The ovens in question are used for preparing food. If not properly cleaned immediately after use the ovens could be a source for rodents searching for food. 2. This kind of commercial equipment requires industrial cleansing, that increases risk of chemical run off into street and nearby storm drain. It also becomes a hazard for neighboring children and animals. 3. The ovens sitting in the yard have signs on them advertising what they are and the phone number of the company or owner,this could be a threat to property values. In closing commercialized equipment such as these ovens should not be on residential property. Please continue to enforce "with the cease and desist the storing, garaging and keeping of commercial business equipment". My complaint was that there were several large cooking units stored in the yard. The person with whom I spoke checked map with this location on it and advised me that this location is residential and not zoned for business and no business request had been made of the zoning board;therefore, I am requesting again that this business and its cookers be removed and not allowed to be stored on this property. Several pictures were presented to the office showing all these cookers that were stored at 122 White Oak Trail. For the past several years we have had to endure daily the sight of as many as four and five large (and very large) pieces of commercial barbecue/ smokers (see Attachments) parked directly in front of the Sanborn house as we come and go from our residence directly across the street. It goes almost without saying that such a display is not in keeping with a residential area that, for the past twenty years we have been here,has been an attractive and extremely well cared for living space.We would like to point out that in addition to the visual affront of the presence of this equipment,the property value of surrounding property, according to realtor estimates, is affected quite negatively. We urge that Sections 3- 1.3 and 4- 1.1 of the Zoning Ordinance continue to be enforced for the general welfare of the White Oak Trail community. During the last five to six years of my ownership, I watched in dismay as their driveway become a holding area for a dismantled boat, a full size sleeping trailer and several large commercial barbecue smokers, which on occasion were fired up! Mind you, all of.this I looked out on as well as passed when you came and went from my residence. In�the twenty some odd years that I lived on White Oak Trail,I cannot recall anyone with such an array of equipment. As a residential area,the street has been an attractive and very well cared for place to live with the exception of the Sanborn property. Not only is the front yard an eyesore, but also has a negative affect on the surrounding properties and their real estate value. It is my hope that Sections 3-1.3 and 4-1.3 of the Zoning Ordinance continues to be enforced for the well ell beingof the residents of White Oak Trail. Thank you. This is a residential area and we have worked hard to keep our property neat and orderly. Mr. Sandbom has kept large smoker trailers and a full size storage trailer on his property with Jarge signs on top with a large phone number on it if you want to hire him and.his trailer to do cooking. These trailers are as large as some u haul trucks. He keeps them in front and on the side of his house at times there have been four trailers on his lawn in front of his house. First of all the trailers are unsightly, second this is a.area of homes and we should not be subject to his business equipment/signage and third we worry about rodents, all these trailers are used to smoke food in, that can attract rodents. A neighbor on our road has one of the largest landscaping canys' on the Cape; you would not know he is in the landscape business you never see any trucks or landscaping equipment in his yard.or in front of his house. That's the difference between a good neighbor and a neighbor who doesn't care what he's doing to our road. I am a realtor and.have worked in real estate for 16 years and I can tell you that houses like Mr. Sandborn's hurts our resale value and we lose money because his house with all this equipment takes our entire road's prices down. It is alleged that Mr. Sanborn is in the Barbeque business and, in keeping with that business is keeping two commercial Barbeque smokers at his residence in Centerville. Petitioner seeks the determination of this Board that no business is being operated out of his home and that the equipment stored at the said home is for his personal use. LOCUS The property in question is a single-family residence known and numbered at 122 White Oak Trail in Centerville. The property is further shown on the Town of Barnstable Assessor's Map 192, Parcel 198. FACTS James M. Sanborn is a regional sales person for Southern Pride Equipment. As such, he travels to six or seven states as a door-to-door salesman for that purpose. Mr. Sanborn sees no customers at his residence and has never received a delivery of even one piece of equipment at his home for further delivery to his customer. Mr.