APP-BCAB 19-0036 A Christian Camp Meeting Association, ) Appellant ) V. ) r Town of Barnstable, Appellee DECISION Introduction This appeal is before the-Massachusetts Building Code Appeals Board ("BCAB") as a result of an application filed on January 22, 2019 with respect to an existing.building located at., 39 Prospect Avenue, Barnstable (Centerville), MA. G. L..c. 143, § 100, 780 CMR 113.1 ("Appeal"). . On or about January 16, 2019, Town of Barnstable Building Commissioner Brian Florence issued a letter denying Appellant's building permit application to change part of an existing building from office use to apartment use-. The letter stated, "For the change of use from an office to a manager's apartment-the provisions of 420.1 and 420.2 require a minimum of 1 hour fire partition designed in accordance with section 708 (please see 708.1—708.4). (Exhibit.1A).1 Notices of hearing were issued''and the hearing was held on March'19, 2019. All interested parties were provided with an opportunity to testify and present evidence and - argument to the Board. The following individuals appeared:.(for Appellant: James Lane);'(for Appellee: Brian Florence); (for the Board: Richard P. Crowley;.H. Jacob Nunnemacher; Harold Learning). Patricia Barry, the Board's clerk was also present. 1"Whoever is aggrieved by an interpretation, order, requirement, direction or failure•to act by any state'or local, agency or any person or state or local agency charged with the administration or enforcement of the state building code or any of its rules and regulations, except any specialized codes as described in section ninety-six, may within forty-five days after the service of notice thereof appeal from such interpretation, order, requirement, direction,or failure to act to the appeals board.Appeals hereunder shall be on forms provided by the appeals board and shall be accompanied by such, fee as said appeals board may determine. G. L. c. 143, §100. f Exhibits The following documents were entered in evidence: 1. BCAB19-0036 Appeal Application (4 pages); 1-A. August 31, 2018 letter to Brian Florence from Shawn Maclnnes, P.E. (Massachusetts Registered Professional Engineer, Civil, No. 41328) and 110/10/2018, 9:40 aim. email from Brian Florence (4 pages); 1-D. Photograph of part of exterior of existing building; highlighted to show location of apartment and four photographs of parts of interior;., . 1-E. Letter to Brian Florence from James A. Lane, re: History of Sunset Lodge, 39A1 Prospect Ave., and attached building 39A2 Prospect Ave., Craigville Village.. Discussion arid Findings The BCAB incorporated the facts described in the Exliibits.2 The issue arose because of the existing separation wall between the proposed apartment and the rest of the building. The'. separation wall is approximately 38 feet in length. Approximately 30 feet of which is accessible to apply an additional layer of fire-rated wall board. But approximately 8 feet cannot be worked on without either demolition of an existing set of stairs or bathrooms. (See e.g.'Exhibit*. 1-D photographs). However, additional fire-rated wall board can be installed in the area beneath the stairway. Note also that the,Building Commissioner does not oppose allowing the requested relief and has found that, in all other respects, the building is being maintained in accordance with 780 CMR. Z References are to 780 CMR,which includes the International Building.Code, 2015 edition ("IBC")and the. International Existing Building Code-2015("IEBC"). The IBC and IEBC are model building codes published by the International Code Council("ICC")TM. The BBRS has adopted, incorporated, and amended the IBC and the IEBC as part of the 9th Edition of 780 CMR,effective as of October 20,2017. 780 CMR 101.1;780 CMR 34.00,§101.1. The conclusions in the Building Commissioner's January 16,2019 letter appear to be based also on his consideration of how the Existing Building Code directs compliance. 'See IEBC Chapter 10, e.g.§1012.3(change of type of occupancy/use may trigger compliance with the.IBC). "The [BCAB] may grant a variance from any provision of[780 CMR] in any particular case, may determine the suitability of alternate materials and methods of construction, and may provide reasonable interpretations of the provisions of[780 CIViR]; provided, however, that [BCAB] decisions, shall not conflict with the general objectives set forth in" G. L. c. 143, § 95.1 In exercising its powers under this section, the [BCAB] may impose limitations both as to time and use,and a continuation of any use permitted may be conditioned upon compliance with regulations made and-.amended from time to time thereafter." G. L.'c. 143, § 100. The , BCAB found that allowing the requested relief, with'certaincondition`describeFd below, would not conflict with the general objectives of G. L. c. 143, §:95; Conclusion and Order. Accordingly, the BCAB GRANTED variances to 780 CMR 708.1—7-08.4, on condition that 5/8" Type X gypsum board,be installed in the area beneath the stairway: . -SO ORDERED, BUILDING CODE APPEALS BOARD By: 04 - H. Building was built in 1912. 2. The building is owned by the Christian Camp Meeting Association and has been owned by them since 1960. 3. This is one of 10 buildings that make up the complex know as the Craigville Retreat Center. 4. The building consists of three floors and a partial basement. 