A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 1,2004, continued to December 8, 2004, at which time the Board found to grant the appeal. Board Members deciding this appeal were, Sheila Geiler, Gail Nightingale,Randolph Childs and Acting Chairman Ron S. Jansson. Attorney John R.Alger presented the appeal before the Board. Jay and Steve O'Brien, owners of the insurance company were also present. Mr. Alger noted that the existing lot measures 50 feet wide by 300 feet deepand is not conducive to the existing non-co use. He explained that there would be no change in the business use but just a reduction of the lot from 15,000 sq.ft. to 7,500 sq.ft. The division would not effect in any way the on-site septic. The issue of Site Plan Review was discussed and it was noted that the applicant had applied for Site Plan review but no decision issued. A letter from the Building Commissioner was submitted to the file. The Board expressed concern for adequacy of on-site parking. It was stated by the applicant that no cars park on Trinity Place and the existing paved parking is accessed off Pine Street. Public comment was requested and no one spoke in favor or in opposition to the request. The hearing was continued to December 08,2004 to provide time for the applicant to prepare a plan showing the location of the parking spaces. It was determined that 5 spaces would be required. At the continuance a new plan was presented showing the location of five on-site parking spaces. The Board noted that it was down to a four members only. Mr. Alger agreed to go forward with the four member Board. The Board expressed concerns.for possible future changes in the non-conforming use especially those of increased number of employees requiring more parking and for office uses that might also increase the need for additional.parking.. The applicant stated that he would accept condition on the number of employees and the use of the premises.
