The property was subdivided-.by plan dated November 2, 1948 for Edmond S. Boucher. The predecessors to our current owners, Harold and Ellen Wald, purchased the property) in 1956 from Mr. Boucher and it remained in the Wald family until Mr. and Mrs. Berman purchased it in 2008. On information and belief, the main structure, being a 1,308 square foot two bedroom residence, was built prior to 1948. The detached garage and carport is believed to have been also in existence in 1948. - At some time after 1948, an apartment was constructed in the garage. In approximately 1957, a three bedroom seasonal-cottage, containing 1,751 square feet, was constructed at the water's edge. In 2010 Mr. and Mrs. Berman installed a Title 5 septic system on the property, replacing tone of the two pre-existing septic systems. Also in 2010, a new garage was constructed in accordance with a building permit in anticipation of the future demolition of the pre- 1948 detached garage and carport, described above. Mr. and'Mrs. Berman will be applying shortly for permits necessary to demolish (a) the pre-1948 garage and carport and its apartment and (b)the two bedroom structure. i3 a I They have already secured an Order of Conditions from the Barnstable Conservation; Commission and plan to have a licensed builder apply for a permit to construct a two- story, three bedroom residence, with a 2.5 baths, measuring approximately 2,900.square feet+/-to replace the two structures, described above. To date, no demolition of any structures on the property, has occurred, and the necessary applications for permits have not as yet been submitted. At this time, there a four structures existing onAhis property. Once the two structures that; are proposed for demolition have been removed and are replaced with the replacement three-bedroom .home, the property will return to its former :state of hosting three structures (i.e., the new three bedroom residence, the existing seasonal cottage and the 2010 garage) I trust that this explanation is sufficient to.document your file. Should you need further information, please do not hesitate to contact me. Thank you. Ve ly yours, $, v n J izzut SJP/dd cc: Roger L. The purpose of this letter is to follow-up on our conversation,. provide you with more detailed information as to.the existing, conditions at the site, the work being proposed and to request relief from the current ruling that the 100 amp electric service for the new garage originate from the service supporting the existing two7bedroom home. Existing Structures on the Property I purchased 164 Point of Pines Avenue(last home on a dead-end street; on Lake Wequaket)two-plus years ago. At time of purchase, three structures were on the property. We have just added a fourth, as follows: I. A two-bedroom,fully winterized, heated and air conditioned home. Pre-dates 1946. 2. A three-bedroom, seasonal home constructed in 1957; expanded in 1962. This structure is NOT winterized and is drained and not used out of the warm weather months. 3. A"garage"purchased with the seller's warning, later confirmed through our title research and review of your Department's files, that this structure contains an "illegal apartment" with a bathroom and shower. 4. 2010: We are completing(06/10)construction of a 24' X 24' garage. Existing Utilities on the Property - 1. There are currently two(2)electric meters on the property. ` a. 'One meter serves the two-bedroom home and garage apartment b. The second meter serves the 1957 seasonal house 2. There are two(2)gas services_on the property a. One meter serves the gas-heated two-bedroom,year-round home y b. The second meter serves the 1957 seasonal house 3. One water service (C.O.M.M.) supports the two-bedroom home, the, garage apartment and the seasonal house.. Septic Services on the Property 1. When purchased the property had two, older, certified and inspected septic systems. a. One system continues to support the seasonal house b. The second system supported the two-bedroom home and the garage apartment i y - Page 2. Mr. Jeffrey Lauzon,Building Inspector - 16 June 2010 y 2. In 2009 we sought, and received, an Order' of Conditions from the Conservation Commission(more on that below)which included'permission,to replace the septic system_ , that served the two-bedroom house and garage apartment. 3. 2010. In April/May, 2010, operating under,Board of Health permits, we removed the septic system supporting the two-bedroom home and garage apartment.and installed a Title V system sized for three-bedrooms. This system is in, operating and receives its electric service from the.two-bedroom home. 2010—2011 Construction/Demolition Project Planning. . The 2010 construction of the new garage and Title V system is part of a-phased approach to the revitalization of this property for my family's personal, seasonal use. I have shared with you preliminary floor plans, elevations and site plan showing what we are considering as a re-construction/replacement program. The main components are: 1. Retention of,no than eg s fo,seasonal home.- '2. Demolition(Sept.2010)of existing garage and apartment 3." Partial demolition and substantial, addition to existing two-bedroom home resulting in a new three bedroom home. 4. Install Title V system to support three bedrooms(complete 05110) 5. Construct new garage closer to road/entrance to property(near completion,06/10).` 6. Place all Electric service UNDERGROUND and remove one of two existing poles. 