-Sanborn has maintained his residence at 122 White Oak Trail for the past twelve years. He does-have a passion for barbeque and his a long-standing member of the National Barbeque Association. He has purchased over the years a number of large commercial smokers for his private use, and even trailers them to the homes of other National Barbeque Association members for Association "Group Smokeouts". ARGUMENT The intension behind Section 3-1.3 and Section 4-1.0 of the zoning ordinance is to limit and control business activities in residential districts. While Mr. Sanborn does on occasion receive and make telephone calls relative to his employment with Souther Pride,this is the only business activity taking place at his home. Contrasting Mr. Sanborn's activities with those of any number of other businesses, such as those of a landscaper,plumber, painter, mason, etc., where business equipment is commonly stored in single family residences located in residential districts. I cannot imagine that most painting contractors, for example, do not keep ladders, brushes,paint, turpentine, etc. at their homes. Plumbers often keep a supply of copper pipes at their homes and in their work-related trucks, etc. Mason keep trailers, cement mixes on trailers and take them to and from work sites. Section 3-1.3 of the zoning ordinances of the Town of Barnstable provides for single-family residential dwellings as a principle permitted use. Accessory to that use is the ability to barbeque meals for family and friends. It is conceded that Mr. Sanborn uses equipment that has greater capacity than most used at residential homes. Section 4-1.1 of the zoning ordinance addresses specifically accessory uses of a residential property where such use is customarily incidental to and subordinate to the principal use that is served. Mr. Sanborn and his family comprise the five occupants of this home. The occasional group barbeque or smokeout is accessory to and subordinate to the use of the property as a single family residence. FINDINGS AND DECISIONS For the reasons set forth above the applicant respectfully requests that his Board find that Mr. Sanborn's maintenance of a commercial cooker at his home is not part of a commercial activity; and, further, that said maintenance of equipment does not constitute the keeping and storing of business equipment in violation of Sections 301.1 and 4-1.1 of the zoning ordinance of the T own of Barnstable. Sanborn Property Address: 122 White Oak Trail,Centerville MA Assessor's Map/Parcel: Map 192,Parcel 198 Zoning: Residential C and Resource Protection Overlay District Relief Requested&Background The applicant is appealing the Building Commissioner's issuance of a June 01, 2001, order to cease and desist. The order alleges that the applicant,James M. Sanborn is carrying on business activity within a residential zoning district. According to the Building Division files,the question of the business use of the property dates back to March of 1998. At that time, complaints were made to both the Building Division and Health Division claiming a number of commercial type barbeques and cookers were parked in and around the garages. The complaints were investigated, and the applicant responded noting that he would reduce the number to one- his personal cooker. Complaints continued and during the year 2000,three separate complaints were received and investigated by the Building Division. Three commercial cookers were noted as being on the property. On May 21, 2001, another Complaint Inquiry by the Building Division ruled that it was a"business operating in a residential zone". Pictures were taken showing at least three, perhaps as many as five commercial cookers in the garage area of the home. On May 31, 2001,the Building Division wrote to Mr. Sanborn citing the violation of zoning and included the June 01, 2001 order to cease and desist. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 22, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September19, 2001, at which time the Board found to uphold and reaffirm the Building Commissioners decision. Board Members deciding this appeal were Gail Nightingale, Richard L. Boy,Ralph Copeland,Jeremy Gilmore, and Chairman, Ron S.Jansson. ' Attorney Mark H. Boudreau represented Mr.James Sanborn who was also present during the hearing. Mr. Boudreau stated that Mr. Sanborn is not running a business and that the two large commercial cookers on the property were for his personal use. The Board noted that Mr. Sanborn has a truck with lettering advertising the business. They discussed the number of cookers on the property. The Board stated that this was not a customary home out-door cooking equipment,,but was being used for a business. The health dept staff inspection report was also cited. Mr.Boudreau submitted to the file two letters of support. They were from Skiff Greene and Dale Bishop, Norton, MA. The public was invited to comment and testify. Mike Murphy, a neighbor, supported the petitioner and stated that he did not think it was a business use. Helen Kenney stated Mr. Sanborn is employed with Southern Pride, as a salesman and distributor of the commercial cookers. He demonstrates the use of the equipment and it is moved many times a week for that purpose. Phil Haggerty stated that there are as many as seven units at any time and that they are moved on average six or seven times a month. He submitted photos taken in February 2000. Mr. Vagts read a letter stating that the property was being used as a commercial property. Mr.Boudreau stated that he had made a site visit and that there were two pieces of equipment on the property today. Findings of Fact: At the hearing of September 19, 2001,the Board unanimously found the following findings of fact: 1. James M. Sanborn has appealed the June 1,2001 order of the Building Commissioner to cease and desist the storing, garaging and keeping of commercial business equipment as it is in violation of Section 3-1.3,Principal and Conditional Uses and Section 4-1.1 Accessory Uses of the Zoning Ordinance. The property is shown on Assessors Map 192 as Parcel 198. It is addressed 122 White Oak Trail, Centerville MA and is located in a Residential C Zoning District. 2. The applicant has been storing large commercial barbeque equipment in his yard for several years. The equipment being stored on the property is not found in most homes. It is commercial equipment that is not customary found in single-family homes. The size of the equipment is not incidental nor is it accessory to the residential use. 3. The equipment is in fact, accessory to the business activity that the applicant is carrying on in his home. The storage of that equipment on the property is not permitted under Section 4-1.4 of the Zoning Ordinance that regulates Home Occupations. 