The property Is located in a RB Residential Zoning District,which requires a minimum lot size of one acre,a minimum frontage of 20 ' feet and a minimum lot width of 100 feet. The subject lot is currently nonconforming with regard to lot size, being 0.46 of an acre. The petitioner wishes to subdivide the property into two lots, as shown on the attached plan of land, In order to convey a portion of the property to the immediate northern abutter. The conveyance of this land will create a more nonconforming lot with regard to the minimum required lot size. The subject lot will be reduced In area t. from about 0.46 of an acre to 0.37 of an acre.(a reduction of about 20%). The abutting lot to the north, also nonconforming with regard to lot size,will Increase.In area from about 0.23 of an acre to 0.32 of an acre(an Increase of about 39%). This lot is also developed with a single-family residential dwelling. The petitioner is applying for a Special Permit pursuant to Section 4.4.2,Nonconforming Lots,to permit the conveyance of a portion of the subject property to the abutter to the north which will Increase the nonconformity of the subject lot. Section 4-4.2(5)states: "No lot,or portion thereof,may be changed or transferred in any manner that will increase the degree of nonconformity unless a special permit has first been obtained from the Zoning Board of Appeals. No such special permit may create any additional buildable lot(s)." j Procedural Summary: This appeal was filed at the Town Cleric's Office and at the Office of the Zoning Board of Appeals on May 5, 1999. A 60 day extension of time for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duty advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened June 30, 1999 and, continued to August 18, 1999, at which time the Board granted the requested Special Permit subject to conditions. Hearing Summary: Board Members hearing this appeal were Gene Burman, Gall Nightingale,Richard Boy, Ron Jansson,- and Chairman Emmett Glynn. Attorney Patrick Butler represented the applicant,Elizabeth D. Stanley, Trustee of the Stanley Family Trust. i 8K 12SIBe P11331 S 78aos Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-78-Stanley Special Permit,Section".2 Nonconforming Lots Chairmen Emmett Glynn read into the record a letter,dated 'June 30, 1999,from Attorney Patrick Butler. He Indicated that he has reviewed the staff report where some concerns were raised about the possible need for additional relief. He,therefore, Is requesting a continuance to allow him time to prepare the Variance application(s)and/or any other relief needed. The Board voted to continue this appeal to August 18, 1999 at 9:00 PM with the understanding that an extension of time must be signed by Attorney Butler. New Board Members to be assigned. Board Members hearing this appeal on August 18, 1999 were Gail.Nightingale,Gene Burman,Tom DeRiemer, Dan Creedon,and Chairman Emmett Glynn. Attorney Patrick Butler represented the applicant, Elizabeth D.Stanley,Trustee. Present were Edward Sliby, Simone Fisher,and Donald W. Monoevicz, Civil Engineer. Attomey Butler requested,and the Board agreed,to hear Appeal Number 1999-104 and Appeal Number 1999-78 together. A memorandum in support of these appeals was previously submitted to the file by Attorney Butler. Attorney Butler explained that Lot 43 Is owned by the Stanley Family Trust and Lot 44 is owned by Edward Sliby. The applicant is seeking to subdivide their property to allow for the transfer of a 20 foot strip of land from Lot 43 to Lot 44. in doing so, Lot 43 becomes smaller,and Lot 44 increases by 3, 937 square feet. The result of this transfer would change the lot width of Lot 43 from 107 feet to 67 feet, less than the required 100 foot minimum width,which is why they are seeking a Variance. As background,Attorney Butler indicated the transfer of land Is to help accommodate the septic systems of both lots. The Slibys have abandoned their cesspool and now have a Title V Septic System further away from Red Lily Pond. The Stanleys will upgrade their system to meet Title V regulations. This is a benefit to the area of the pond,the groundwater,and the neighborhood overall. This will not be in derogation from the spirit and Intent of the Zoning Ordinance. As to Variance conditions, a review of the configuration,shape and size of the lot,as well as the topography and soil conditions relating to the placement of an upgraded Title V system would support a hardship finding in that the septic system can not be upgraded without the transfer of this strip of land. Because the overall width of the two lots combined and the overall square footage of the two lots does not change with the transfer,the relief may be granted without substantial detriment to the public good or the neighborhood affected. Donald W. Moncevicz, Civil Engineer,reviewed the plans and showed where the septic system will be located on the property-In the front and further away from the pond. He also showed where the septic system will be located on the Sliby property. That system will also be located further from the pond. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of August 18, 1999,the Board unanimously found the following findings of fact as related to Appeal No. 1999-78: .. 1. The applicant, Elizabeth D.Stanley,Trustee of the Stanley Family Trust,is seeking a Special Permit pursuant to Section 4-4.2 Nonconforming Lots. The property address Is 11 Red Lily Pond Road, Centerville, MA as shown on Assessor's Map 227, Parcel 043 located in the RB Residential B Zoning District and the AP Aquifer Protection Overlay District. 2. The subject lot is currently nonconforming with regard to lot size, being 0.46 of an acre. 3. After evaluation of ail the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact,a motion was duly made and seconded to grant the'rell®f being sought in Appeal No. 1999-78, subject to the following terms and conditions: 1. The lot shall be divided as shown on the submitted plan titled,"Plan of Land in Hyannis, Massachusetts as prepared for Elizabeth D. Stanley,Trustee-Stanley Family Tr.", dated February 23, 1999 and prepared by Donald Moncevicz, Professional Engineer. 2. The petitioner shall be required to file an ANR Plan with the Planning Board. 3. The ANR Plan,to be approved by the Planning Board,shall reference this decision of the Board and both the plan and decision shall be recorded at the same time at the Barnstable County Registry of Deeds. At the Zoning Board of Appeals hearing on June 30, 1999, the applicant requested,and the Board granted, a continuance after discovering that a Variance on the minimum required lot width would also be required In addition to the Special Permit request. There Is a minimum required lot width of 100 feet-on — the property. Currently,the subject lot conforms to this requirement, being approximately 107 feet wide on Red Lily Pond Road. The proposed subdivision of this property will reduce the lot width to 87 feet. In addition to a Special Permit pursuant to Section 4-4.2(Appeal Number 1999-78),the applicant is also seeking a Variance to Section 3-1.1(5)to allow the lot width to be reduced from 107 feet to 87 feet.
