Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire, express or implied, oral or written." MGL chapter 152, §25C(6) also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required." Additionally,MGL chapter 152, §25C(7) states "Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." During the winter of '77-*78 the property was hit by a severe storm which washed out a portion of the beach on which the seawall rests.This breach threatened to break up the wall near where the beach house rests upon it. Nothing was done to repair the situation until spring,when the condition showed signs of steady worsening.At that time I did not have professional advice and therefore took emergency action to save the wall by causing sand to backfill the area of the washout.That action took the form of rearrang ing scattered stones from two dysfunctional existing piles.The effort took many hours in ice-cold springtime water.The placement and size of this temporary fix has not changed in any way since the spring of 1978. The result of my emergency effort is not permanent and will be removed to be used as core material in groins that will provide a permanent solu tion.I applied for a disaster loan to help repair the damage.The disas ter office inspector approved a loan in early 1978.With the wall regain ing its footing and the loan approved, I then searched for a consultant who specializes in coastal zone work.After a lengthy search,I retained the professional services of Mr.Athanasios A.Vulgaropulos of Waltham. Aplan (also showing the emergency fix) suggesting groin alternatives originating from the end of the existing seawall was hand carried in August of 1978 to the other property owners who share the narrow parcel at the east end of the wall.This plan was intended to serve as a basis for discussion and alternative suggestions,with the primary objective of reaching a con sensus of how to save the wall by reestablishing the sand depths in front of it that existed when the seven small original groins were kept in repair. The .September 12,1978 letter from Mr,Pickering was the only feedback we have received and was used as the basis of decision making during the fall of 1978.My letter in reply of September,1978 suggested ways that the objectives of the project would be modified to address Mr.Reardon,Mr._ Birmingham and Mr.Pickering's concerns in a positive manner with solutions that would provide only benefit to the easterly abutters. Fall and winter of 'TS-'TQ was spent discussing alternatives with Mr. Vulgaropulos and with various Corps of Engineers district and divisional engineers throughout the country,which I call on during the course of my professional travels as a Government Sales Manager for Daystar Corporation, a solar energy equipment manufacturer and a division of Exxon Enterprises. The result of all these efforts was forwarded to my neighbors for their consideration in my letter of March 6,1979. During the winter of '78-*79 other storms damaged the property,carry ing off some porch rails and putting the emergency fix to a severe test. The footings of the wall held tight,confirming Mr.Vulgaropulos*professional opinion and ii\y own observations regarding the nature of the forces at work on this stretch of wall. Raising the sand level to shield the wall would provide full-time access for town residents who walk the beach to fish or dig shellfish,with out the constant trespassing that now takes place through my property when the tide is high.Attempts to secure the area have been met by vandalism of our driveway gate and a permanent solution rests only in reestablishing an unbroken beach line past the property at high tide. The beach house itself should be floodproofed.Investing in a major coastal rehabilitation is unwise if the structure is destined to be severely damaged when the next hurricane passes.We decided to incorporate flood- proofing into the project proposal this winter and included it in the March 6 proposals.On May 3,1979 I received a response from Mr.Reardon which objected to the floodproofing portion only.Mr.Reardon believes that changing the foundation and chimney heights of our beach house will violate Paragraph 4.1a of recessions of certain deed provisions which he had drawn up as a condition to the purchase of his lot from Mr.Herb Pheeney.The plans for floodproofing are now/being finished by Mr.Vulgaropulos and will include deck construction to maintain access to the three doors,served by two stairways.Foundation and chimney work are specifically excluded from restrictions in the deed and only the provision for access are subject to the section 4.If approvals. That section also states that "Such approvals as are required hereunder shall not be unreasonably withheld."Mr.Reardon kindly paid a visit to iny property on Sunday,June 3,1979 and at that time he expressed his opposition to the proposed 70' stone groin shown on the study scheme "B"in my.letter of March 6th,which alternative,my wife and I prefer more than scheme "A".Mr.Reardon feels that our placement of sand as prescribed in the proposal to fill the groins would not have the bene ficial effect shown on the parcel behind the groin,which he shares with the Birminghams and the Pickerings. I offered to have Mr.Vulgaropulos meet with him and go over the engineering considerations which produced the contour shown on the plan;that proposal was left open.Mr.Reardon restated his opposition to the floodproofing and asked for drawings on the proposal as soon as they are ready.We discussed another matter and there has not yet been any further contact since that time.Mr.Vulgaropulos and I expected that feedback would come from the Pickerings and the Birminghams when all arrived for the season. Your letter arrived today,one day after a letter from the Building Inspector and I should expect,that other actions can be expected in an effort by the complaining party to destroy n\y credibility with all offi cials that will review the proposal on which we have worked so hard.We hope your Conmission will find our final proposal a positive solution to 15 years of deterioration and neglect suffered by the property and the coastal beauty. With the above comments as background I hope the Commission can understand my periodic presence on the beach to maintain the integrity of my emergency,temporary fix.The fieldstones are regularly tossed about by the waves due to their very light weight and must be maintained to pro tect the wall footings throughout the pisriod necessary to reach a final solution. I will contact Mr.Vulgaropiilos and have him bring you up to date on the status of the proposal we are preparing to present for the Commission. The captain of the motor yacht regularly resided in the beach house for the entire summer season after which,when the Riley's returned to Brookline,his quarters were then taken up in an apartment above the large garage/carriage house adjacent to the main Riley home.Those same quarters in the garage were occupied during the summer season by the family chauffeur and upon arrival in the spring the captain moved to the beach house leaving the garage apartment for the chauffeur, The beach house is now as it existed.It consists