Thaler, Trustee of the Joan E. Thaler Revocable Trust, petitioned for a Modification of Variance No. 1956-26 pursuant to Section 240-125(B)(1)(c) of the Town of Barnstable Zoning Ordinance in order to demolish and rebuild a smaller, detached garage. Variance No. 1956-26 was granted in order to construct a 2-car garage and shed approximately 3 feet from the southwesterly side yard setback. The proposed garage will be placed approximately, at its closest, 6.4 feet where ten (10) feet side yard setback is required by Section 240-11(E) in the Residence 0-1 Zoning District in which the subject property is located. The subject property is located at 139 Point of Pines Avenue, Centerville, MA as shown on Assessor's Map 230 as Parcel 073. The subject property is a 0.56 acre lot on Wequaquet Lake with frontage on Point of Pines Avenue and Juniper Road. The property is improved with two single family dwellings built in 1953. There is also a detached garage/she and an accessory ramp and landing. Building 1 contains 1,873 square feet of living area (4,125 gross ) and 3 bedrooms. Building No, 2 contains 1,252 square feet of living area (gross 2,128) and 2 bedrooms. Previous Board actions: • Variance No. 1956-26 was a variance to allow the construction of a two-car garage and shed within three feet of the side yard setback. • Special Permit No. 1975-70 allowed the expansion of a preexisting nonconforming use to allow the expansion of the dwelling nearest to the water. •. Special Permit No. 2015-032 allowed the expansion of the dwelling. Proposal & Hearing Summary Modification Variance Petition No. 2020-021, a request to allow the Petitioner to remove the garage and replace with a smaller, less nonconforming garage was filed at the Town Clerk's office on April_21, 2020 and at the office of the Zoning Board of Appeals on April 24, 2020. A public r Bk 33258 Pg38 #48429 Town of Barnstable Manning and Development Department Decision Modification Variance 2020-021 —'I1ialer hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on May 27, 2020, at which time the Board found to grant the Modification Variance subject to conditions. Board members.deciding this petition were Alex Rodolakis, David Hirsch, Jacob Dewey, Paul Pinard, and Bob Twiss. The hearing was opened on May 27, 2020 with Attorney Marian Rose representing the Petitioner. Also present was Builder Chris Wood. Attorney Rose reviewed the existing rand proposed conditions. She reminded the.Board that this property is subject to a Variance from 1956 and the current owners seek to modify the variance by making the proposed garage more conforming to the required setbacks. Attorney Rose reviewed the criteria for the grant of a Variance and stated r this property is unique in-that the location of the septic, the existing topography and underground utilities make locating this garage,in any other location difficult. She also pointed out that there is a large tree and an existing fire place that creates locating the garage difficult. Any other location would create a financial hardship and would be impractical. Attorney Rose stated the existing garage is in poor condition with a cracked block foundation and requires replacement. Attorney Rose also mentioned that an email of support was received by Kerry Kent of .149 Point of Pines. She concluded that the project has been approved by the Conservation Commission. The Board discussed the topographical constraints. The Board asked for public comment. No testimony was taken. Findings of Fact At the hearing on May 27, 2020, the Board voted and made the following findings of fact in Modification Variance No. 2020-021, a request to remove an existing garage and replace with a smaller, less nonconforming garage. i. Owing to circumstances related to soil conditions, shape, or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located. The Board found that due to the existing topography, the location of the large tree, the existing septic.and underground utilities affecting this property _ and not others in the district, the proposed location of the garage is the only practical location. 2. A literal enforcement of the provisions of the zoning ordinance would involve substantial hardship, financial or otherwise to the petitioner. The Board found that locating the garage anywhere else on the property would create financial hardship and would not be practical 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. The proposed garage abuts a driveway and the project has received support from the neighbor. The Board voted to accept the findings as follows: AYE: Alex Rodolakis, David Hirsch, Jacob Dewey, Paul Pinard and Robert Twiss NAY: None Decision The Board voted to grant the requested Modification Variance with conditions as follows: 1. Variance No. 2020-021 is granted to Joan E. Thaler, Trustee of the Joan E. Thaler Revocable.Trust to remove the garage built pursuant to Variance No. 1956-26 and replace with a smaller less nonconforming garage at 139 Point of Pines Avenue, Centerville, MA. 2. The site development shall be constructed in substantial conformance with the site plan entitled "Site Plan" dated March 13, 2020 prepared for Patriot Builders by Bass River Engineering. All mechanical equipment associated with the structure (air conditioners, electric generators, etc.) shall be screened from neighboring homes and the public right-of-way. 5. ,This decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the ' Building Division prior to issuance of a building permit. The rights.authorized by this Variance must be exercised within one year, unless extended. Section 240-7(F) states that in residential districts, only one principal permitted building shall be located on a single lot. Relief is requested to allow the expansion of a dwelling where there are multiple single-family residential dwellings on the property. The subject property was a .56 acre lot on Wequaquet Lake with frontage on Point of Pines Avenue and Juniper Road. The property was improved with two single-family dwellings built in 1953. There was also a detached garage/shed and an accessory ramp and landing. There are two prior ZSA decisions on file for the property: 1956-26: A variance to allow for the construction of a two-car garage and shed within three feet of the sideline. 1975-70: A Special Permit for an expansion of a preexisting nonconforming use to allow the expansion of the house nearest to the water. Procedural & Tearing Summary Special Permit No. 2015-032 allowing an expansion of a preexisting nonconforming use was filed at the Town Clerk's office and office of the Zoning Board of Appeals on May 20, 2015. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on June 10, 2015 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Brian Florence, Alex M. Rodolakis, George T. Zevitas, David A. Hirsch, and Herbert K. Bodensiek. - Attorney James Norcross represented the Petitioner before the Board. Petitioner represented himself. Guest house on locus has been there since. 1956 and is little more than a shed. Petitioner wishes to expand guest house as it is right on the water, next to their pier and Petitioner and Mrs. Sears close the main house in the summer and move into the guest house. Neither .dwelling is rented and Petitioner has no intention of renting them. The Conservation Commission has approved this project already. The Board found that this was a routine application under Section PA 4 of the Barnstable Zoning By--Law, namely extension of a non-conforming use. The Board found that the extension was within their power to grant and that there would be no .detriment to the area involved nor derogation of the Barnstable Zoning By-Law and, therefore, the Board voted unanimously to grant this special. permit under Section PA 4. I must add that at that time my wife was in excellent health and could putwwith the conditions that existed. In the past two years she has developed a very bad back and most severe arthritis of the lower spine, knees and legs. She no longer can man- euver in the present kitchen and also must have more room. The present kitchen is a scant 6x6 ft. area and the only bedroom is 8x10 feet. I also feel in view of the fine houses that surround me, that this guest house at present is not an asset to this fine neighborhood. Our new plans will blend in with the neighboring residences and add charm and dignity to the area. It will enhance our property as well as the others.
