Dear Mr. Geiler,
I am writing to you as a public official and as our neighbor on Riverview Lane
concerning a parcel of land known as Map 228, Block 90, "Lot 02". The property
is 0.17 AC in size. Recently, the property was surveyed and I believe that a perc
test was performed last week. I am concerned that this activity may be leading to
the application for a building permit. I believe that the property is owned by
Christopher J. and Laura Perry of 34 Roads End, Dennis, MA. The property is
located on Pine Street between St. Francis Xavier Cemetary and the home at the
eastern side of the entrance to Riverview Heights ("Lot 01"). The lot in question
also abuts our home at 353 Riverview Lane.
It is my understanding that Christopher J. and Laura Perry came to own this
property through a clerical error in their mortgage. Mr. Perry purchased both
Lots 01 and 02 on Block 90, Map 228 (429 Pine Street) in 1988 which in total had
a combined acreage of .36 acres. When Mr. Perry purchased the two adjacent
lots, he executed a mortgage that was only secured by Lot 1. Apparently, Mr.
Perry defaulted on his mortgage payments and the bank foreclosed on the
property in 1992. The property was subsequently sold to Timothy and Kathleen
Mahoney. They believed that they had-purchased both lots 01 and 02, as-did the
Town of Barnstable that charged them property tax on both lots for several years.
It was not until the installation of the sidewalk on Pine Street that it came to the
attention of Mr. Perry, the Mahoneys and the Town of Barnstable that the Mr.
Perry's bank had not properly secured both lots at the time he purchased 429
Pine Street and thus, he, not the Mahoneys, actually owned Lot 02.
Needless to say, I am very concerned that Mr. Perry will attempt to obtain a
building permit and a building will be erected on Lot 02. Lot 02 is below the
required lot size in our area and was created solely as a result of Mr. Perry's
default nearly ten years ago. I also believe.that the division of the lots made it
impossible for the Mahoneys' home to comply with the set back requirements.
Furthermore, I am concerned about the addition of another septic system in such

a small area and the need for a curb cut to allow access to the property. Another
septic system may overburden the area, especially since there are already two
(one failed and one new) septic systems on Lot 01. It should also be noted that
the property is located very near a herring run that feeds the Centerville River. In
addition, another curb cut onto Pine Street, across the sidewalk, could cause
confusion for both drivers and pedestrians and potentially lead to more accidents.
There are already four curb cuts in a very small area.
I would ask that you ensure that all the Town Departments (particularly the
Building and Health Departments) involved in reviewing applications related to
this property give them very careful consideration as the lot is extremely small
and was created by the current owner's default on a bank loan. As we all know,
the eco-system on Cape Cod is very fragile and we are already taxing it with the
existing,strpctures.
If this property is given a building permit, it seems to go against what the Town is
trying to achieve with designating Barnstable as a District of Critical Planning and
two acre zoning. I understand that there may certain instances in which building
permits are issued due to hardship but this does not seem to be one of those
cases, especially given how Mr. Perry came to own this property separate from
Lot 01.
