In fact, the garage has failed inspection. The final inspection for the garage has revealed that the windows that were installed are deficient. The windows lack impact glazing. The Plan dated November 4,2008, indicates that the windows would have impact glass. The homeowners contracted for a structure'that fully complies with the building code, since windows with impact glass have not been installed;.the contract has not been satisfied. Additionally, the building inspector inspected the property on February 20, 2009, and has indicated that the hold downs are missing. Those hold downs are also shown on the Plan and contain a reference of SSTB27. Those hold downs are not in place even though they were shown clearly on the Plan. See attached Inspection Correction Notice. A copy of the Plan is also attached. Additionally, the rough grading is incomplete and the lamp post needs to be installed as per.the agreement between your office and the homeowners. _ The rough grading, including the replacement of the pre-existing boulder wall needs to be completed. Your subcontractor, Mike Leary, has already been paid$3,500..00 and has only Page-2— completed $2,900.00 of work. See attached proposal from Mr. Leary which clearly indicates that a payment of$2,900.00,is all that is due for.the work that he has completed. Although we paid Mr. Leary directly as per your instruction, HomeKore is ultimately responsible for all subcontractors necessary for the construction of the garage. The homeowners did not know Mr. Leary and HomeKore sent him directly to the property at 42 Powers Drive. The homeowners demand the return of the'$600.00 overpayment.immediately. This.letter shall constitute a Chapter 93A demand letter for the return of the $600.00. I direct your attention to the provisions of Chapter 93A for the timing and manner of your response. You should sign this document, because the proposed dock does not violate any provision of the Town of Barnstable's zoning by-law. First, let me introduce myself. I own the property at 42 Powers Drive Centerville, Massachusetts. Some of my neighbors and I propose to construct a dock at the end of Powers Drive. The neighbors who are C proposing this project include Damian and Kathy Dupuy, 35 Powers Drive; Peter and Paula Sullivan, 34 Powers Drive; and William Nelson, c 871 Bumps River Road; Florence Vicario, 15 Powers Drive; and Helena Power, 60 Powers Drive. The purpose of the dock will be to provide acc ss to the Skunknet River, sometimes referred to as the Bumps River. I acquired my land from Helena Power and included in my purchase was an easement of way from Bumps River Road to the Bumps River. I am enclosing a copy of my deed and the plan referenced therein. As you can see, the deed and the plan indicate that my wife and I have an easement that provides access from Bumps River Road to the Bumps River. Similary, the Dupuys and the Sullivans and the rest of my neighbors have an easement to use the area known as Powers Drive to gain access to their property and to the Bumps River. The easement that all of us own provides the broadest possible rights.to use Powers Drive. We have the right to use the easement for all reasonable uses that are necessary for the full enjoyment of the easement. See for example Hodgkins v. Bianchini, 323 Mass. 169; 80 NE 2nd 464 (1948). Tom Perry - 2 - March 2, 2006 The right to use Powers Drive includes every right necessary for the proper use and enjoyment of the easement. See Mt. Holyoke Real Corp. v. Holyoke Realty Corp., 298 Mass. 513; 11 NE 2nd 429 (1937). The proper use of the easement includes access to both Bumps River Road and access to the Bumps River. The plan recorded at the Registry of Deeds shows Powers Drive extending to the River. The purpose of this section of Powers Drive and our easement is to provide me, and my neighbors, with reasonable access to the Bumps River. Currently, we do not have reasonable access to the Bumps River. We need to construct a dock that will enable us to gain access to the Bumps River with our canoes, kayaks ' and other water craft. Our right to use the easement .for access to the Bumps River also includes our right to maintain and improve the easement. See again Hodgkins v. Bianchini. See also Guillet v. Livernois, 297 Mass. 337; 8 NE 2nd 921 (1937), wherein the court noted that an easement holder has "the right to make (the) Street passable and useable for its entire width . . . This follows from the.general principle that when an easement or other property right is created, every right necessary for its enjoyment is included by implication." In that case, the court concluded that an easement holder had the right to improve the grade of the easement, remove a retaining wall and, essentially, use the easement for its intended purpose, namely access to his land. In our situation, we propose to construct a dock that will enable us to use Powers Drive for its intended purpose and to its full enjoyment; namely, access to the Bumps River. The construction of our dock will not interfere with any property interests of abutters or with anyone having the right to use Powers Drive. The proposed dock is nothing more than an improvement that is "reasonably necessary to the proper use and full enjoyment of the easement". See again Mt. Holyoke Realty Corp. v. Holyoke Realty Corp. I realize that you have previously reviewed this request and denied it. In light of the foregoing analysis, I request that you reconsider your decision. I understand from documents on file with the Zoning Board of Appeals, that you determined that the certificate should not be signed because "the waterway license is for a structure that is not on the same lot (as the principal use it serves)". This reason invokes the section of the zoning by-law that addresses accessory uses, namely Section 240- 44. I respectfully disagree with this reasoning. Tom Perry -3- March 2, 2006 The proposed dock is not an accessory use. It is nothing more than a use of Powers Drive consistent with the rights of the owners of the easement across Powers Drive. Accessory uses are incidental, customary, and subordinate to primary uses. The court has defined incidental as meaning "the use must not be the primary use of the property but rather one which is subordinate and minor in significance". Harvard v. Maxant. Our use of Powers Drive to gain access to our houses is not incidental. It is critical. It is not subordinate. It is paramount. The use of our land for a residential purpose depends on our access across Powers Drive. Indeed, a dependent use is not a subordinate use. The proposed dock is nothing more than an improvement to Powers Drive consistent with its purpose and, therefore, not an accessory use. Additionally, I would also like to point out that the Town of Barnstable's Conservation Commission Regulations provide a definition of a private pier and dock. "Private Pier is a water dependent structure accessory to a residential use but shall also include Yacht Club, Association and Community Piers and any other non-commercial, non-governmental pier". This definition contemplates that private piers are sometimes properly considered accessory uses to a primary residential use, but there are also times when private piers are properly considered something else indeed. In our situation, the pier and/or dock that we are proposing is more like a community pier than anything else. The application of this definition supports the conclusion that our proposed dock is not an accessory use. In conclusion, I would appreciate it if you would consider this request with an open mind.