of a large front room opening out onto a porch which extends out over the beach,supported by two concrete and steel columns.During the period when the permanent pier was in place there was a gangway from a ramp and gateway to the right side of the beach house which allowed access from the yard directly onto the dockway without the requirement of access to the beach house or to its porch.During the early years ,of use the rear of the beach house was provided with a bathroom with running water and a cesspool sewerage disposal system,all of which remain today as they existed.The capacity of this septic system was provided with the following use patterns for the beach house.The large front room was provided with sufficient space to entertain a great number of guests.The Riley's regularly entertained their friends in this large room for meals and entertainment as it provided an excellent view of Cotuit Bay and enjoyed the cooling effects of a shore breeze.In the rear portion of the beach house five separate changing rooms were provided so that it would be a regular convenience to entertain five separate unrelated groups of people at one time plus members of the immediate Riley family. The captain's quarters consisted of a large folding cabinet bed,an ice chest,several food storage cabinets and a kitchen preparation area which included a sink which drained to a container so that food wastes might be deposited on the garden compost heap.The building was equipped with kerosene lamps and a kerosene cooking stove as well as a large field stone fireplace for early spring and late fall warmth.The windows at the rear of the building were equipped with pull-down shades for night time privacy and a dividing set of folding doors separated the front entertainment room from the rear living quarters and changing rooms,The provision was made for hot water in the bathroom and kitchen,provided by machinery which has since been removed from the building, During the years after the passing of Mabel L.Riley's parents the beach house continued to be used in the previously described manner but with a much reduced social schedule.After a number of years Ms,Riley lost the services of her chauffeur and as a result the boat captain took on the additional position of family chauffeur.The maintenance of a large size yacht under these circumstances became difficult and therefore the Riley motor yacht was reduced in size considerably and the permanent dock eventually became a seasonal one as Ms.Riley's health and frequency of visits to Cotuit both declined.The chauffeur/boat captain continued to use the beach house as a dwelling during the hot summer months while retiring to the garage apartment during other portions of the season. After Mabel Riley's death the beach house was cleaned out and fell into disuse while continuing to receive the required maintenance.After the trustees settled the estate and the servants departed,a developer purchased the property and established a large number of subdivision lots. During that period until this past spring of 1978 the building fell into disrepair and the landscaping waterfront area and the lower pond received no attention whatsoever. February 13 l!)..L ilio 13oni\l of Appeals found ^he is"titioner,Margaux Reg.lty Trust,seeks a Special Permit under Section 0, wetl-ind:j,of the Bamstable Zoning By-Law as revised August 24,1973*"to construct a timber pier,ramp and floats and mooring piles in Cotuit Bay at Cross Street,Cotuit Bay,Cotuit in an RF Zoning District. Rngineer Charles Savery represented the Petitioner and staged that the Petitioner had purchased one of the six lots into which the Riley estate had been si.ihdi\n.ded and that this lot nnntained the boathouse;that the Petitioner has a 30 foot motor sailer v-hdch draws 4 feet of water;that there was a 1898 pier permit which may or may not be valid and the validity will be determined by the Division of Waterways;that this 1898 permit called for a pier 232 feet,long but the® Petitioner only wants to build a pier 163 feet in length with three mooring piles on either side of the fixed portion of the pier,one side to be used only for storm conditions;tliat there are many other private piers in this area and that this is a normal use in a residential zone and that it would be private and there will be no filling. Those opposed stated that the channel into which this pier would go is only 405 feet wide and that this pier would be a hazard to navigation and that there is no house on this lot to which tliis could be an accessory use and that the eventual use of the pier is in question as it seems overlarge for a one family private pier. The Board found that there is no dwellin/^on this lot to which this pier would be an accessory use and,therefore,the Board did not have the power to grant this Special Pemnit as this would be a violation of the Bamstable Zoning By—Law. The Board further found that this pier would be a hazard to navigation and therefore detrimental to the area.Therefore,the Board voted unanimously to deny this petition for Special Permit. DaLuz Building Inspector Town of Barnstable Town Office Building Hyannis,MA 02601 Dear Mr.DaLuz: With regard to your letter of June 1st Inquiring as to the status of the house at 100 Cross Street In Cotult,there are currently no renovations In progress and the only renovation carried out In the past has been to renew a limited footage of the supporting sill rest ing on the foundation which was accomplished last summer under a permit Issued from your office.Several maintenance projects have been undertaken this spring which Involved replacing of some rotted floorboards on a small foot bridge and some temporary 2x4 railings which have replaced sections of a porch railing carried away by winter storms.We did change the angle of the north end railing of the porch to allow us quick access to the top of the seawall as a safety measure to allow us to respond more quickly to any potential swimming emergency. An additional maintenance project planned Involves placing grout In the eroded portions of the seawall face,as time and tide permits during the summer. The existing porch structure Is scheduled for permanent demolition as part of a comprehension flood-proofing project now being prepared by my consulting engineer.That particular project Involves raising the structure In Its existing position approximately seven to eight feet In the air to conform with the 100 year flood elevation and to provide access to the existing doorway via stairways and deck substitutes for the existing porches,both front and rear.The proposed project will Involve only modifications In the foundations and the fireplace chimney. You may proceed to fill in the test hole excavation at the edge of the pond on the site without a filing under the Wetlands Restriction Statutes. The rest of the work you propose,including but not limited to repair of groins and seawall,fill behind seawall,modifications to exist ing stairs to the beach,construction of decks and railings, construction of septic system,and beach nourishment may not be undertaken without a full filing under both M.G.L.Ch 131 sec 40 and article 28 of the Town By-laws.
