McShane purchased the property from John C. Dimitrakis who acquired title to,the subject lot by deed from Alan E. Small, Inc. dated March 29, 1984 and recorded at Book. 4040, Page 339. Other than Alan E. Small, Inc., none of these parties ever acquired any interest in an abutting parcel contemporaneously with having an ownership interest in Lot 309. '. The O'Keefes purchased the property from James W. and Margaret f. Hardey Jr. who acquired title by a deed from Alan E. Under our Zoning Ordinance Section 4-4-2 (1), any increase in the size requirement of the Zoning Ordinance shall not apply to a lot for a single family residential use which at the time of recording or endorsement: A) was not held in common ownership with any adjoining land and B)had a minimum of 5,000 sq. ft. or"area and 50 feet of frontage or the minimum frontage requirement for the zoning district in which it is located; and C) conformed to the existing zoning if any when legally created, and D)was separately owned at the time of every zoning change which made it nonconforming. At the time of the zoning change from RC , 15,000 sq. ft. to 43,560 sq. ft. minimum size, the lots were held in separate ownership and not under common control nor has the owner of the subject lot since at least 1984,owned any of the pertinent abutting lots.
