Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) Thu lack of awareness often results in. serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the II unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. I To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. The site is improved with a one-story, single-family dwelling of approximately 1,400 sq. ft. and is located in a RB Residential Zoning District. The RB District has a minimum 20 foot front yard, 10 foot side yard and 10 foot rear yard setback requirement. The applicants are proposing to add a second floor to the existing structure and construct two equal size additions to both sides of the house which will encroach into the 20'front yard setback. The locus is a corner lot at the intersection of Red Lily Pond Road and Old Craigville Road. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on February 8, 1999. A 90 day extension of time for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 7, 1999 and continued to June 16, 1999, at which time the Board denied the applicants' request. Donald W. Moncevicz, Civil Engineer, represented the applicants, Gerd and Joanne Siller,who were present. Mr. Moncevicz reported the applicants have owned this property for the past 20 years. The subject dwelling is a three bedroom home. The applicants are proposing to do some interior renovation work, add two small additions to both sides and add a second floor. Being a comer lot, a minimum 20'front yard setback is required off both Red Lily Pond Road and Old Craigville Road. The existing dwelling is presently nonconforming with respect to the minimum 20'front yard setback required off Red Lily Pond Road and the minimum 10' rear yard setback, being situated approximately 17'from the front property line and about 1.6'from the rear lot line. The addition to the west side of the house will encroach to within approximately 11.4'from the front property line off Red Lily Pond Road and the addition to the east side of the house will encroach to within approximately 19'from the front boundary off Old Craigville Road. The existing deck is within 1.64 feet of the sideline setback and does not conform to the side yard setback. According to the applicant, it is approximately 15 years old, and he is of the opinion it was built with a valid building permit. The Board questioned how the deck could legally sit that close to the sideline. The applicant did not know the answer. There was a discussion regarding the existing square footage of the house and the total square footage of what was being added. The plans submitted do not have any dimensions listed. It appears the existing footprint is 1,424 square feet. They are adding a second floor(the exact measurements were unclear) and two 160 square feet additions of 2 stories each. They will have four bedrooms which will be in conformance with the Title V Septic System. The Board asked Mr. Moncevicz to confirm the exact calculations for the dwelling. The Board Members were concerned with the size of the proposed dwelling in view of its close location to Red Lily Pond. The Town has spent a lot of time and money on Red Lily Pond and the Board was concerned that this proposal will increase the nitrate loading in the pond. This is a very small lot and this is a big addition which comes within 300 feet of the pond. Mr. Moncevicz indicated this dwelling is across the street and over 250 feet away from the pond so the stricter regulations do not apply to this house. Their system will comply with all the requirements of Title V and it will be located in the front yard. There was no site plan to review the exact location of the septic system. The Board asked the applicant to speak with the Board of Health to get their input regarding Red Lily Pond, nitrate loading, the septic system, and the additional bedroom(s). They want a letter from the Board of Health before they make a decision. The new plans do not have dimensions. The Board suggested the applicant continue this appeal and return with plans showing the dimensions with the exact calculations for the gross square footage, the location of the septic system, and a letter from the Board of Health regarding this site and Red Lily Pond. The applicant requested a continuance to allow him time to provide the Board with the requested information. The Board voted to continue Appeal Number 1999-47 to June 16, 1999 at 7:30 PM. Board members hearing this appeal on June 16, 1999 were Ron Jansson, Gail Nightingale, Richard Boy, Gene Burman, and Chairman Emmett Glynn. Don Moncevicz, Civil Engineer, represented Gerd & Joanne Siller, who were present. Mr. Moncevicz addressed the Board. He stated that this is a continuation from a previous hearing. Questions were raised concerning Board of Health approval and the proposed size of the house. The 2 Town of Bamstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-47-Siller Special Permit,Section 4-4.3(2)Expansion of a Nonconforming Single-Family Residence Board of Health has issued a Disposal System Construction Permit, a copy of which was submitted. New plans, showing the proposed dimensions and layout were also previously submitted to the file. The Board was concerned with the proposed size of the bedrooms and questioned if the owners were creating their own hardship. Mr. Siller stated that he is adding on 30 feet to the second floor to match the downstairs and make the house look better by having a uniform design. There was a concern that the lot would be overbuilt for the area and would be overcrowded. The lot is small and the square footage is going from about 1,400 square feet to over 3,000 square feet in a sensitive area-near Red Lily Pond. Mr. Siller stated he is improving the area by upgrading the property and helping to prevent the area from becoming a rental area. The Board asked about the footprint and the square footage of the existing porch and decks. Mr. Moncevicz stated that the footprint is 1, 424 square feet-not including the decks, and that the area of the decks and porch are: existing deck-450 Square feet(+/-)in front existing deck-70 square feet(+/-)in rear existing porch- 180 square feet(+) porch &deck=700 square feet The Board questioned the septic permit which states 4 bedrooms are permitted. The Building Commissioner responded that Board of Health sign-off is required for a building permit. Four bedrooms are permitted because the lot is located in the AP Aquifer Protection Overlay District and not a GP or WP District which does restrict the number of bedrooms. Mr. Moncevicz addressed the Board. He stated-relative to the size issue-that this location is near the beginning of Red Lily Pond Road and is one of the nicest homes in this area. It is well maintained and well landscaped. The grounds are immaculate. The property has been in the family 20 years but the family situation has now changed. They now have grandchildren and there are privacy issues. There are currently other efforts in this neighborhood to improve and upgrade the area. The Siller-are going to improve the area and this will not be detrimental to the neighborhood. The footprint is 20% of the lot and not out of scale for the area. The Board asked about on-site parking. Mr. Siller stated that there is a 2 car driveway (stone) located behind the house that holds 6 cars. Public Comment: No one spoke in favor or opposition to this appeal. Findings of Fact: At the hearing of June 16, 1999, the Board unanimously found the following findings of fact as,related to Appeal No. 1999-47: 1. The petitioners are Gerd and Joanne Siller. The property address is 10 Red Lily Pond Road, Centerville, as shown on Assessor's Map 227, Parcel 058. 