At the December 2012 meeting we reviewed and discussed the following documentation prior to my clients' purchase of the property: l. In 1949 the original subdivision plan prepared for Wequaquet Trust reflected that Lot 48 did not have any frontage on Tern Lane. However, in 1949,there was no frontage requirement. See Exhibit 1. 2. By deed dated April 10, 1953, the Wequaquet Trust conveyed Lot 49 to Stanislaus A. McLean and Grace A. McLean. See Exhibit 2. At the time of the conveyance of Lot.49 to McLean, the Trust reserved access to Lot 48 "over a strip of land 30 feet in width along the edge of the pond...for use in common with others for uses as ways are commonly used." Exhibit 2. This action by the Trust created the "way". 3. The reference to the "way" providing access to the property (Lot 48) and the requisite frontage is reflected`throughout the deeds in the chain of title to Lot 48, including the current deed. See Exhibit 3 (noting"a 30 foot way, running from Lot 48...in common with all others entitled thereto for such uses as ways are commonly used."); see also Exhibit 4 (noting "a 30 foot way running from Lot 48 to a way marked "Way" as shown on the above referenced plan over Lot 49. Said way to be used for the purposes for which.ways are commonly used.") f 4. The 30 foot way is also depicted on a plan of land recorded with the Barnstable County Registry of Deeds in Plan Book 147, Page 113. See Exhibit 5 (noting that the plan dimensionally depicts the way but incorrectly names it a right of way.). After reviewing the above documents at our December 2012 meeting you stated that there was sufficient frontage on a way. Additionally, we discussed where the front yard setback would be determined from, and our plans reflect your determination.
