Area: 0.34 acre Zoning: RC Residential C Zoning District Groundwater Overlay: AP Aquifer Protection District Background: The property that is the subject of this appeal consists of a 0.34 acre lot commonly addressed as 305 Riverview Lane, Centerville. It is improved with a one-story single-family residence of approximately 1,244 sq. ft., according to assessor's records dated 10/05/99. The site is located in an RC Residential Zoning District, which requires a minimum 20' front yard, 10' side yard and 10' rear yard setback. ' According to the application, the applicant was unaware that the existing deck encroaches into the minimum required side yard until recently when a plot plan was done. It appears from the assessor's field card that the deck was constructed when the house was built in 1994. The deck is an elevated structure (14' x 22') and is situated approximately 7 feet from the south side lot line. All other required setbacks appear to be met. The applicant is seeking a Variance to Section 3-1.3(5) of the Zoning Ordinance-Bulk Regulations-in order to legitimize the existing deck that encroaches into the minimum required 10' side yard by about 31 inches. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 6, 1999. A 30 day extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened October 13, 1999, at which time the Board granted the requested Variance with conditions. Hearing Summary: Board Members hearing this appeal were Gail Nightingale, Richard.Boy, Ron Jansson, Tom DeRiemer, and Chairman Emmett Glynn. John Bowes represented himself before the Board. Mr. Bowes reported he built his house with the intention of putting his deck across the back of the house. There is an embankment in the back of the house with a walkout to the finished basement. When it was time to put on the deck, the builder suggested they build the deck around the side of the house instead of the back. Because of the embankment, if the deck were in the back,they would need to have ten feet of stairs for access and the deck would interfere with sunlight to the finished basement. By putting the deck on the side, these problems were eliminated. It was not until he tried to sell his house that the applicant learned his deck encroached by 31 inches. Before he applied for a Variance, the applicant looked into just cutting the deck by the 31 inches, but found that impossible because the support pilings would be effected and the result would be a long narrow deck. The embankment in the rear is a topographical feature unique to.his lot. Mr. Bowes reported the abutting neighbor most effected by this encroachment has no problem with the deck's location. There is a green buffer strip between the properties. Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-117-Bowes Variance to Section 3-1.3(5)Bulk Regulations-Side Yard Setback The deck does not have a separate building permit because Mr. Bowes stated he did not need one and that his new home building permit is sufficient. According to Mr. Bowes, you would only need a permit for a deck if it is added after the house is completed. Public Comment: Sally Glista, the buyer of the home, would like the deck to remain as is. No one else spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of October 13, 1999, the Board runanimously found the following findings of fact as related to Appeal No. 1999-117: 1. The applicant is John J. Bowes, Jr. The property in issue is addressed as 305 Riverview Lane, Centerville, MA as shown on Assessor's Map 228, Parcel 091.002. 2. The property is located in the RC Residential C Zoning District which requires a minimum 20'front yard, 10' side yard and 10' rear yard setback. The applicant's deck is situated approximately 7 feet from the south side lot line. Therefore, the applicant is seeking a Variance to Section 3-1.3(5) of the Zoning Ordinance- Bulk Regulations- in order to legitimize the existing deck that encroaches into the required side yard setback by about 31 inches. 3. To remove the deck would involve substantial hardship, financial or otherwise to the petitioner. 4. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in . Appeal No. 1999-117, subject to the following terms and conditions: 1. There shall be no further encroachments. 2. The deck shall not be enclosed. The Vote was as follows: AYE: Gail Nightingale, Richard Boy, Ron Jansson, Tom DeRiemer, and Chairman Emmett Glynn NAY: None Order: Variance Number 1999-117 has been Granted with Conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A, Section 17, within twenty (20) days after the date of the filing of this decision. Mr. Green and his late wife, Audrey, originally purchased Lots 52 and 53 , as tenants by the entirety, on September 24, 1981, Lots So and 51 were then purchased by the trust on November 23, 1982 . At no time did James Green or Audrey Green own sots So and 51 in their own naxres or jointly.
