Proposal: Addition of 29 units of assisted living to the existing 120 bed nursing
home facility. Improvements to be made to wastewater treatment, including
nitrogen removal, wetland buffer mitigation, new landscape improvements and
parking area improvements.
Dear Attorney Cox:
Please be advised that subsequent to the Site Plan Review Committee's approval on January 3,
2007, the plan entitled "Cape Regency Rehab and Nursing Center 120 South Main
Street, Centerville, MA" (Sheet C-2), prepared by SS Designs, dated August 31, 2006 and last
revised on March 8, 2008 depicting the relocation of seven parking spaces plus the addition of
one new paved parking space has been administratively approved by the Building Commissioner,
Tom Perry subject to the following conditions:
• Upon completion of all work, a registered engineer or land surveyor shall submit a letter
of certification, made upon knowledge and belief in accordance with professional
standards that all work has been done in substantial compliance with the approved site
plan(Zoning Section 240-104 (G) and zoning board of appeals Special Permit decision.
This document shall be submitted prior to the issuance of the final certificate of
occupancy.
A copy of the approved plan will be available on file. If you have any questions, or require

Please be advised that subsequent to the formal site plan review meeting on September 28,
2006,the Building Commissioner, Tom Perry, has found the revised plan to be administratively
approvable subject to the following:
• All construction shall be in compliance with the approved plan entitled, "Assisted Living
Addition to Cape Regency, A Radius Healthcare Center,f120 South Nlii n Street
Centerville, MA";prepared for Radius Regency Operating LLC d/b/a Cape Regency, A
Radius Healthcare Center, Framingham, MA consisting of seven sheets, stamped and
signed on 9/9/06 by Thomas A. Ryder, Prof. Civil Engineer, SS Designs, W. Boylston,
MA, revised 12/12/06 with final revision to Sheets 4, 5 and 7 on 12/13/06 and ten sheets
stamped and signed by David Dunlap, Reg. Architect on 9/08/06 of David H. Dunlap
Associates, Inc., Hanover,MA,with final revisions dated December 7, 2006. All
submitted plan revisions are per formal site plan review September 28, 2006.
® Applicant must obtain.all other applicable permits, licenses and approvals required.
• Compliance with all Board of Health regulations, approvals and permits will be necessary
as well as Title V compliance.

• Drainage calculations submitted September 28, 2006 will require finial approval from
Growth Management Department Engineer, Steve Seymour.

2007-002) Special Permit Application to the Zoning Board of Appeals
Dear Attorney Smith.
At yesterday's Zoning Board of Appeals hearing on the above referenced application, the question 0�
was raised on the applicability of the Inclusionary affordable housing requirements of Chapter 9,
Article I of the Code of the Town. This application seeks to expand the existing nursing and
rehabilitation center with a 20,272 sq.ft., addition in order to house 29 studio and one-bedroom
units to accommodate memory impaired, Alzheimer and Dementia patients.
According to the applicant's Attorney, Patrick M. Butler, the addition is exempt from the Cape Cod
Commission's Development of Regional Impacts (DRI) review because Commission regulations-
deem this to be residential units and, as it is below 30 units, it does not trigger Commission review
as a DRI. On the other hand, it was noted that the Town's building permit for the development
would be issued as a nursing home/group home permit and not as residential units and therefore
not subject to the inclusionary affordable housing requirements.
The Board inquired as to how the same development could have it both ways, residential units in
one case, and not on the other. Given this situation, the Board is requesting that your office review
the inclusionary affordable housing regulations and offer guidance as to whether this is applicable
and if the Board has the authority to impose it.
The Board understands that Attorney Butler will contact you regarding this issue. Should you need
information or assistance from this Department, please do not hesitate to contact me or Carol
Puckett, Administrative Assistant. This appeal was continued to January 17, 2007. Materials for
that hearing will be transmitted to the Board Members on January 111h
