It is improved with a one and a half story single-family residence. The property is located in an RC Residential C Zoning District which requires a minimum 20 foot front yard, 10 foot side yard and 10 foot rear yard setback. The applicant is proposing to extend the existing kitchen by constructing a 10'x 12' addition to the east side of the house. The property is a corner lot so a front yard setback is required off Taramac Road and Lietrim Circle. The house currently conforms to all setback requirements, being situated approximately 53' from Taramac Road and 25'from Lietrim Circle. The proposed addition will extend 5' into the minimum 20'setback required off Lietrim Circle. The applicant is seeking a variance to Section 3-1.3(5) of the Zoning Ordinance- Bulk Regulations, in order to allow construction of a proposed addition that would encroach to within 15' from the eastern lot line. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 6, 1999. Two 60 day extensions of time for holding the hearing and for filing of the decision were executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened March 17, 1999 and continued to June 02, June 30 and July 21, 1999, at which time the Board denied the applicant's request. Hearing Summary: At the start of the hearing, Chairman Emmett Glynn read a letter from Paul Crosby which states, "Due to a death in the family, I am unable to attend this evening's meeting." He requested this appeal be continued. It was decided to continue this appeal to June 02, 1999 at 7:30 PM at which time Board Members will be assigned. Board Members hearing this appeal on June 02, 1999 were Gene Burman, Gail Nightingale, Richard Boy, Ron Jansson, and Chairman Emmett Glynn. Paul Crosby was present. Also, the east side of the house is where the kitchen and dining room are currently located. The Board suggested the applicant provide an engineered plan and a floor plan in addition to the submitted plot plan in order to better assess this site and the need for zoning relief. Public Comment: No one spoke in favor or in opposition to this appeal. The Board suggested a continuance and the applicant agreed. It was decided to continue Appeal Number 1999-33 to 06/30/99 @ 7:00 PM. No one was present to represent the applicant at the June 30, 1999 continuance. The property is located in an RC Residential C Zoning District which requires a minimum 20 foot front yard, 10 foot side yard and 10 foot rear yard setback. The applicant is proposing to extend the existing kitchen by constructing a 10'x 12' addition to the east side of the house. The property is a corner lot so a front yard setback is required off Taramac Road and Lietrim Circle. The house currently conforms to all setback requirements, being situated approximately 53'from Taramac Road and 25'from Lietrim Circle. The proposed addition will extend 5' into the minimum 20' setback required off Lietrim Circle. The applicant is seeking a variance to Section 3-1.3(5)of the Zoning Ordinance- Bulk Regulations, in order to allow construction of a proposed addition that would encroach to within 15'from the eastern lot line. Single-family homes directly abut the property to the west and south. A traffic island at the intersection of Taramac Road, Lietrim Circle and Donegal Circle separates the subject site from the residences to the north. Lietrim Circle separates the property from the neighbors to the east. Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. It is improved with a one and a half story single-family residence. The property is located in an RC Residential C Zoning District which requires a minimum 20 foot front yard, 10 _ foot side yard and 10 foot rear yard setback. The property'is a comerlot so a front yardaetback is:required off Taramac Road and:Lietrim Circle. The house currently conforms to all setback requirements;being situated approximately°53'lfrom Taramac Road and 25'from Lietrim Circle. The proposed addition will extend 5' into the minimum 20' setback required off Lietrim Circle. The applicant is seeking a variance to Section 3-1.3(5) of the Zoning Ordinance-Bulk Regulations, in order to allow construction of a proposed addition that would encroach to within 15'from the eastern lot line. Single-family homes directly abut the property to the west and south. A traffic island at the intersection of Taramac Road, Lietrim Circle and Donegal Circle separates the subject site from the residences to the north. Lietrim Circle separates the property from the neighbors to the east. Variance Findings: In consideration for the Variance, the petitioner must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance.
