The above Lot is shown as Lot 13 on the plan prepared for James E. Murphy recorded on June 13 , 1984 in Plan Book 383 , Page 90 , a copy of which is enclosed. At the time of the recording of the plan, Lot 13 met all the dimensional requirements of the Barnstable Zoning Bylaw being located in a RD-1 zone . On February 28, 1985, the bylaw was amended rendering Lot 13 non-conforming as to area. At the time of the change to acre zoning in 1985, Lot 13 was held by the above owners in ownership separate from all adjoining lots . Enclosed are copies of the deed of Lot 14 recorded in Book 4307, Page 57 and a the deed of Lot 12 recorded in Book 4307, Page 54 both on November 2 , 1984 . As of the recording of said deeds the above owners, James E. Murphy, Sr. and Barbara L. Murphy retained ownership in said Lot 13 . In my opinion, under the provisions of Section 4-4 . 2 of the Barnstable Zoning Bylaw the area increase effected by the 1985 amendment did not apply and does not apply to said Lot 13 . MURPHY, SR. and BARBARA L. MURPHY, OWNERS Dear Mr. Crossen: This office has been asked by the Owners to render a buildability opinion for a single-family residence on the above- referenced Lot . The above Lot is shown as Lot 13 on the plan prepared for James E. Murphy recorded on June 13 , 1984 in Plan Book 383 , Page 90, a copy of which is enclosed. At the time of the recording of the plan, Lot 13 met all the dimensional requirements of the Barnstable Zoning Bylaw being located in a RD-1 zone . On February 28, 1985, the bylaw was amended rendering Lot 13 non-conforming as to area. At the time of the change to acre zoning in 1985, Lot 13 was held by the above owners in ownership separate from all adjoining lots . Enclosed are copies of the deed of Lot 14 recorded in Book 4307, Page 57 and a the deed of Lot 12 recorded in Book 4307, Page 54 both on November 2 , 1984 . As of the recording of said deeds the above owners, James E. Murphy, Sr. and Barbara L. Murphy retained ownership in said Lot 13 . In my opinion, under the provisions of Section 4-4 . 2 of the Barnstable Zoning Bylaw the area increase effected by the 1985 amendment did not apply and does not apply to said Lot 13 .
