Plan No. 32290D F Waterman Farm Road; Centerville - Dear Mr. Crossen: Following up our last meeting.relative to the status of,the private portion of Waterman Farm Road, I have run the record title to the Waterman Farm property Well back into the 1800's,pulled the relevant records from the Town's engineer's office and planning board, and have discussed the history of the farm,and surrounding area with-its present owner and descendants of prior owners. The records at the Barnstable County Registry of Deeds indicate that,in the mid- 1800's,the Waterman Farm consisted of approximately fourteen acres, bounded by the Centerville River,on the east'and various parcels of upland, bog and swampland to the• south, west and north. It was the homestead of Prentiss and Caroline Kelley.,In 1881, after Prentiss'-death, the farm was conveyed,to Hannah Waterman. Hannah died in the early 1900's and four of her five,surviving children conveyed-'a life interest in the property to the fifth, surviving child, William Waterman. -William gradually obtained title to ' many smaller surrounding parcels of land, a few of which were later sold by his heirs. The original farm parcel and a few contiguous parcels of swamp and bog land are still in his family today;being owned by his grandnephew's widow, Olga Fuller, and his grand nephew,Thomas Waterman. The land was registered with the Land Courtin 1973. With respect to the status.of Waterman Farm Road in the records at the Registry of Deeds,the public portion thereof is.shown on the-Land Court plans as "Waterman Farm Road" and the private portion thereof is shown as "Way G" and"Way-E,"which are merely continuations or extensions of the road. (A copy of Land Court Plan No. 32290D is enclosed for your reference.) - - The Town's engineering office recognizes Waterman Farm Road as both public and private. Since the only.portion,of Waterman Farm Road that has not been laid out by the town as a public road is that•shown on the Land Court Plan as "Way G'-and"Way E and the continuation of"Way E"beyond the borders of the Land Court decree (and possibly "Way M"), it is clear that the Town engineer's office recognizes at least"Way G" and"Way E" as,a private road known as Waterman_ Farm-Road. .(See the enclosed Street Listing for the Town of Barnstable.) Likewise, the records of the Town'.s Planning Board clearly:recognize the ways in question as the private way known as Waterman Farm Road. In 1978, the lot in question was created-on an Approval Not Required plan,the application for which and resultant endorsement of the ANR.plan indicating a finding that"Way G" and."Way E" (and an extension of"Way E" designated as"Way M" on the Land Court Plan) constituted a way sufficient for creation of lots thereon pursuant to M.G.L. Ch. 41, Sec. 81P. (Enclosed are copies of the Application and Minutes of the meeting indicating the approval.) L R-As you know;the question,of-the suitability of the way for consideration under Section 81P is determined with reference to M.G.L. Ch. 41, Sec. 81L, wherein a way is considered sufficient.for such a determination if it was "in existence when the subdivision control law became effective (in Barnstable, 1962) and had, in the opinion�of the planning board, sufficient width, suitable grades and adequate construction to provide for the needs of vehicular traffic in relation to the proposed use of the land abutting thereon or served thereby, and for the installation of municipal.services to serve such land and the buildings erected or to be erected thereon." The endorsement of the above- referenced ANR plan dictates that such a finding was made with respect to the relevant portion of Waterman Farm Road-in 1978. In_fact,the subsequent registration of this ANR plan(as Land Court Plan No. 32290D) would appear to conclusively recognize the Upropriateness of such finding,M.G.L, Ch. 41, Sec. 81FF, (copy enclosed). ~ It is also noteworthy;that the same finding with respect to Waterman Farm.-Road" was of necessity inade.by the-Planning Board with respect to its ANR endorsement of a number of other lots with frontage further on down along this way. (Barnstable Registry of Deeds, Plan Book 357, Page'65, Plan Book 195,"Page 53, and Plan Book 137, Page 125.) _ In order to.gain some insight'as to the historical existence on the ground of this way, I have discussed the property's past withone of its current owners, Olga Fuller, who has lived in the area since the 1940s and was familiar with the property prior thereto. I- have;also discussed.the property at some length with Vivian Nault,who, being a direct descendent of the Kelleys referred to hereinabove, seemed best able to lend some insight. From the information provided me,.it appears that the way:more recently known as Waterman Farm Road was used to accessthis property and many other properties in the area at least since the 1800's when the Kelleys lived on and worked the property. From 1880 to date, the Waterman family has owned the farm and, as described above, some of the surrounding lands which also have used Waterman Farm Road.to access their properties. William Waterman lived on and operated the farm until 1938, when the hurricane of that year destroyed his home. William lived down the road from the property after that, but continued to operate the farm:until his death in 1944 or 1945, at which time the family disassembled what was left of the dwelling and discontinued the - operation of the farm. At present, the private portion of Waterman Farm Road which is shown as "Way G" and"Way E" is still in existence and is a well traveled way used to access-a number of properties abutting thereon,including locus, all of which bear street addresses on"Waterman Farm Road." I trust the above information is sufficient to enable you to make a finding that this lot meets the frontage requirements for zoning. Recommendation from the D.P.W. is that only 3 lots which are pending for sale be released until such time as a bond for $10,000 is posted as security for proper completion of the subdivision. Mr. John Lebel & Mr. Paul Lebel re: ' Drainage problem "Hickory Hills" Mr. Paul Lebel stated that he and his brother feel the same as last week that-;they are not responsible for the water problem of Mrs. Talbot.
