James M.Sanborn Property Address: 122 White Oak Trail,Centerville MA Assessor's Map/Parcel: Map 192,Parcel 198 Zoning: Residential C and Resource Protection Overlay District Relief Requested&Background The applicant is appealing the Building Commissioner's issuance of a June 01,2001,order to cease and desist. The order alleges that the applicant,James M. Sanborn is carrying on business activity within a residential zoning, district. According to the Building Division files, the question of the business use of the property dates back to March of 1998. At that time, complaints were made to both the Building Division and Health Division claiming a number of commercial type barbe.ques and cookers were parked in and around the garages. The complaints were investigated, and the applicant.responded noting that he would reduce the number to one—his personal cooker. Complaints continued and during the year 2000,three separate complaints were received and investigated by the Building Division. Three commercial cookers were noted as being on the property. On May 21,2001,another Complaint Inquiry by the Building Division ruled that it was a"business operating in a residential zone". Pictures were taken showing at least three, perhaps as many as five commercial cookers in the garage area of the home. On May 31,2001,the Building Division wrote to Mr. Sanborn citing the violation of zoning and included the June 01,.2001 order to cease and desist. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 22, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 19,2001,at. which time the Board found to uphold and reaffirm the Building Commissioners decision. Board Members deciding this appeal were Gail Nightingale,Richard L.Boy,Ralph Copeland,Jeremy Gilmore, and Chairman,Ron S.Jansson. Attorney Mark H.Boudreau represented Mr.James Sanborn who was also present during the hearing. Mr. Boudreau stated that Mr. Sanborn is not running a business and that the two large commercial cookers on the property were for his personal use. The Board noted that Mr. Sanborn has a truck with lettering advertising the business.. They discussed the number of cookers on the property. The Board stated that this was not a customary home out-door cooking equipment, but was being used for a business. The health dept staff inspection report was also cited. Mr..Boudreau submitted to the file two letters of support. They were from Skiff Greene and Dale Bishop, Norton,MA. The public was invited to comment and testify. Mike Murphy,a neighbor, supported the petitioner and stated that he did not think it was a business use. Helen Kenney stated Mr.Sanborn is employed with Southern Pride, as a salesman and distributor of the commercial cookers. He demonstrates the use of the equipment and it is moved many times a week for that purpose. Phil Haggerty stated that there are as many as seven units at any time and that they are moved on average six or seven times a month. He submitted photos taken in February .2000. Mr.Vagts read a letter stating that the property was being used as a commercial property. Mr.Boudreau stated that he had made a site visit and that there were two pieces of equipment on the property today. Findings of Fact: At the hearing of September 19,2061, the Board unanimously found the following findings of fact: 1. James M. Sanborn has appealed the June 1,2001 order of the Building Commissioner to cease and desist the storing, garaging and keeping of commercial business equipment as it is in violation of Section 3-1.3, Principal and Conditional Uses and Section 4-1.1 Accessory Uses of the Zoning Ordinance. The property is shown on Assessors Map 192 as Parcel 198. It is addressed 122 White Oak Trail, Centerville MA and is located in a Residential C Zoning District. 2. The applicant has been storing large commercial barbeque equipment in his yard for several years. The equipment being stored on the property is not found in most homes. It is commercial equipment that is not customary found in single-family homes. The size of the equipment is not incidental nor is it accessory to the residential use. 3. The equipment is in fact, accessory to the business activity that the applicant is carrying on in his home. The storage of that equipment on the property is.not.permitted under Section 4-1.4 of the Zoning Ordinance that regulates Home Occupations. 4. The predominate use in this Residential C Zoning District is single-family dwellings. It is the only principal use permitted as-of-right. 5. "New England Barbecue/Southern Pride"is listed in the Business Listings of the Hyannis Area July 2001 phone book. The listing did not give a street address but did note Centerville. The phone.number given for that business was 508-775-1920. That phone number is the exact phone number listed on the Zoning Board Application submitted by the applicant on June 22,2001..The company is also listed under Restaurant Equipment and Supplies. Decision: Based on the findings of fact,.a motion was duly made and seconded to affirm and uphold in full the decision of the Building Commissioner as stated in his June 1,2001 cease and desist order issued to Mr.James M. Sanborn. The vote was as,follows:' 2 j AYE: Gail Nightingale,Richard L.Boy,Ralph Copeland,Jeremy Gilmore,Ron S.Jansson NAY: None Ordered: In Appeal 2001-105 the Board has upheld the decision of the Building Commissioner. Helen J. Kenny 245 White Oak Trail Centerville, MA k02632 f• : Tom Perry Building Commissioner Town of Barnstable 200 Main Street Hyannis,MA 02601 September 12,2002 Dear Commissioner Perry: ' As nearby neighbors to the residence of James Sanborn at 122 White Oak Trail, Centerville,we are again writing to register our protests regarding Mr. Sanborn's continuing violation of the Building Commissioner's ruling of June 01,2001 to cease and desist the storing, garaging, and keeping of commercial business equipment on his property. This decision was upheld by the Zoning Board of Appeals September 19,2001 in findings of fact that clearly set forth Mr. Sanborn's use of his residence as a staging area for his business as a representative of Southern Pride,a manufacturer of industrial/commercial woodburning BBQ Pits"and Smokers. It should be noted that the Appeal Board's decision was made without restrictions, indicating that the decision of the Building Commissioner was fully affirmed and upheld as stated in his June 1,2001 cease and desist order. No appeal of the Board's decision was filed within the 20 days pursuant to MGL Ch 40A,Section 17. 