The applicants purchased the property in August 2014. The existing buildings are nonconforming in that the lot contains two separate dwellings, where only one dwelling is permitted in the RD-1 Zoning District: The principal dwelling is nonconforming in that its setback is 39.8 feet from a Great Pond where 50 feet is required. All other bulk regulations are conforming. Procedural & Hearing Summary Special Permit Application No. 2017-072 to allow the demolition and construction of a single family dwelling was filed at the Town Clerk's. office and the office of the Zoning Board of Appeals on November 17, 2017. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on January 24, 2018 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Alex Rodolakis, David Hirsch, Herbert Bodensiek, Paul Pinard and Jacob Dewey. Attorney's Michael Ford and Jeffrey Ford represented the Applicants before the Board. Also present were the applicants John and Mary Lombardo, Rich Tabaczynski from Atlantic Design Engineers, and John Ingwersen from Architectural Design Incorporated. Attorney Michael Ford reviewed the project and noted through his research that the property was developed prior to zoning. The proposed project consists of demolishing the existing 3 bedroom dwelling and constructing a new 3 bedroom dwelling with 2 stories. The footprints are essentially the same. The Conservation Commission has issued an Order of Conditions. The only relief requested is concerning the setback from a Great Pond. Attorney Ford noted that many of the dwellings in the area have been reconstructed. The Board questioned the height to the peak and it is 28 feet. The Board Chair requested public comment and no one spoke. Findings of Fact At the hearing on January 24, 2018, the Board unanimously made the following findings of fact in Special Permit Application No. 2017-072, a request to allow the demolition of the existing dwelling and construction of a new dwelling: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-92 allows for the expansion or alteration of a preexisting nonconforming structure used as a single-family residence with a Special Permit. 2. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 3. The proposed expansion of the dwelling will not be substantially more detrimental to the neighborhood than the existing building or structure. The Board based this finding on the fact that other structures in the neighborhood are closer to the Great Pond. The vote to accept the findings was: AYE: Alex Rodolakis, David Hirsch, Herbert Bodensiek, Paul Pinard and Jacob Dewey _NAY: None Decision 1. Special Permit No. 2017-072 is granted to John and Mary Lombardo, to allow for the demolition of the existing principal dwelling and construction of a new principal dwelling with a 40 foot setback from a Great Pond where 50 feet is required.