5. The building is used for transient lodging of which most stay for approximately three nights. Normally no one stays more than one week. 6. The building consists of 11 bedrooms, two meeting rooms, a kitchen and 11 bathrooms. 7. The building has a monitored fire alarm system which is inspected annually by the local fire department plus the building gets inspected for safety yearly by the Town of Barnstable building department. 8. Abutting the building is a staff apartment that was built in 1980. The unit has been used as both an office manager residence and office along with being used as just a site office. 9. In 2016 the unit received alterations and converted back to a site manager residence. 10. The Town of Barnstable building department is requiring a change of use application be submitted. 11. A Building Investigation and Evaluation per MA 780 CMR 34-104.2.2.1 confirms the following: a. Does not appear to be any structural issues within the area of the apartment. b. The means of egress and number of egresses are enough to ski meet the requirement of 780 CMR 10. t{ -. c. There does not appear to be any hazardous materials on the site. d. The lighting and ventilation appear to be in compliance with the requirements of 780 CMR. e. The apartment is sufficient to meet the requirements of accessory use designating for the building. The area of the apartment, 1,020 square feet, equates to .073% of the total building area of 13,917 square feet, which meets the requirement of up to 10% of floor area being acceptable for accessory uses. f. Also, the apartment accessory use is not in a separate use group from the rest of the building which is lodging. 12. The Town of Barnstable building commissioner has ruled that the separation wall between the apartment and lodging is required to have a minimum separation of one-hour fire rated partition designed in accordance with section 708 (see 708.1 - 708.4). 13. The separation wall between the two is approximately 38 feet in length. Approximately 30 feet can be worked on to apply an additional layer of fire rated wall board.Approximately 8 feet cannot be worked on without demolition of either an existing stairway to the second floor or bathrooms (see photo). 14. We are asking for a variance for this section of the separation wall or an interpretation that perhaps no fire rated separation wall is required. As mentioned above the smoke detectors in the apartment are tied into the entire building fire alarm panel. The concept of pre-existing or"grandfathered" structures (or parts thereof) exists in the building code for structures, alterations or changes of use that pre-date 1975 when the Commonwealth of MA adopted the State building code. The other instance when existing conditions is applicable is when alterations or changes of use comply with an older code dated after 1975 but prior to the current code. I am happy to listen to any arguments related to pre-existing conditions however, as I recall there have been a couple of changes(use changes)that postdate 1975 or relative code changes that may affect your ability to rely on pre-existing conditions. 1 haven't done an exhaustive review concerning the conditions on site but you may wish to consult the 20151nternationcal Existing Building Code chapter 10(Change of Occupancy) as there may be some benefit to utilizing that document over the 2015 IBC. If I had to guess, at a minimum some separation will be required, but again I have not done an exhaustive review as I do not have the institutional knowledge of the facility that you, Mr. Sauro and the property managers do. We are finding them one by one by notices like yours to this office. The Craigville Conference Center is very old and some of the roads were never built and there are other issues with this area. The biggest issue has been addresses. When the community septic system was installed up there years ago, I was called in by the C.O.MM. Fire Dept. to evaluate the addresses and road names. I brought with me maps like the one enclosed. I identified each building and noted any"POSTED" numbers I could identify. If I remember correctly, there was some construction going on the Lodge and I could not identify a "POSTED" number. I used the address identified in my house number book which goes back to 1930. The address for the Lodge is#45 and the other building next to it is#19. There is no record that#39 Prospect was ever assigned legally up there. If the owners want#39, they can request it in writing to: Mr. Roger Parsons, PE. Town Engineer DPW/Technical Support 382 Falmouth Rd./Rte 28 Hyannis, MA. 02601 They should indicate the Map/Parcel number identified on the enclosed map and the towns' referenced building number if this is the site. Then if they want to state they have been using#39 on the Lodge Building for many years; that will be fine. Roger will forward it to me to do a site visit and check all records to see if#39 will work for this site. If it can work according to the regulations of the Town Ordinance, I may be able to change the records to what they are using. We need the request in writing so we know who we are dealing with and what the problem actually is. Then we will respond in writing "IF"we can accommodate their request or not. If we can't, we'll explain why. Until then, there is no legal#39 Prospect Avenue, Centerville (Craigville). Please let me know if you