Members in attendance: Judith J. French, Chairman Peter W. Hutton, Vice-chairman Susan H. Rohrbach, Clark David B. H. Martin, Ernest J. Jaxtimer, Joseph Bartell & Bernard Wilber Staff: Larry Dunkin Bernice Latham The chairman welcomed the two newly appointed members to the Board. E.J. Jaxtimer and B. Wilber. APPROVAL NOT REQUIRED PLANS: John J. Rosario, Tr. Hyannis Down Cape Perimiter survey 1 lot off Rosary Lane to Yarmouth Town Line. Moved approval B. Wilber 2nd S. Rohrbach--It was found that this plan does not require approval under the subdivision control law. Motion carried unanimously. Robert J. Williams West Barnstable Kelley Subdivision of 5 acre parcel into 2 driveway will be relocated--a home for his mother will be built on the second lot. It was moved by J. Bartell that this plan does not require approval of the Board under the subdivision control law. 2nd B. Wilber. Motion carried unanimously. Eleanor C. Orbe Centerville Eldredge The Boarddisapproved-this-plan last .week,ek, however, since that time the petitioner's attorney has been into the office and pointed out that there is already 2 lots on an approved plan that has been recorded, this new plan makes those 2 lots basically into 1, and at the same time adds a portion of the southerlymost lot to the remaining land of Laurence Bearse. It was moved by P. Hutton that the Board found that this plan does not require approval under the subdivision control law. 2nd J. Bartell. Motion carried unanimously. Sweeney This plan is just to be updated. It was endorsed by the Board in March and never recorded. The plan was updated as requested. (Martin opposed) Barnstable Holding Co. Marstons Mills Deborah & Farmersville Road .Steve Jones, Atty. for the petitioner Wish to explain the situation and hopefully the Board will approve the plan. This is a subdivision of lot 7 into lots 8 & 9--from the beginning the access was to be from Deborah Lane to lots 6 & 7 and no access onto Farmersville Road the proposed access to lots 8 & 9 would be from Deborah Lane with a right of way easement being provided to serve the 3rd lot--Barnstable Holding Co. would have , no objection to the same restriction--of no access onto Farmersville Road. Larry: There was some confusion in the first place because of the locus on the plan, which incorrectly named Crooked Cartway - Farmersville Road--Farmersville Road actually being west of the locus. The plan was denied because of lack of safe and adequate access. As an approval not required the assumption is that the road is constructed and the physical access to the lots that have frontage on it will come from the same roadway, not via some other easement. The Planning Board is not in a position with an ANR to establish restrictions or criteria and add conditions to the approval of an ANR plan. It is either approval required or it isn't. A subdivision could add Giangregorio Robin From: Traczyk Art To: Giangregorio Robin Subject: RE: - 100% upland Requirement Date: Wednesday, September 06, 2000 5:58PM Robin: Changed from 70%to 100% upland on date of first publication -advertising -Article 8-13 of 1983 fall meeting (that was October 06, 1983-date of first publication of the Article) This article was approved by the Attorney General on Feb. 4, 1984. The effective date of change is October 06, 1983. In 1973-Article 156 added the requirement that 70% of a lot must be in contiguous upland. The signing of an ANR Plan -Approval Not Required -designates only that the plan does not create any new roads. The Planning Board signature carries no other connotation - it does not necessarily create a buildable lot. ANR plan can be used for a number or reasons-possible transfer of a peace of property ... etc. Hope this answers you concerns. That 1985 ANR plan did not create a buildable lot under zoning it the time. However, keep in mind that an attorney could make a case that the 100% upland criteria is a bulk regulation and that a lot could be grand fathered for up to 5 years from that change. However-this lot would have to have an earlier plan to fall back on and it does not meet the 70% upland requirement that was enforced from 1973.
