I are sensitive to the needs of our neighbors, we are disturbed by the number of complaints and the fact that we do not know who is making them. You may be interested to know that an anonymous individual called the Massachusetts Board of Barbers not long ago and falsely reported we had someone working here in the shop that was not properly licensed. Since my wife and I took over this location several months ago, we are the only two people who have worked here and both of us are properly licensed. Because we felt cars were driving through too fast, particularly where our two young daughters sometimes play outside, we notified the Barnstable Police and set up a barrier across the driveway to slow people down. In addition, we have had a number of people poking around the grounds from time to time for no apparent reason. These events have lead us to the conclusion that someone is trying to harass us with unfounded complaints. Pursuant to the applicable provisions of the Freedom of Information Act, I hereby request that you provide us with the identify of any complaintants who have contacted your office, together with copies of all pertinent documents and papers in our file relative to matters mentioned in this letter or with otherwise affect me, my wife or our property. You may apply to the Zoning Board of Appeals for a special permit to allow the apartment attached to the store to be used by a family member. If the special permit is granted,please be aware that it will only be valid as long as the requirements of section 3-1.1(3)(D) of the Zoning Ordinances are met and that the permit is nontransferable from owner to owner. Michael O'Neil presented. the petition and reference was made to, the previous appeal on the property in question, which allowed the petitioner to re-institute and change a non-conforming use from a greenhouse to a beauty salon: Permission for this change was granted under appeal no. 1977-65. Presently, the petitioner is restricted so that the existing driveway cannot be paved and only four persons can be employed on the premises at any one time. The gravelled driveway is a hazard to to the safety of the beauty shop patrons, particularly the elderly and those who use walkers, crutches, etc. Two of the people of the four employees allowed on the premises at one time, are part-time and the petitioner does not wish to increase the number of chairs which are used in the beauty shop for hairdressing purposes, but would like to hire a manicurist and a receptionist. There are now- six hairdressing chairs in the beauty shop. Mr. O'Neill said that the petitioner is asking for the removal of restriction #1 and restriction #4 but is agreeable to having all other conditions imposed under appeal no. 1977765 in force. The petitioner is also agreeable to having a limit of eight people employed on the premises at one time. No one spoke in favor of or in objection to the petition and the Board took the matter under advisement. The Board found that restriction #1 and restriction #4 imposed under the petitioner's previous appeal (1977-65), unreasonably' restrict the operation of the beauty shop, business and voted unanimously to eliminate these restrictions. These are two buildings at the locus; one is a residence and the other is a former greenhouse which was also used for various business purposes. The greenhouse has not been used since the death of the owner, in 1974. Affadavits were presented to the Board by Mr. Bianchi, confirming the previous business uses. - There would be no change in the use of the residence and no major alterations to the exterior of the greenhouse.
