Background: The property that is the subject of this appeal is a 0.34 acre lot addressed as 40 Windlass Lane, Centerville. The lot is currently vacant. The lot was created by Subdivision.No. 156"Knotty Village" in. 1970. At that time, the RC district required 1500 sq.ft. of lot area and 20 feet of frontage for a buildable lot. In 1985, the RC District regulation was changed to require a lot area of 1 acre. Today the lot conforms to all bulk requirements except Minimum Lot Area for which the applicant has requested a Variance. Madeline O. Zielinski is owner of an adjacent Parcel No. 064 (72 Rolling Hitch Road). According to the Assessors records, that lot was developed in 1971 with a.2,784 sq.ft. single-family dwelling. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on September 18, 1997. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 05, 1997, at which time the Board found to allow the appeal to be withdrawn as no relief is necessary. Board Members hearing this appeal were Ron Jansson, Gene Burman, Gail Nightingale, and Chairman Emmett Glynn. Attorney Michael Hayes represented the applicants. Hearing Summary: Attorney Hayes explained that the lot is owned '/2 by the Estate of Karol Zielinski and by the Madeline Zielinski Trust. The lot in issue is a vacant lot behind the house. The property was subdivided in 1970 and the lots.at that time conformed to zoning. This is the only lot in the immediate area without a house on it. The Zielinskis.bought the house in 1971, and the adjacent vacant lot was bought in 1972. The deeds for both lots read to Karol B. and Madeline Zielinski, as tenants in common. In 1985, there was a zoning change but no changes were made to the titles so Mr. & Mrs. Zielinski held both lots as tenants in common. In 1987, Karol Zielinski deeded '/2 interest to Madeline Zielinski so in 1987, she had the full interest to the house property. The changes were not made for zoning protection but rather for estate planning purposes. In 1992, Madeline Zielinski deeded her interest in the vacant lot to her Trust and she also deeded the house to her Trust. As of today, the house is owned by the Madeline Zielinski Trust.
