Pursuant to this statute, an employee is defined as "...every person in the service of another under any contract of hire, express or implied, oral or written." An employer is defined as"an individual,partnership, association, corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity,employing employees. However the owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer." MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold.the issuance or . renewal of a license or permit to operate a business or,to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required." Additionally,MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." I had an opportunity--to look at the property again this weekend, and I find that there continues to exist a seriously dangerous condition at that site. As you will recall, the foundation which is in the ground at this time has been present for in excess of three years . The snow fence which has been erected is totally unacceptable, and does not prevent the possible entry of small children or animals . In addition, as you are aware, there are several empty foundations on Bay Lane, which are not properly capped. These foundations have also been in existence for over two years . As I requested in June, M.G.L. c. 139 provides that the Town Council of Barnstable may conduct a hearing to adjudge the unfinished foundation on Lot 17 to be a nuisance and to order the same to be abated. We would suggest that capping of the foundation would be an appropriate abatement at this juncture. The other alternative would be demolition and filling. I would, therefore, renew my request that steps be taken to schedule a hearing and to provide for proper abatement in order to prevent a potentially tragic situation. For the past three years we have endured the complete negligence and disregard by these developers of our requests that they either complete construction or at the very least cap this foundation and remove debris that litters the lot. In addition to having a-significant negative.effect on property values of other homes in the area, the failure of Silvia& Silvia to act in a responsible fashion places them in clear violation of the Massachusetts State Building Code, specifically Sections 113.9 Time limitation of application, and 114.3 Expiration of Permit.
