In December of 1996,Robert Klemme of 216'Riverview Lane,Centerville,received a variance to
construct a single family home. The subject property is on .32 acre site and due to the concerns of the
Zoning Board,the variance was granted with 3 restrictions. One of the restrictions was that the house to be
built,could not exceed 3000 square feet and could not have more than 3 bedrooms and 2 baths.
The house was completed recently and through an oversight,2-1/2 baths were built instead of 2.
All other requirements were met according to the ZBA decision including being under 3000 square feet of
living space, inclusive of garage.
I feel this is de minimis and would like the Board's concurrence so that the closing may go
forward tomorrow without a variance modification.

TO WHOM IT MAY CONCERN:
Please be advised that on April 29, 1998,1 submitted the attached letter to the Zoning Board of
Appeals in person. Their reaction was as I expected. Their intent was only to limit the size of the structure
and the number of bedrooms as this is the accepted method to regulate density in Massachusetts. The fact
of the matter is that they see no need to bring the case back up for a modification as it does not really
concern them. Their suggestion was for me to handle the problem.
At this time,I as Zoning Enforcement Officer,certify that this home has three(3)bedrooms, is not
over 3000 square feet in size,and has two full baths. The fact that it also has a half bath is not in violation
of the variance language as that language only referred to full baths. If this house had three full baths, I
would agree a variance modification would be in order,however 2-1/2 baths is much different and in
compliance with their variance.

Background:
The property is a .32 acre lot shown on Assessor's Maps as Map 228, Parcel 167. The lot is owned by Margaret
Klemme and is located in the RC Zoning District, where the minimum lot size is one acre. Mrs. Klemme and her
husband, Robert, owned an adjacent lot, Assessor's Map 228, Parcel 169, which is .76 acres and contains a
dwelling, from 1993 through 1996. According to the applicant, this lot was recently sold. Both lots were created
by a subdivision for Jack and Sylvia Furman approved by the Planning Board on January 11, 1965 and were
apparently jointly owned by Jack and Sylvia Furman from 1964 through 1993. The minimum lot size in this
district was 15,000 sq. ft. until one acre was adopted in 1985.
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on November
13, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to a!I
abutters in accordance with MGL Chapter 40A. The hearing was opened December 18, 1996, at which time the
Board found to grant the appeal. Board members hearing this appeal were Ron Jansson, Gene Burman,
Richard Boy, Thomas DeRiemer, and Chairman Gail Nightingale. Attorney John W. Kenney represented the
Applicant, Margaret V. Klemme. A memorandum from the Attorney was submitted to the file.
Hearing Summary:
Attorney Kenney explained the history of the lot. The land was bought by Jack and Sylvia Furman in 1964. In
approximately 1967, the land was subdivided and a house was built on Lots 23 and 24, while Lot 22 remained
vacant and still under the ownership of Jack and Sylvia Furman.. In 1991, Jack Furman transferred the
ownership of Lot 22,. Lot 23, and Lot 24 to Sylvia Furman. In 1993, the house on Lots 23 and 24 was sold by
Sylvia Furman to Robert and Margaret Klemme. Later when Mr. and Mrs. Klemme started to undertake the
steps necessary to build their house on the vacant lot(Lot 22), they became aware of the merger of Lots 22, 23,_...
and 24.
Because there was a new house being built on Lot 25 (a lot similar to Lot 22) and later another house built in the
area, the Klemmes believed their lot was also buildable. The lot is similar in size to the other lots in the area.
Forty out of the fifty adjacent lots have homes`built upon them. However, this lot is unique in that it is the sole
remaining vacant lot without a vacant lot next:to it with which to acquire land to allow it to become closer to
conforming. Attorney Kenney submitted that because this lot is of similar size and character to the neighboring.
lots; the granting of the relief being sought would not be in derogation of the sprit and intent of the Zoning
Ordinance nor would it be detrimental to the area.

Based upon the testimony given during the public hearing on this appeal, a majority of the Board members found
the following findings of fact with reference to Appeal Number 1996-159:
1. The properly in issue is a .32 acre lot described as Lot 22 River View Lane, Centerville, MA and shown on
Assessor's Map as Map 228, Parcel 167.
2. The lot is owned by Margaret Klemme and is located in the RC Zoning District,where the minimum lot size is
one acre.
3. When the Applicants purchased this lot(Lot 22), there was construction on the adjacent lot(Lot 25). Due to
this construction, there was confusion by the Applicants as they were under the impression that their lot(Lot
22)was also a buildable lot. The Applicants also owned the house on Lots 23 and 24. When the house was
sold in 1993, the Klemmes were unaware of any merger. This was an honest mistake.
4. The lot is located within a subdivision of approximately fifty lots of which forty lots presently are built upon.
The size of the lot is approximately the same size as the other lots in the development with the exception of
the merger of Lots 23 and 24. The majority of these lots are between .31 and .35 acres. It is because all of
the adjoining lots are built upon, that there is no way the non-conformity can be remedied. There is no land
available to merge with the lot.
5. No variance conditions have been demonstrated pursuant to M.G.L. Chapter 40A, Section 10.
6. Granting the relief beirig sought to allow the construction of a dwelling on the vacant parcel would not be in
derogation of the spirit and intent of the Zoning Ordinance nor would it be detrimental to the neighborhood
affected.
7. The lot in issue has been and continues to be assessed by the Town of Barnstable as a separate buildable
lot..
Motion:
Based on the findings of fact in Appeal Number 1996-159, a motion is duly made and seconded to grant the
Petitioner the relief being sought with the following terms and conditions:
1. The on-site wastewater disposal septic system shall conform to all requirements of Title V without variance
from the Board of Health.
2. All construction must conform to the required setbacks in the RC Residential C Zoning District.
3. Due to the fact that the lot is only .32 acres, the size of the house shall be limited to no more than three (3)
bedrooms and two (2) baths and shall not exceed 3,000 sq.ft. in total living space inclusive of the garage
area.

Please be advised that I represent Margaret V. Klemme, Trustee
of Brukle Realty Trust, the owner of the above-referenced property.
This property contains 13,760 square feet.
On December 3, 1993, Sylvia M. Furman transferred title to hot
22 to Margaret v. Klemme, Trustee of Brukle Realty Trust .
Previously, on August 19, 1994, Sylvia M. Furman transferred title
to Lots 23 and 24 as shown on the plan recorded in the Barnstable
County Registry of Deeds in Plan Book 190, Page 143 to Robert D.
Klemme and Margaret V. glemme. Since, at the time of this
transfer, Sylvia M. Furman owned title to Lots 22, 23, and 24, I do
not believe that Lot 22 is a buildable lot under the current Town
of Barnstable Zoning By-law.
Lots 23 and 24 have been combined and have one house built
upon them. Lot 22 is vacant. My client is seeking a building
permit for Lot 22 but, as I have stated, it is my opinion that the
Lot is not presently a buildable lot and a variance is required.
