The current exemption for"homeowners"was extended t\pDos
de owner-occupied dwellings of six units or less and to allow
homeowners to engage an individual for.hire who does noess a license,provided that the owner acts as supervisor.
DEFINITION OF HOMEOWNER F°
Person(s)who owns a parcel of land on which he/she resides or in ends to reside,on which there is'; or is intended to be,a one or two-
family dwelling, attached or detached structures accessory to such u eand/or farm structures. A person who constructs more than one
home in a two-year period shall not be considered a homeowner. Suc "homeowner"shall submit to the Building Official on a form

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for whichla building permit is required shall be exempt from the provisions of this section(Section
109.1.1 -Licensing of construction Supervisors),provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as
supervisor."
Many homeowners who use this'exemption are unaware that they/are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for
i unlicensed persons.

Background:
The property that is the subject of this appeal is a 0.57 acre lot located at the end of Willow Run Drive,
Centerville, MA. The lot borders 94 feet on Lake Wequaquet and is in close proximity to Lily Pond. It is
a developed lot consisting of two principal structures, each used as a single family dwelling.
• The first structure is a one story two bedroom, one and a half bathroom, 2,044 sq.ft. dwelling built in
1964.
• The second structure is a one story, one room structure containing a half bath, 1,104 sq.ft., also built
in 1964, and according to the Assessor's Record has no basement and no heat but is classify as a
single family dwelling.
Relief Requested:
Appeal Number 1997-52
Appeal for a Use Variance to Section 3-1.1(1)(A), Principal Permitted Use, Single Family Residence, and
Section 2-3.6 Number of Buildings Allowed Per Lot to allow for an existing second dwelling on the lot.
Appeal Number 1997-53
Appeal for a Variance to Section 3-1.1(5), Bulk Regulations, Lot Width and Front Yard Setback to allow a
reduction of front yard setback to permit a proposed two story 24 by 24 foot accessory building (garage
and second floor with deck)to be constructed located 10 feet from the front property line rather than the
required 30 feet and on a lot with insufficient width.
In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that
justify the granting of the relief being sought.

History:
The lot was apparently created from the division of land approved by the Planning Board on January 25,
1965 as an Approval Not Required (ANR) plan. That plan created Lot 1 and the subject Lot 2. Lot 2 in
this plan was 0.79 acres (34,500 sq.ft.) in size.
In 1965, the lot was zoned RD-1 and required 20,000 sq.ft. of area and a lot width of 125 feet. Permitted
use was limited to one single family dwelling per lot and permitted accessory uses.
In 1966 the structures on Lot No. 2 were built.
The 1967 Tax information supplied by the appliant cites two structure on the subject lot, one being a
Dwelling and the second a garage.
The Assessors Field Cards which were completed and dated January 19, 1972 cites that the lot is
developed,with two buildings, a single family dwelling and a cottage. A note on one of the field cants
does cites"Two Dwigs"- [Two dwellings?]. The cards also reveals that the single family dwelling has
one bathroom and that the cottage structure had a Shower Bath and a sink.
On April 7, 1975, a second Approval Not Required Plan was signed by the Planning Board which took
2,358 sq.ft., of lot area from the lot in question (Lot No. 2) and transferred the area to the neighboring
Lot No. 1 reducing the area of the subject lot from 0.79 acres to it present size of 0.57 acres. This
division also caused the lot wide to be reduced from the required minimum wide of 125 to 117 feet.
In 1975,the area was zoned RD-1 and required 20,000 sq.ft. of area and a lot width of 125 feet.
Permitted use was limited to one single family dwelling per lot and permitted accessory uses.
The present owner purchased to property in March of 1984.
Staff Review and Comments:
j The applicant should be prepared to present a more detailed history of development of the lot, especially
citing question that seem to be outstanding.
• Are there kitchen facilities in the cottage? If so, when was the kitchen installed?
• Was compensation paid to the owner of the lot for transferring of the land in 1975? How much?
Would this voluntary transfer of land has constituted a self-imposed hardship?
• When did the rental situation began of the property? Are they year round or seasonal?
• What is the proposed use of the second floor over the garage?
• Was there ever a mortgage on the property and if so, did any attorney or bank review the locus being
purchase from a zoning conformance standpoint?
Wastewater Disposal:
The on-site septic disposal system is a mounded system which is not permitted except by variance from
the Board of Health. The fact that the lot required a mounded septic system is an indication that the lot
in question has problems meeting the requirements of Title V and that the use of the land and intensity of
development may be exceed the conditions of the lot to support the uses and level of development given
the location, soil and groundwater.
The area around Wequaquet Lake has been identified by the Health Division as one area of the Critical
Areas of Concern for On-site Wastewater Disposal Systems. Over crowding (density of people), nature
of the soils and a high groundwater table,the amount of run-off in to the lake (over development-
buildings and pavement) and the lack of public sewers in the area have lead to the eutrification of Lake
Wequaquet Lake

Use vs. Structure:
An illegal use of the property under zoning never received a legal non-conforming status over time-An
illegal use is never grandfathered. An illegally built structure, (built without all permits) can not be
compelled to be removed after 10 years (MGL Section 7) however the illegal use can be
compelled to be removed or ceased. No building permits were found for the original construction.
The 1975 ANR Plan documents that the structure were on site and have existed for more that 10 years.
Staff would suggest that the extent of relief being sought (a use variance) coupled with proposed relief to
further expand the use and building on the lot should be scrutinized carefully. This is a very sensitive
area and care should be taken in not over development on critical environment.
Staff Recommendation:
Given the existing structure on the lot, staff would recommend that the Board should find that the
structure on the site have existed for more than 10 years and perhaps make a motion to grant a Variance
to Section 3-1.1(5), Bulk Regulations, Lot Width only(as partly requested in Appeal Number 1997-53)
for the existing structures to be reduced to 117 feet with the following conditions:
1. Use of the property shall conform to all requirements of the RD-1 Residential D-1 Zoning District.
2. There shall be no further expansion of the structures on the lot in footprint nor in gross square
footage of the structures without prior permission of the Board.
3. All development on the lot shall conform to all requirements of the Building, Health and Conservation
Division and all fire department regulations.
4. There shall be no addition of paved surfaces on the lot without approval of the Board.
Staff would also suggest that the Board consider the following order:
The relief granted and all conditions of it, must be exercised within one year of the granting of the
variance to be considered executed as required by both MGL Chapter 40A and the Barnstable Zoning
Ordinance. The applicant is reminded that today most banks and mortgage companies require some
form of an appraisal of a property's conformance to zoning to be mortgaged and/or insured. Without this
relief being fully executed, the applicant may be positioning the property at risk of not being able to
secure an independent review for conformance to zoning.

Dear Board Members:
Attached please find a Request for Variances filed on behalf of
Richard Haddad, owner of land at 87 Willow Run Drive, Centerville,
MA (;_Map 210, Lot 57) . Two of the variances request relief to
validate non-conformities (as to the number of dwelling units and
the 'Width of the lot) running respectively from ±1972 and 1975.
The third variance would allow construction of a two car garage,
predominantly within the front yard setback. Constraints imposed
on the site by abutting wetlands, the burden of an access easement
to the abutting westerly lot, and a mounded Title V septic system
constructed ±10 years ago leave the extreme southerly end of the
lot as the only available area for garage construction.
A history of site development and documentation to support the
requested relief are provided as part of the application. Also
provided for your files is a copy of the Notice of Intent as filed
with the Barnstable Conservation Commission. Please don't hesitate