2. The locus is relatively small being approximately 8,700 square feet and is surrounded by single-family dwellings on all sides. 3. The locus is improved with a one-story single-family dwelling of approximately 1,400 square feet. It is located in a RB Residential Zoning District which requires a minimum 20 foot front yard, 10 foot side yard and 10 foot rear yard setback. 4. The applicants are proposing to add a second story to the existing structure and construct two equal size additions to both sides of the house that would encroach into the required 20 foot front yard setback. 5. The locus is a corner lot at the intersection of Red Lily Pond Road and Old Craigville Road. After evaluation of all the evidence presented,and a view of the property, the proposal does not fulfill the spirit or intent of the Zoning Ordinance and would represent a substantial detriment to the public good and the neighborhood affected. 9. The proposed construction on this undersized lot would be an over-intensification of the lot. Decision: Based on the findings of fact, a motion was duly made and seconded to deny the requested relief. Donald W.Moncevicz,Civil Engineer,represented the applicants,Gerd and Joanne Siller,who were present. Mr.Moncevicz reported the applicants have owned this property for the past 20 years. The subject dwelling is a three bedroom home. The applicants are proposing to do some interior renovation work,add two small additions to both sides and add a second floor. Being a comer lot,a minimum 20' front yard setback is required off both Red Lily Pond Road and Old Craigville Road. The existing dwelling is presently nonconforming with respect to the minimum 20' front yard setback required off Red Lily Pond Road and the minimum 10'rear yard setback,being situated approximately 17' from the front property line and about 1.6' from the rear lot line. The addition to the west side of the house will encroach to within approximately 11.4' from the front property line off Red Lily Pond Road and the addition to the east side of the house will encroach to within approximately 19' from the front boundary off Old Craigville Road. The applicants are applying for a Special Permit pursuant to Section 4-4.3(2)of the Zoning Ordinance-Nonconforming Buildings or Structures Used as Single and Two Family Residences-to allow two 12'4"x 13' additions to encroach into the required 20' front yard setback. The existing deck is within 1.64 feet of the sideline setback and does not conform to the side yard setback. According to the applicant,it is approximately 15 years old,and he is of the opinion it was built with a valid building permit. The Board questioned how the deck could legally sit that close to the sideline. The applicant did not know the answer. There was a discussion regarding the existing square footage of the house and the total square footage of what was being added. The plans submitted do not have any dimensions listed. It appears the existing.footprint is 1,424 square feet. They are adding a second floor(the exact measurements were unclear)and two 160 square feet additions of 2 stories each. They will have four bedrooms which will be in conformance with the Title V Septic System. The Board asked Mr.Moncevicz to confirm the exact calculations for the dwelling. The Board Members were concerned with the size of the proposed dwelling in view of its close location to Red Lily Pond. The Town has spent a lot of time and money on Red Lily Pond and the Board was concerned that this proposal will increase the nitrate loading in the pond. This is a very small lot and this is a big addition which comes within 300 feet of the pond. Mr.Moncevicz indicated this dwelling is across the street and over 250 feet away from the pond so the stricter regulations do not apply to this house. Their system will comply with all the requirements of Title V and it will be located in the front yard. There was no site plan to review the exact location of the septic system. The Board asked the applicant to speak with the Board of Health to get their input regarding Red Lily Pond,nitrate loading,the septic system,and the additional bedroom(s). They want a letter from the Board of Health before they make a decision. The new plans do not have dimensions. The Board suggested the applicant continue this appeal and return with plans showing the dimensions with the exact calculations for the gross square footage,the location of the septic system,and a letter from the Board of Health regarding this site and Red Lily Pond. Appeal Number 1999-47-Siller ' Special Permit,Section 4-4.3(2)Expansion of a Nonconforming Single-Family Residence The,lot sizes in this residential neighborhood vary in size, but many of the lots in the.surrounding vicinity are of equivalent size to that of the applicants'property. Because the subject site is a corner lot, a substantial portion of the property, about 70%of the perimeter according to the petitioners' application, is required to meet the minimum 20'front yard setback. The proposed addition on the east side will encroach only about a foot into the required setback. The addition on the west side will encroach an additional 5.7'from the present 17'setback for a total encroachment of approximately 8.6'. From the submitted floor plans, it appears that the applicants are adding two bedrooms for a total of four. Although the property is located in the AP Aquifer Protection Overlay District and is, therefore, not limited in the number of gallons per acre per day of wastewater discharge, staff suggests the applicants provide the Board with a copy of the latest septic system inspection report to ensure that the existing septic system can handle the proposed number of bedrooms. Special Permit Requirements: For the expansion and/or alteration of a pre-existing nonconforming building used as a single-family residence, the Board must find that the proposed alteration or expansion will not be substantially more detrimental to the neighborhood than the existing building or structure. The standards for granting a Special Permit also require the following findings of fact to be made by the Board (Section 5-3.3(2)): • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, (the expansion and/or alteration of a nonconforming building used as single or two- family residences is allowed by a Special Permit Pursuant to Section 4-4.3(2) of the Zoning Ordinance), • that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Suggested Conditions: If the Board should find to grant the requested relief, they may wish to consider the following conditions: 1. The proposed additions shall be constructed in accordance with the submitted plans, copies of which are in the file. 2. The proposed addition to the west side of the existing dwelling shall be located no closer than 11'to the front property line off Red Lily Pond Road.
