The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and to allow
homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-
family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one
home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form
acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section
109.1.1) l'

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner,performing work for which a building permit is,required shall be exempt
from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner
engages a person(s)for hire to do.such work,that such Homeowner shall act as supervisor."

Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor
(see Appendix Q,Rulei &Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often
results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot,
proceed against the unlicensed person as it would with a licensed Supervisor. ,The homeowner acting as Supervisor is
..ultimately-responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the
permit application,that the homeowner certify,that he/she understands the responsibilities of a Supervisor. On the last page
of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in
your community.

INTENT: It is the intent of this section to allow the residents of the.Town of Barnstable to operate a home occupation
within single family dwellings,subject to the provisions of Section 4-1.4 of the Zoning ordinance,provided that the activity
shall not be discernible from outside the dwelling: there shall be no increase in noise or odor,no visual alteration to the

•. Such use occupies no more than 400 square feet of space.- -
• There are no external alterations to the dwelling which are not customary in residential buildings, and there is
no outside evidence of such use.
• No traffic will be generated in excess of normal residential volumes.
• T'he use does not involve the production of offensive noise,vibration,smoke,dust or other particular matter,
odors,electrical disturbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flammable or explosive materials,in excess of
normal household quantities. .
• Any need for parking generated by such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard. .
e There is no exterior storage or.display of materials or equipment.
• There are no commercial vehides,related to the Customary Home Occupation,other than-one van or one _ -
pick-up truck not to exceed one ton capacity,and one.trailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containing the Customary Home Occupation.
• No sign shall be displayed indicating the Customary.Home Occupation

Hi Robin,
A guy named Tony called (508-775-2553). He is upset that the people at<�472-Souff�-Mafn7Street;_Centenrille (map
207/004)are parking 4 to 5 trucks/vans every night and washing them down, plus the painting equipment. They
wait until the evening and on weekends. The name on the vehicles is "Painting Pro" the number is 508-802- .
3896. They also have a sign out front, I think he said on a pole. He tried to speak to them, but he said the guy
doesn't speak english, or he is pretending not to understand. Tony is worried the paint will back it into his
driveway. He said it is going down the road. Anything you can do about this? I would have to see the paint make
it into our jurisdiction and effect the wetland. I can call and warn them. Can you please call Tony if there is
something you can do about this. Thanks

Found two buildings that appear to be used as multi-families
Confirmed later that both dwellings are on same lot.
First house has historic plaque on front porch.
Porch ceiling falling down, support columns are tilted.
Advised that Jonas de Paula(not sure about spelling) owns business.
Jonas does not live here but leaves trucks here.
Jonas has an employee that lives here.
Evident that trucks were parking over septic.
Parking area exceeds allowance.
Inspected first floor of first dwelling.
Invited in by first floor tenant of first dwelling—Claudio Barbalho.
Total of 4 bedrooms on first floor including makeshift bedrooms in porches.
Seven people present.
Rooms lacking lighting provisions.
One bedroom room lacked door knob—just something jutting out of the keyhole.
First floor deficient of proper smoke & CO detectors.
Second floor unit not accessible from first floor unit.
Advised that second floor is a single unit with one male tenant in residence.
That tenant left shortly after our arrival.
Found abandoned oil tank leaking in basement.
Jonas advised to contact me Monday.
Directed Claudio to have commercial trucks removed.
Officer Morrison agreed to check property the next night on midnight shift
For commercial vehicles. Will ticket Jonas if trucks remain.
BOH will contact owner regarding BOH violations noted during inspection.

sleeping area. Two beds and sheets were on porch. Number of occupants of dwelling exceeds maximum number
allowed.
Town of Barnstable Code Chapter, 170-5. Posting
Certificate of rental registration was not conspicuously posted.
You are directed to correct the violations listed above within 24 Hours
of your receipt of this notice by: fixing or repairing the Smoke Detectors and installing Carbon Monoxide
Detectors.
You are directed to correct the violations listed above within 30 days
of your receipt of this notice by: removing the abandoned fuel storage tank and supply lines in
accordance with the Fire Department Regulations. Replace trip lever in bathtub, clear clogged sink,
repair and replace rotting materials on the front porch, repair columns, repair hole in wall and ceiling to
front porch. Replace missing screens.
You may request a hearing before the Board of Health if written petition requesting same is received within ten.
(10) days after the date the order is served.
Non-compliance will result in a fine of$100.00 per violation. Each days failure to comply with an order shall
constitute a separate violation.
Should you have any questions regarding the above violations,please contact the Town Health Division and ask
to speak with the inspector who performed the inspection.

I understand that you have been questioned concerning the
status of the above property which is currently used as four
apartments, two in each building .
I recall that we discussed this matter some time ago, prior to
Mr . Franco purchasing the property. After that discussion, I
looked into the matter more closely, inquiring of a prior
resident of the property, Charles A. Richardson, and searching
the records of your office and the Board of Appeals. Enclosed
is a copy of Mr . Richardson' s affidavit, which recites the
history of the property, indicating that a 1954 Variance
supported the conversion of the front house into two apartments
and the rear dwelling was the subject matter of a building
permit , which was issued in connection with the remodeling of
the structure. Also enclosed is a copy of that Variance
decision and building permit , together with a copy of the
Barnstable Assessor 's Field Records indicating that both
buildings had two units at least as early as September 24,
h971.
Based on the above, it is my opinion that the use of four,
rental apartments on the premises are legal uses .