4. The predominate use in this Residential C Zoning District is single-family dwellings. It is the only principal use permitted as-of-right. 5. "New England Barbecue/Southern Pride" is listed in the Business Listings of the Hyannis Area July 2001 phone book. The listing did not give a street address but did note Centerville. The phone number given for that business was 508-775-1920. That phone number is the exact phone number 2 listed on the Zoning Board Application submitted by the applicant on June 22, 2001. The company is also listed under Restaurant Equipment and Supplies. Decision: Based on the findings of fact, a motion was duly made and seconded to affirm and uphold in full the decision of the Building Commissioner as stated in his June 1,2001 cease and desist order issued to Mr. James M. A. The activity is carried on by the permanent resident of a single-family residential dwelling unit,located within that dwelling unit. B. The activity is a type customarily carried on.within a dwelling unit. C. Such use is clearly incidental to and subordinate to the use of the premises for residential purposes. D. First of all the trailers are unsightly, second this is a area of homes and we should not be subject to his business equipment/signage and third we worry about rodents, all these trailers are used to smoke food in, that can attract rodents. I A neighbor on our road has one of the largest landscaping companys' on the Cape, you would not know he is in the'landscape business you never see any trucks or landscaping equipment in his yard or in front of his house. That's the difference between a good neighbor and a neighbor who doesn't care_ what he's doing to our road. I am a realtor and:have worked in real estate for 16 years and I can tell you that.houses like Mr. Sandborn's hurts our resale value and we lose money because his house with all this equipment takes our entire road's prices down. Sanborn HEARING DATE: September 19, 2001 RELIEF REQUESTED This is an appeal of the Building Inspectors of The Town of Barnstable for a determination that James M Sanborn has violated Section 3-1.3 and Section 4-1.1 of the Zoning Ordinances of the Town of Barnstable by the storing, garaging, or keeping of commercial business equipment. It is alleged that Mr. Sanborn is in the Barbeque business and, in keeping with that business is keeping two commercial Barbeque smokers at his residence in Centerville. Petitioner seeks the determination of this Board that no business is being operated out of his home and that the equipment stored at the said home is for his personal use. LOCUS The property in question is a single-family residence known and numbered at 122 White Oak Trail in Centerville. The property is further shown on the Town of Barnstable Assessor's Map 192, Parcel 198. FACTS James M. Sanborn is a regional sales person for Southern Pride Equipment. As such, he travels to six or seven states as a door-to-door salesman for that purpose. Mr. Sanborn sees no customers at his residence and has never received a delivery of even one piece of equipment at his home for further delivery to his customer. Mr. Sanborn has maintained his residence at 122 White Oak Trail for the past twelve years. He does have a passion for barbeque and his a long-standing member of the National Barbeque Association. He has purchased over the years a number of large commercial smokers for his private use, and even trailers them to the homes of other National Barbeque Association members for Association "Group Smokeouts". ARGUMENT The intension behind Section 3-1.3 and Section4-1.0 of the zoning ordinance is to limit and control business activities in residential districts. While Mr. Sanborn does on occasion receive and make telephone calls relative to his employment with Souther Pride, this is the only business activity taking place at his home. Contrasting Mr. Sanborn's activities with those of any number of other businesses, such as those of a landscaper,plumber,painter, mason, etc., where business equipment is commonly stored in single family residences located in residential districts. I cannot imagine that most painting contractors, for example, do not keep ladders, brushes,paint, turpentine, etc. at their homes. Plumbers often keep a supply of copper pipes at their homes and in their work:related trucks, etc. Mason keep trailers, cement mixes on trailers and take them to and from work sites. Section 3-1.3 of the zoning ordinances of the Town of Barnstable provides for single-family residential dwellings as a principle permitted use. Accessory to that use is the ability to barbeque meals for family and friends. It is conceded that Mr. Sanborn uses equipment that has greater capacity than most used at residential homes. Section 4-1.1 of the zoning ordinance addresses specifically accessory uses of a residential property where such use is customarily incidental to and subordinate to the principal use that is served. Mr. Sanborn and his family comprise the five occupants of this home. The occasional group barbeque. or smokeout is accessory to and subordinate to the use of the property as a single family residence. FINDINGS AND DECISIONS For the reasons set forth above the applicant respectfully requests that his Board find that Mr. Sanborn's maintenance of a commercial cooker at his home is not part of a commercial activity; and, further, that said maintenance of equipment does not constitute the keeping and storing of business equipment in violation of Sections 301.1 and 4-1.1 of the zoning ordinance of the T own of Barnstable.
