Dear Thomas Perry:
I have in my possession a notification from the Town Clerks office dated May 8, 2006, of
a public hearing June 7, 2006. The notice is for all persons affected by the Zoning Board
of appeals from Section 11 of Chapter 40A, General Laws. I did skip the second in a list
of three applications by DuPuy for a"dock to be located within a private way"on Powers
Dr. in Centerville, held in September 2005. I did attend the first and third hearings in
regard to the same request. I have responded to the Conservation Commission's request
for comment and offered my objection to Chairperson Nightingale's hearing on several
issues of the application that seemed clearly to fall outside the guidelines of
appropriateness, as I understand them.
This letter is being written in advance of the upcoming meeting June 7, 2006 for
clarification. Have I missed some critical step in the process of approval, or missed a
revision? Or, has someone stretched their reality ? In particular, I would like to ask just
how it is that on Saturday May 27, 2006, of the Memorial Day weekend, I awakened to
find a series of 4"x 4"posts dug into the bank approaching the Skunknett River at the
very same location as scribed by the previous series of applications, denied during prior
hearings. An 8 foot section of decking had been installed in advance of the 4"x 4"posts,
and out above the bank supported by other large blocking and posts. After making note
of this I went to get a camera and do some errands. Upon my return around noon the
same day I discovered that a series of new construction steps had been installed on top of
the 4"x 4"posts that led down to the water's edge. It is my guess that approximately 40%
of the proposed dock/pier has presently been fabricated and installed. As of this writing,
there has been no invasion into the actual waterway section of the plan.
I am planning to attend the June 7, 2006 hearing. Photographs will be developed by then
and I will bring them. It is unclear just what steps I should take. Legal counsel has been
retained by me already and the objections and issues have been submitted by certified
letter to Chairperson Nightingale and submitted to the Conservation Commission
previously. I will anxiously await your response.

Dear Mr. Doriss:
Recently at the end of Powers Drive a stairway was installed which did not have the benefit of
proper permitting. The permitting for this was a subject that was recently before the June 7,2006,
meeting of the Zoning Board of Appeals, at which time the Board upheld my decision not to issue
the necessary permits. Since my actions have been upheld the stairway must be removed. This
office has no idea who installed the stairs. Therefore we are notifying all abutters listed with the
Zoning Board of Appeals. This corrective action must be accomplished by July 3,2006. If this
structure is not removed by then,this office will take the necessary steps to have it removed and
seek monetary compensation from the individual owners listed with the Zoning Board of Appeals.
This office looks forward to your anticipated cooperation.

Following an.in-depth review of the above-referenced file, and in accordance with
Massachusetts General Laws, Chapter 131, Section 40,the Department of Environmental
Protection has issued the enclosed Superseding Order of Conditions. This Order affirms the
local Order of Conditions approving the construction and maintenance of a 3'x28' shared pier
with associated 4 foot wide natural path, Yx20' section of timber stairs and proposed boat rack.
Relative to the issue of specific-easement nghts,please be advised that.General Condition
#2 states: "The Order does not grant ariyproperty rights or'any exclusi ev pnvilel g ies t does,lot
authorize any injury to private property-or invasion of private rights. In addition, navigation
and access issues are not within the jurisdiction of the Wetlands-Protection Act, and can be
addressed during the Chapter 91 Waterways Licensing proceedings.
In the Department's opinion, the project as conditioned herein adequately protections the 4
interests of the Wetlands Protection Act. Please be advised that the Department reserves the
right, should there be further proceedings in the matter to raise additional issues and present
further evidence as may be appropriate.
