Mr.Daigle stated that nothing has changed in the conditions affecting the lot and would hope that the Board could see its way to reissue those variance to the lot. Attorney Daigle stated that Ms. LeClair is still caring for her father,Mr.Albert A.Tartaglia,and her intent is to build the home for herself At the request of the Board,Attorney Daigle reiterated the variance conditions. He stated conditions are established by the nature of the location and shape of the lot. The required setbacks from Route 28 and Tellegen Trail limit the buildabilty of the lot. The lot is bordered with the herring run on the west and Route 28 on the south. The lot has a different shape than others in the subdivision and the 100-foot setback from Route 28 encumbers most of the lot area. Public comment was requested and Joseph M. Loud of 73 Tellegen Trail spoke in opposition citing that the building and clearing of the lot would open the street to view and noise of Route 28. Findings of Fact: At the hearing of September 26, 2007, the Board made the following findings of fact: 1. Appeal 2007-076 is that of Kathleen LeClair for properties addressed as 85 and 89 Tellegen_Trail, Centerville MA. The lots are shown on Assessor's Map 230 as parcels 151 and 152. They are in a Residence D-1 Zoning District and Resource Protection Overlay District. The lots were created by a 1971 subdivision plan recorded at the Barnstable Registry of Deeds in Plan Book 254, page 52. The vacant lot consists of 21,200 sq.ft., and is shown as Lot#8 on a 1971 subdivision plan and conformed to the district's minimum lot area of 20,000 sq.ft., in 1971. The district's minimum lot area remained 20,000 sq.ft., until 1985 when it increased to one-acre. The applicant has resubmitted the plan for the development of the lot. That plan shows a proposed dwelling measuring 36 by 28 feet with an attached garage (14 by 22 feet) and a small deck (10 by 12-feet). The lot fronts both Tellegen Trail and Route 28. Access to the home is to be from Tellegen Trail. The plan shows that the proposed structure is to be situated 30.8 feet off Route 28. 8. In April of 2006, the Board granted variances to this lot(Variances 2006-30 and 2006-35). Those variances were not executed within the prescribed one-year time frame imposed by MGL Chapter 40A Section 10, and the applicant is requesting the variances be re-granted. The objective remains the same as in 2006. That being, to 'un-merge' two adjoining undersized lots and develop the vacant lot with a single-family dwelling located 30.8 feet off Route 28 where a 100 foot setback is required. 9. Owing to circumstances that this is a narrow shaped lot, and that the proximity to Route 28 and the herring run established special conditions in terms of soil, shape, and topography that effect the lot. Those issues are not generally found in this zoning district; therefore, unique to the lot. 10.A literal enforcement of the provisions of the zoning ordinance would involve substantial financial hardship to the petitioner if the lot could not be developed. 11. With appropriate conditions, the desired relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. At that hearing the Board found to grant the variance requested subject to conditions herein. Board Members deciding this appeal were,James R. Hatfield,Jeremy Gilmore,John T. Norman, Kelly Kevin Lydon,and Chairman -Gail C. Nightingale. Attorney Peter M. Daigle represented the applicant. He noted that the variances being requested had been granted in 2006. At the request of the Board,Attorney Daigle reiterated the variance conditions. He stated conditions are established by the nature of the location and shape of the lot. The required setbacks from Route 28 and Tellegen Trail limit the buildabilty of the lot. The lot is bordered with the herring run on the west and Route 28 on the south. The lot has a.different shape than others in the subdivision and the 100-foot setback from Route 28 encumbers most of the lot area. Public comment was requested and Joseph M.Loud of 73 Tellegen Trail spoke in opposition citing that the building and clearing of the lot would open the street to view and noise of Route 28. Findings of Fact: At the hearing of September 26, 2007,the Board made the following findings of fact: 1. Appeal 2007-076 is that of Kathleen LeClair for properties addressed as 85 and 89 Tellegen Trail, Centerville MA. The lots are shown on Assessor's Map 230 as parcels 151 and.152. They are in a Residence D-1 Zoning District and Resource Protection Overlay District. The applicant has applied for variances to Sections 240-36-Resource Protection Overlay District and 240-11(E)- Bulk Regulation, Minimum Lot Area and 100-foot Front Yard Setback from Route 28. The applicant seeks to create a buildable undersized lot from a lot that has merged due to common ownership of adjoining lots and then to develop that vacant lot addressed as 89 Tellegen Trail with a single-family dwelling located 30.8 feet off Route 28 where a 100-foot setback is required. 2. The lots were created by a 1971 subdivision plan recorded at the Barnstable Registry.of Deeds in Plan Book 254, page 52. During that time, Mr.Tartaglia either had to transfer one lot into separate ownership or build a dwelling upon the vacant lot. Neither action was taken and in February 1990, the grandfather protection expired. The lot fronts both Tellegen Trail and Route 28. Access to the home is to be from Tellegen Trail. The plan shows that the proposed structure is to be situated 30.8 feet off Route 28: 8. In April of 2006, the Board granted variances to this lot(Variances 2006-30 and 2006-35). Those variances were not executed within the prescribed one-year time frame imposed by MG Chapter . 40A Section 10, and the applicant is requesting the variances be re-granted. The objective . remains the same as in 2006. That being,.to 'un-merge'two adjoining undersized lots and develop the vacant lot with a single-family dwelling located 30.8 feet off Route 28 where a 100 foot setback is required. 9. Owing to circumstances that this is a narrow shaped lot, and that the proximity to Route 28 and the herring run established special conditions in terms of soil, shape,and topography that effect the lot. Those issues are not generally found in this zoning district; therefore, unique to the lot. 10.A literal enforcement of the provisions of the zoning ordinance would involve substantial financial hardship to the petitioner if the lot could not be developed. 11. With appropriate conditions,the desired relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance.
