DaLuz : I am writing to you with respect to a parcel of land being ,shown as Lot 2 on a plan of land endorsed by the Barnstable Planning Board as Approval Not Required on April 7, 1980, which plan is recorded with the Barnstable County Registry of Deeds in Plan Book 342 , Page 9 , a copy of which is enclosed herewith. As you .can see from a review of that plan, there was a house existing on the lot as of March 21, 1980 which house has continued to- exist up to the time that Mr . Nickulas , the present owner of the property,' Yiad the house razed for the purpose of building a new single-family home this past month. The lot contains in excess of 28, 524 sq. ft . of upland and over 150 ' of frontage and, therefore, was buildable on. April 7_ 1980, the minimum requirements at that time being 20, 000 sq. ft . of area and 125 ' in width. The lot is presently suitable for single-family dwelling purposes under our present Zoning By-law for two reasons, the first of which the lot has had the benefit of an existing dwelling on it prior to the lot becoming nonconforming, as evidenced by the Approval Not Required plan. Secondly, the lot has the benefit of the protection provided by General Laws, Chapter 40A, Section 6 from the one acre requirement adopted in February of 1985 , as outlined in my Page 2 - Ltr . to Joseph'-Da-luz - February 15, 1990 . letter to you.,dated December' 9 , 1986 concerning the buildability of Lot - 1 . Intensity Regulations-Residence District , paragraph B, provides in r' pertinent part that in any residence district a one family dwelling and accessory buildings may be erected on any lot which complies with the applicable provisions of Chapter 40A of the General Laws . Massachusetts General Laws Chapter 40A Section 6 provides a in pertinent part as follows : t;. a+ Mr . " 1; to Lot 1 as shown on the enclosed plan meets all of the P ,. requirements of the above-referenced portion of Chapter 40A Section 6 in that it met the zoning as of January 1, 1976 in f all respects, was held in common , ownership at the time of the zoning change which rendered it non-conforming, ( the change to one acre was enacted in. February 1985 ) and was shown on a plan s. duly endorsed by the Planning Board dated April 7 , 1980. The Massachusetts Appeals Court has recently ruled in the case of Baldiga vs Board of Appeals of Uxbridge, 482 N. E. 2d 809, 19851' k that the above referred to language contained in 40A Section 6 provides grandfather clause protection which applies to lots where plans were recorded after January 1, 1976, but ;prior to the enactment of the ordinance establishing the new area requirement. ' In this case, although the plan is dated subsequent to January 1 , 1976, it was made and recorded prior to the zoning change to one acre in February 1985, thereby fulfilling the _ f. { Mr . DaLuz -3- December 9 , 1986 s: requirements of the statute . Therefore, it is my opinion that Lot 1 meets all of the { requirements of the above-mentioned Section 6 of Chapter 40A and therefore has protection under the provisions of the G Barnstable Zoning bylaw Section J, Intensity Regulations Residence District, paragraph B, and accordingly is a buildable lot for single family dwelling purposes .