7. Place 200 amp electric meter (and disconnect switch) for.re=built home at pole (to remain)on the edge of the property: Existing 1,00 amp service is on two-bedroom house: We have been using Down Cape Engineering (Yarmouth) for all site work planning and documentation: This material can be shared with your office at any time. The Conservation Commission has a complete file on this proposed project,.including the Title V and garage additions: The Conservation Commission issued an Order.of Conditions for,the site and the work described above.. Electric Service-Request for Review and Consideration When I called NSTAR I requested a residential service for the garage and was asked if this structure was intended to house people or have any residential use. I advised NSTAR this was not the case. NSTAR said, given the use, they could allow a higher priced commercial service. A 100 amp commercial account was issued. While the excavator was installing the required dry wells at the garage, they trenched from the one electric pole to remain,to the garage. Conduit(no wiring)was, installed in the trench.' _ It is my understanding that when our electrician, Mr..Robert Chaves (Chaves'Electric, Centerville),sought to pull a permit to install this 100 Amp service he.was±informed the garage can only be served by a residential service originating at the two-bedroom house. You have explained to me the basis•for this-"rule" (ordinance?), stems from the Town's interest in preventing the very type of illegal apartment we are-in the process of removing from this property. The existing illegal apartment demonstrates that permit approach does not preclude the establishment of such Page 3. Mr. Jeffrey Lauzon, Building Inspector. 16 June 2010 apartments. In any case, this is not our intent. I believe the sizing of the new Title V system confirms our intentions,as does our detailed representations to the Conservation Commission and the Board of Health. Every aspect of the work at this address has been, and will continue to be;done in conformance with Town permitting processes. However, my specific request is for relief from the application of this"rule"(ordinance?)as to how electric service is to be provided to the new garage at 164 Point of Pines Avenue,Centerville. What has been proposed will add needless expense to the cost of the project, require additional trenching and disruption within the 100 foot wetland buffer zone, require the new home's electric service to be increased from its proposed 200 amp service to 400 amps so as to be able to have 100 amps peeled off and. sent back to the garage. We already are prepared to trench from the remaining pole to the new construction for a 200 amp service: We have already trenched to the new garage itself. What is being proposed is a separate, return trench from the home to the rear of the new garage, a distance in excess of 100 feet. The estimated.additional cost for this approach is as follows: Upgrade 200 amp service to 400 amps $3,400 Additional electrical from house back to garage $1,600a Additional trench house back to garage 'S00 Additional expense estimate: $5,500 The approach defeats Nstar's desire for a commercial account that accurately reflects its use. Thank you for your consideration of this request. I am available to meet with you,;or any other.Town official you-,suggest,.at a'time and location of your selection. If it would be helpful, I can conduct a tour of the entire property to confirm the existing conditions, and the relief we are seeking. Finally, if you require any written confirmation with regard to the removal of the existing garage and its apartment, I can do so in whatever form you deem appropriate. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a petson(s)for hire to do such work, that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for',Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems, particularly when the homeowner hires unlicensed persons. In this case, our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities, many communities require,as part of the permit application, that the homeowner certify that he/she understands the tesponsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. -Q:\WPFILES\FORMS\homeexempt.DOC O GENERAL STRUCTURAL NOTES: GENERAL STRUCTURAL NOTES:(Oo-) SHEARWALL SCHEDULE: SHEARWALL HOLDDOWN SCHEDULE: 1.ALL CONSTRUCTION IS TO BE IN ACCORDANCE WITH THE WALL FRAMING UPLIFT CONNECTIONS: WALL TYPE SCHEDULE: (, MASSACHUSETTS STATE BUILD NO CODS FOR ONE AND TWD-FAMILY \ DWBLLMS•SEVENTH EDITION 1780 CM111 AND ALL AMENOMENI9, T.ATTACH SXRR10R WALL STUDS TO THE DMJ818 TOP KA71 AT THE PLYWOOD BLOCKED)WHICH 19 BASED ON THE 2003 INTERNATIONAL RESIDENTIAL CODE RWVW(R(1)TSPCONNBCMAT73.O.0 PROVDIB(9)•tOdaIJ NAM I bppAgQpN pgpAl,yAy®gp)(HAMS®yp,C®ppy AND FOUNDATION HOLDDOWNS: W LTHEWMDOESI CRM-RIAFORT111SBUUDDJOISMACMRDAMM COCONNECTORTOEEM"WAND(dAPIPLMDDMECILY707XPRAMM NO70:N0T N NABS TO TUBDOUBUTOFFLATIiTO.C.Fnim V WITH AMERICAN FOREST AND PAPER ASSOCIATION(AFAPA)ANU THE ROCWHEN USINO H2A CONNECTOR PBR NOTS7'ROOPPRAMMO W TUNUMUM DESIGN LOADS FOR BUILDINGS AND OTHER STRUCTURES CONNECTIOIIY. Please be advised that the property is located in a Residence D1 Zoning District and the required setback from any street is thirty (30) feet and the distance required from a side or rear line is ten ( 10) feet. Any further request for information would require an advisory opinion that must be obtained from an attorney. Very truly yours, Alfred i. Martin Building Inspector AEM/gr Ronald James Cadillac, PLS, RS Registered Professional Land.Surveyor Registered Sanitarian P.O. Box 258 West Yarmouth,MA 02673 (508)775-6517 March 26, 1994 Mr. Joseph D. DaLuz,Building Commissioner Barnstable Town Hall 367 Main St. Hyannis,MA 02601 Dear Mr. DaLuz: In 1992 I prepared a dock licensing plan for the estate of Ellen Wald. I recently received inquiry as to whether the two houses on this parcel--Map 230 lot 69 could be sold separately. Enclosed is a 1957 plan subdividing this lot into 3 parcels with a 40 foot way shown. My guess is that the second house was constructed after this plan was signed by the Town. In regard to Zoning Regulations could these houses be sold separately? What would be the required building setbacks from lot lines--from the 40 foot way? I have sketched the lot lines onto my work plan that shows the two houses. Your advice on this matter is requested in writing as it will be passed on to the Wald family representative who is out of State. You may retain the other materials, but please return the copy of Plan book 135 page 113 enclosed. Thank you. Sincerely, 9_: j Ronald J.