need more help with this. If you don't want to explain this to your customer, please have them call or email me or Roger and we'll explain the problem to them. CURRENT MAILING ADDRESS: city/town state zip code The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and to allow homeowners to engage an individual for hire who does not possess a license, provided that the owner acts as supervisor. DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two- family dwelling, attached or detached structures accessory to such use and/or farm structures.'A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes, bylaws, rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the Homeowner engages a person(s)for hire to do such work, that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules &Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems, particularly when the homeowner hires unlicensed persons. In this case, our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. . To ensure that the homeowner is fully aware of his/her responsibilities, many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. United Camps,.Conferences and Retreats (UCCR) for the operation of the Craigville Retreat Center. Attached is a letter received by Mr.John Diggs, the new Food Service Manager of UCCR, from the Town Clerk declining his voting rights. Mr. Diggs and his ; wife Cynthia moved from California in late December into a 1915 CCMA owned building (the Sunset Lodge) that has housed CRC staff and guests for over 60 years. Mr. Diggs has a valid Massachusetts' driver's license indicating 39 Prospect Ave.as his address. Because the assessor's map ndicates-45 Prospect Ave."as the address in question, 39 Prospect Ave.was declared to be "not a legal residence"by the front desk at 200 Main Street. Presently the Town's Engineering Department and COMM Fire Department are planning to use 39A for the Lodge building and 39B for the detached Marshview cottage. The 39 Prospect Ave. address has been the mailing address of the CCMA, CRC, Craigville'Beach Association, Red Lily Pond Project Association and the Craigville Cottage Association for decades. Our contractor is presently working with the building department to correct an existing building permit to indicate the"change of use" from a former office to a staff apartment attached to the Lodge building. Obtaining a drivers license requires that individuals have copies of valid correspondence indicating their current Massachusetts address. The Secretary of the Commonwealth advises citizens that.you may register to vote in Massachusetts if:you are a citizen of the United States, at least 18 years old, a resident of Massachusetts and not currently incarcerated. This problem is an unwelcomed issue for me, and for our new UCCR citizens arriving in Barnstable. I believe it is a serious violation to reject a citizen's voting application and will appreciate your response. Thank you. Sincerely, ,r James A. We are finding them one by one by notices like yours to this office. The Craigville Conference Center is very old and some of the roads were never built and there are other issues with this area. The biggest issue has been addresses. When the community septic - system was installed up there years ago, I was called in by the C.O.MM. Fire Dept.to evaluate the addresses and road names. I brought with me maps like the one enclosed. I identified each building and noted any "POSTED" numbers I could identify. If I remember correctly, there was some construction going on the Lodge and I could not identify a "POSTED" number.I used the address identified in my house number book which, goes;back to1.930. The address for the Lodge is#45 and the other building next to if is#19. TT ere s no record that#39 Prospe"ct s. was ever assigned legally up there. If the owners want#39, they can request it`m wntmg to. Mr. Roger Parsons, PE. Town Engineer DPW/Technical Support 382 Falmouth Rd./Rte 28 Hyannis, MA. 02601 They should indicate the Map/Parcel number identified on the enclosed map and the towns'.referenced building number if this is the site. Then if they want to state they have been using#39 on the Lodge Building, for many years; that will be fine. Roger will forward it to me to do a site visit and check all records to see if#39 will work-for this site. If it can work according to the regulations of the Town Ordinance, I may be able to change the records to what they are using. We need the request in writing so we know who we are dealing with and what the problem actually is. Then we will respond in writing "IF"we can accommodate their request or not. If we can't; we'll explain why. Until then, there is no legal#39 Prospect Avenue, Centerville (Craigville). Please let me know if you need more help with this. If you don't want to explain this to your customer, please have them call or email me or Roger and we'll explain the problem to them. Also the BX Cable is old. Because of these problems, when the old BX cable failed, the metal jacket became energized and heated up causing the fire. In addition to what I found,NSTAR's linemen found serious arcing at the neutral on the pole which only compounded the problems. The owner had complained of the lights dimming. If they had lost the neutral at any point, it would cause this problem and/or it would send high voltage throughout all the 110 circuits in the building.
