The site is improved with a one-story single-family residence of approximately 1,792 sq. ft., and is serviced by public water and a private septic system. The property is located in an RD-1 Residential Zoning District which requires a minimum 30'front yard, 10' side yard and 10' rear yard setback. The petitioners are proposing to construct an addition to the east side of their house in order to expand the existing one car garage into a two car garage. The proposed addition will encroach into the required 10 foot side yard by approximately 3 feet at its closest point. The petitioners are also proposing to construct an addition to the rear of the existing house. This addition appears to meet setback requirements. The existing residence is currently nonconforming with regard to the minimum 50 foot setback required from Long Pond on which the property fronts. It appears from the submitted site plan that the majority of the concrete patio area on the rear portion of the lot is located within the 50 foot setback area. Section 2= 3.7(2) Setbacks from Wetlands/Great Ponds states: "All construction shall be set back a minimum of fifty(50)feet from mean high water on any great pond..." The applicants are applying for a Special Permit pursuant to Section 4-4.3(2) Nonconforming Buildings or Structures Used as Single and Two-Family Residences, to permit the proposed expansion of the existing residence that will encroach 3' into the minimum 10'side yard required on the property. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 10, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 11, 1999, at which time the Board granted the requested Special Permit subject to conditions. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-92-Luzietti Special Permit,Section 4-4.3(2)Expansion of a pre-existing nonconforming building Hearing Summary: Board Members hearing this appeal were Gene Burman, Ron Jansson, Richard Boy, Tom DeRiemer, and Chairman Emmett Glynn. Attorney Philip M. Boudreau represented the applicants, Timothy and Constance Claire Luzietti. Timothy Luzietti was present. Attorney Boudreau had previously submitted a memorandum to the file and all Board Members have received it. For the record, Gene Burman reported that he and Attorney Boudreau belong to the same professional club. Mr. Burman felt he could act impartially on this matter but would step down if anyone felt there might be a conflict or an appearance of a conflict. Both the Board Members and Attorney Boudreau agreed that this disclosure would not constitute a conflict. Attorney Boudreau submitted a floor plan of the first floor which shows the areas of the proposed addition and the footprint of the existing house. It also delineates the setback line. The Board asked Attorney Boudreau to explain why he is applying for a Special Permit rather than a• Variance. Mr. Boudreau explained this is a legal pre-existing nonconforming single family structure.- The deck was built in 1972. The bylaw changed in the 1980s and the deck/structure did not meet those setbacks. Therefore, the structure is pre-existing nonconforming with regard to setbacks. They are. seeking relief pursuant to Section 4-4.3(2)of the Zoning Ordinance. Attorney Boudreau reported the applicants are in the process of remodeling the entire structure, but the garage addition will encroach into the setback. That is the only relief needed because the rest of the proposal meets the requirements of the Zoning Ordinance. Attorney Boudreau reviewed the proposal. The applicants are up-dating the house. They wish to add a one-car garage to the current garage to make it a two-car garage. The house currently has three bedrooms on the main floor and one bedroom in the basement for a total of four bedrooms. After the renovations there will be three bedrooms and an open loft area. This will conform to the Board of Health Requirements so long as no bedrooms are added. They do not have drawn elevation plans yet, but Attorney Boudreau indicated there will be some type of dormer in the rear. The area above the garage will be unfinished storage space. Board Member Ron Jansson stated he had some concerns with the total coverage on this small lot. There were no calculations of the exact impervious coverage on the lot. He also asked the applicant to address the septic system on site. Attorney Boudreau reported the septic system was upgraded in 1983. At that time, the requirement was for a septic tank and a leaching pit. If the applicant were to upgrade the system now, the only difference would be the requirement that there be a leaching field-not a pit. The Board of Health has indicated that as long as no bedrooms are added, they applicant does not have to upgrade their system as long as it is a functioning system. They are reducing the number of bedrooms. The bathroom count will.remain the same. For the record, Attorney Boudreau reported the site is on the south side of the Long Pond and the water flows from the pond to the house-away from the pond. Plus, the septic system is on the back side of the site-far from the water's edge. Public Comment:- No one spoke in favor or in opposition to this appeal. There are letters of support from the direct abutters on either side, Priscilla Cotter and Donald Egant&Gillian Hollands. Findings of Fact: At the hearing of August 11, 1999:the Board unanimously found the following findings of fact as related to Appeal No. 1999-92: W 1. The Petitioners are Timothy R. and Constance Claire Luzietti. The property is located at 119 Pond View Drive, Centerville, MA as shown on Assessor's Map 229, Parcel 027 and is located in an RD-1 Residential Zoning District. The site contains 13,392 square feet. . 2 r Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-92-Luzietti Special Permit,Section 44.3(2)Expansion of a pre-existing nonconforming building 2. The site is improved with a one-story, four bedroom single-family residence; a one-car attached garage; and a deck all totaling approximately 2,500 square feet. 3. The applicants are seeking a Special Permit pursuant to Section 4-4.3(2)of the Zoning Ordinance for the alteration or expansion of the pre-existing nonconforming building. The relief may be granted providing the Board finds that the proposed expansion and/or alterations are not substantially more detrimental to the neighborhood. 4. The applicants are proposing.to construct an addition to the house in order to expand the existing one car garage into a two car garage. The proposed addition will encroach into the required 10 foot side yard by approximately 3 feet at its closest point. After evaluation of the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance. 5. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. LOCUS: The property in question is situate at 119 Pond View Drive, Centerville, Massachusetts; and is shown on Barnstable Assessors Map No. 229 as Parcel No. 27. FACTS: The property is presently improved with a single-family dwelling and attached one car garage with a total floor area(including garage) of approximately 2,509 square feet. The Petitioners are in the process of remodeling the entire structure and their proposed work contemplates an addition of approximately 529 square feet in area to the structure by enclosing a portion of the existing rear deck and by expanding a portion of the home on the east side thereof and expanding the garage to a two car garage. Locus lies in a Residence D-1, which requires side yard set backs of ten feet. However, the proposed work would involve expansion of the structure such that it would encroach upon the side yard setback by approximately three feet at a point. CRITERIA: Pursuant to the Town of Barnstable Zoning Ordinance, a pre-existing nonconforming single-family residence may be expanded into a ten foot side yard setback by Special Permit . provided that the proposed expansion will not be substantially more detrimental to the neighborhood than the existing structure, Town of Barnstable Zoning Ordinance, Section 4 L3 LQ. PROPOSED FINDINGS AND DECISION: The Petitioners' proposed updating, remodeling and expansion of their home will enhance its general appearance and value; and, given the relatively minimal intrusion into the required side yard setback, it will not be substantially more detrimental to the surrounding neighborhood than the existing residence. A Special Permit may therefore be granted to allow the Petitioners' proposed expansion in accordance with the Petitioners' plans filed in this matter.