Road, Barnstable (Centerville) , Barnstable County, Massachusetts.
3. During the 1960's and 1970's, my family owned and improved the
above-referenced property..
4. Prior to my family's purchase of this property, it had been used
as a rooming house.
5. In 1954, a variance issued from the Board of Appeals of the Town
of Barnstable allowing the installation of a kitchen on the .second floor
of the front house and the conversion of the second floor into an
apartment, separated from the rest of the house.
6. In 1967, my family obtained a building permit from the Building
Inspector of the Town of Barnstable, the purpose of which was to make
improvements to the barn building located on the property.
7. The 1967 work on the barn involved the building of the front
downstairs living room, a bath and kitchen.
8. At the.time the work was performed on the barn pursuant to the
1967 building permit, the barn already contained two rental units.
9. The work done pursuant to the 1967 building permit was completed
in accordance with the building permit and all phases of construction
including, but not limited to, the structural , electrical and plumbing
phases, were inspected and approved by the appropriate inspectors of the
Town of Barnstable.

At the hearing, nobody appeared in opposition.
r Three "members' of the petitioners' family were present,
and testified that the remises in p question were bought
ri and used as a rooming house long before the zoning law,

It was explained that instead of using one of the second

into a kitchen, in order to have a second-floor apartment

ing difficulty in renting rooms not separated from other

lease. The consent by the LANDLORD to an assignment or subletting shall not be construed to relieve the TENANT from obtaining the consent in
writing of the LANDLORD to any further assignment or subletting.

22. UREA FORMALDEHYDE INSULATION-UFFI:A LANDLORD of a residential dwelling containing UFFI shall disclose or cause to be
disclosed to all prospective tenants and to all existing tenants the presence of UFFI in the dwelling. In the case of a prospective TENANT,a
LANDLORD aware of the presence of UFFI in the dwelling shall make the disclosure before entering into a lease or rental agreement with the
TENANT. The disclosure shall be made in writing,and shall be in the form of the disclosure set forth in 105 CMR 651.011(3)or as amended and

AFFIDAVIT
I, ,Charles A. Richardson, do, on oath depose and say as follows:
1. I am an adult residing at 82 Birchwood Drive, Holden, Worcester
County, .Massachusetts.
2. ;,,, I -am familiar with the real estate located at 472 South County
Road, Barnstable (Centerville), Barnstable County, Massachusetts.
3. During the 1960's and 1970's, my family owned and improved the
above-referenced property..
4. Prior to my family's purchase of this property, it had been used
as a rooming house.
5. In 1954, a variance issued from the Board of Appeals of the Town
of Barnstable allowing the installation of.a kitchen on the .second floor
of the front house and the conversion of the second floor into an
apartment, separated from the rest .of, the house.
6. In 1967, my family obtained a building permit from the Building
Inspector of the Town of Barnstable, the purpose of which was to make
improvements to the barn building located on the property.
7. The 1967 work on the barn involved the building of the front
downstairs living room, a bath and kitchen.
8. At the time the work was performed on the barn pursuant to the
1967 building permit, the barn already contained two rental units.
9. The work done pursuant to the 1967 building permit was completed
in accordance with the building permit and all phases of construction _
including, but not limited to, the structural , electrical and plumbing
phases, were inspected and approved by the appropriate inspectors of the
Town of Barnstable.

Dear Mr . Daluz:
I understand that you have been questioned concerning the
status of the above property which is currently used as four
apartments, two in each building .
I recall that we discussed this matter some time ago,• prior to
Mr . Franco purchasing the property. After that discussion, I
looked into the matter more closely, inquiring of a prior
resident of the property, Charles A. Richardson, and searching
the records of your office and the Board of Appeals. Enclosed
is a copy of Mr . Richardson' s affidavit, which recites the
history of the property, indicating that a 1954 Variance
supported the conversion of the front house into two apartments
and the rear dwelling was the subject matter of a building
permit , which was issued in connection with the remodeling of
the structure. Also enclosed is a copy of that Variance
decision and building permit , together with a copy of the
Barnstable Assessor 's Field Records indicating that both
buildings had two units at least as early as September 24,
f971.
Based on the above, it is my opinion that the use of four
rental apartments on the premises are legal uses .

ing difficulty in renting rooms not separated from other
or common._-living quarters would be avoided. The addition
of a dormer window in the proposedkitchen would be at the
3 rear.,of the house, and no exterior change in the premises
would affect the character and appearance of the neighbor-

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINMON OF HOMEOWNER
Persons) who owns a parcel of land on'which he/she resides or intends to reside, on which there is, or is intended to-
be, a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a fivo-year period shall not be considered a homeowner. Such
"homeowner" shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be
responsible for all such work performed under the building-Perrot. (Section 109.1.1)

HOMEOWNER'S EXEWTION
The Code states that "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
'this section(Section 109.1..1 -Licensing of construction Supervisors);provided that if the homeowner engages a persons)for hire to do such
irk,that such Homeowner shall act as supervisor,"
Many homeowners who use this exemption air unaware that they arc assuming the responsibilitics of a supervisor(see Appendix Q,
j)cs&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
icn the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would With a licensed
pervisor. The homeowner acting as supervisor is ultimately responsible.
To ensure that the homeowner is fully aware ofhis/hcr responsibilities,many communities require,as part of the permit application,
t the homeowner certify that he/she understands the rtsponsnbilities of a Supervisor. On the last page of this issue is a form currently used by
,cral towns. You may care t amend and adopt such a form/certification for use in your corrununity.
