MU11PON" April 22, 1991 Mr. Joseph DaLuz Building Inspector Town of Barnstable Main Street Hyannis, MA 02601 Re; Lot 19, Riverview ,Road, Centerville, MA Assessor' s Map 228 Parcel 164 Dear Mr. DaLuz; My client, Aayside Building Company, Inc. , has requested that I contact you with respect to the above-referenced lot which it has under agreement. Bayside Building Company, Inc, intends to construct a single-family dwelling on Lot 19, Riverview Road. Title to the Lot was acquired by Jack and Sylvia Furman during 1965. The sub-division plan was approved on or about January 11, 1965 by the Town of Barnstable Planning Board. The plan was a subdivision &PP oval regaired plan. The lot Is approximately 13,700 square feet acres and is undersized because of a previous change in the zoning from RB-10, 000 square feet to RC-15,000 square feet and then in 1985 to one acre lots. The current zoning in the affected area is RC/One Acre. Prior to .1971 the lots had been. held in common . _ ownership. Title to this lot has beery held in non-contiguous_ ownership since 1971. Massachusetts General ,.Laws Chapter 40A Section 6', covers the lot ownerphip in question. Prior to ,the re-codification of this statute in 1977", a subdivision approval required plan wss afforded seven year protection or zoning freeze. I could not detemine the date the zoning changed from 10,000 sgaure feet 4o 15, 000 sgaure feet but that date is not significant because of the statutory zoning freeze. In 1:971, all the lots contiguous to Lot 19 were "check erboarded" by conveyance to various unrelated owners and Lot 19 came and remains- under the protection of Article III, Chapter III, Section 4-4 . 5 (1) and (2) of the Town of Barnstable Zoning By Law. This section involves non-conforming uses and provides, in.part ` that if "while building on such lot, was otherwise permitted" the lots were checkerboarded, a single family residential permit may issue. As such it is my opinion that a permit should issue for the construction of a single family residence. Please call me if you have any furthe questiions. Very truly yours,
