DEFINITION HOMEOWNER Person(s)who owns a parcel of land on which he/ e resides or' tends to reside,on which there is,or is intended to be,a one or two- family dwelling, attached or detached structures acc ssory to su use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a meown . Such"homeowner" shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be es Do ible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for pliance with the State Building Code and other applicable codes, bylaws,rules and regulations. The undersigned"homeowner"certifies that he/she un erstands Town of Barnstable Building Department minimum inspection procedures and requirements and that he/she will corn ly with said ocedures and requirements. HOMEOWNER'S EXEMPTION The Code states that: "Any horn caner performing work for which a ilding permit is required shall be exempt from the provisions of this section(Sectio 109.1.1—Licensing of construction Su rvisors);provided that if the homeowner engages a person(s)for hire to do such w rk,that.such Homeowner shall act as su rvisor." Many homeowners who use th' exemption are unaware that they are assumi the responsibilities of a supervisor (see Appendix Q,RuIes &Regulations for Licensing Construction Supervisors,Section .15) This lack of awareness often results in serious problems, particula ly when the homeowner hires unlicensed persons_ this case,our Board cannot proceed against the unlicensed perso as it would with a licensed Supervisor_ The homeo er acting as Supervisor is ultimately responsible. To ensure that the homeo er is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeo ner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently use by several towns. You may care t amend and adopt such a formlcertification for use in your community.