4 It is worth noting that complaints about commercial type barbeques and cookers parked in and around the Sanborn garages are long standing, dating back as far as March 1998. Now, more than a year later, we must act again in the face of Mr. Sanborn's continued violation of the zoning regulations in a Residential C Zoning district. Commercial equipment is apparently stored in a large structure that was put up without, as we understand it,a building permit. Mr. Sanborn is still in business with. Southern Pride with a local telephone listing under New England Barbecue/Southern Pride. A large smoker unit appears periodically and for several days or weeks at a time parked in front of the Sanborn house. An extremely large carnival type mobile restaurant appears for several days at a time, is moved, and then reappears. For months a white commercial van was parked to the right of the house throughout the .fall and the winter. At this writing the mobile restaurant has been there over the t weekend. For the Appeal Board and the magistrate hearing this case,we want it to be clearly understood our position is (1)that the September 19,2001 ruling of the Appeals r Board be fully upheld which states that no commercial equipment be stored on the Sanborn property(2) that we have not made and will not make any agreement with Mr. Sanborn for any modification of that decision,(3)that Mr. Sanborn's contention that a single smoker is maintained for his recreational use only is entirely without credibility. Clearly, he is conducting an individual business (not a franchise) as a representative of Southern Pride in Massachusetts and most of New England from his residence. His job as representative entails demonstrating models of these commercial cookers which are purchased through Southern Pride that handles billing and shipping. A representative's primary job is sales. Finally,we feel we have reached the limits of our frustration tolerance. Four years of living with this problem are more than enough. Thank you for communicating our concerns and positions to the Zoning Board of Appeals and the magistrate of the Barnstable District Court hearing this case. Di Matteo Building Inspector' s Office 367 Main Street Hyannis, MA 02601 Re: James M. Sanborn 122 White Oak Trail, Centerville Dear Mr. Di Matteo: . As a follow-up to our recent meeting at your office, and in light of the hearing on September 18 , 2001, my client is agreeable to the following conditions relative to his residence at 122 White Oak Trail in Centerville: ( 1) He shall remove all commercial barbeque equipment/smokers, with the exception .of the Southern Pride unit currently on a trailer. This unit shall be moved to the back yard and enclosed in a temporary garage-type structure not located within the rear or sideline setback appurtenant to the residential "C" District. (2 ) This single unit shall be for his personal use so that' no business activity is associated with it at the residential site. ( 3 ) Further, Mr. Sanborn agrees not to have barbeque "smokeouts" with his friends, whether or not they are entirely for private non-business purposes. (4 ) As he has done previously, Mr. Sanborn will not demonstrate his unit at his house or cook any food for eventual sale there. Peter F. Di Matteo - 2 - October 22, 2001 I believe this constitutes our discussion and agreement relative to the October 2, 2001 meeting at your office. If I have mis-stated anything, please contact me immediately so that this may be rectified. ei Sincerely, Mark H. Boudreau MHB:kb cc: James M. This decision was upheld by the Zoning Board of Appeals September 19,2001 in findings of fact that clearly set forth Mr. Sanborn's use of his residence as a staging area for his business as a representative of Southern Pride, a manufacturer of industrial/commercial woodburning BBQ Pits and Smokers. It should be noted that the Appeal Board's decision was made without restrictions, indicating that the decision of the Building Commissioner was fully affirmed and upheld as stated in ti his June 1,2001 cease.and desist order. No appeal of the Board's decision was filed within the 20 days pursuant to MGL Ch 40A, Section 17. It is worth noting that complaints about commercial type barbeques and cookers. parked in and around the Sanborn garages are long standing, dating back as far as March 1998. Now, more than a year later, we,must act again in the face of Mr. Sanborn's continued violation of the zoning regulations in a Residential C Zoning district. Commercial equipment is apparently stored in a large structure that was put up without, as we understand it,a building permit. Mr. Sanborn is still in business with Southern Pride with a local telephone listing under New England ' Barbecue/Southern Pride. A large smoker unit appears periodically and for several days or weeks at a time parked in front of the Sanborn house. An extremely large carnival type mobile restaurant appears for several days at a time, is moved, and then reappears. For months a white commercial van was parked to the right of the house throughout the fall and the winter. At this writing the mobile restaurant has been there over the weekend. For the Appeal Board and the magistrate hearing this case,we want it to be clearly understood our position is(1)that the September 19,2001 ruling of the Appeals K• v , Board be fully upheld which states that no commercial equipment be stored on the Sanborn property (2) that we have not made and will not make any agreement with Mr. Sanborn for any modification of that decision,(3)that Mr. Sanborn's contention that a single smoker is maintained for his recreational use only is entirely without credibility. Clearly,he is conducting an individual business(not a franchise) as a representative of Southern Pride in Massachusetts and most of New England from his residence. If we can be of further help in these proceedings, please get in touch with us.
