Pretrial conference scheduled for May 18. According to police reports,an officer pulled Villa over for speeding and
noticed a ripped corner of a plastic bag,a piece of cotton wadding and an amber pill vial with the label scratched off
inside Villa's car. A search of Villa turned up a$2o bag of heroin inside his left sock. After his arrest,the police report
said Villa handed over another$2o bag of heroin he had concealed in his shorts.

The case against the men began when a mailed package was found by the state police and U.S.Postal Service
inspectors in South Boston recently,according to the state police.A Boston police drug detection dog confirmed z

The package was delivered under surveillance to Villa,a spokesman with the Cape and Islands Narcotics division C �of the state police said yesterday.

under any agreement for sale of the PROPERTY,the BROKER shall be due one-half(1/2)of the amount so retained,but not more than
an amount equal to the full commission that would have been paid to BROKER if a sale had been completed.
5. Broker Cooperation. BROKER ereby advises SELLER that BROKER will offer compen ion to cooperating real estate licensees as
follows: buyer's agents %of the selling price; facilitators(non-agents) %of the selling price. If subagency
will be offered,Consent To Subagency form must be signed.
6. Br Mt its. BROKER agrees to use reasonable efforts in marketing the PROPERTY and agrees to list the PROPERTY with
th _ multiple listing service. The BROKER shall have no obligation to continue to market the
PROPERTY af(er an offer has been accepted and shall have no obligation to present any offer once an offer has been accepted and
while a transaction is pending. The BROKER is not hired as a property inspector, tax advisor or attorney and if such services are

7. Consent To Dual Agency.The SELLER understands that BROKER also represents buyers and that if BROKER introduces a buyer-client to
the PROPERTY a"dual agency"will be created.The BROKER may act as a dual agent who represents both prospective buyer and seller
with their informed written consent. A dual agent is authorized to assist the buyer and seller in a transaction, but shall be neutral with
regard to any conflicting interest of the buyer and seller. Consequently, a.dual agent will not have the ability to satisfy fully the duties
of loyalty, full disclosure,reasonable care and obedience to lawful instructions,but shall still owe the duty of confidentiality of material
information and the duty to account for funds. SELLER understands that material information received from either client that is
confidential may not be disclosed by a dual agent, except: (1)if disclosure is expressly authorized;(2)if such disclosure is required by
law; (3) if such disclosure is intended to prevent illegal conduct; or (4) if such disclosure is necessary to prosecute a claim against a
person represented or to defend a claim against the broker or salesperson. This duty of confidentiality shall continue after termination
of the brokerage relationship. By signing this agreement, SELLER authorizes BROKER to.act as a dual agent and consents to. .

DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building'Official,that he/she shall be
reMonsible for all such work performed under the building permit. (Section 109,l.l)

applicable codes,bylaws,.rules and regulations.

HOMEOWNER'S EXEMPTION
The Code states that:."Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a persons)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons.In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a form/certification for use in your community.

A recent review of our records,including the permitting history and the Zoning Board of Appeals records,
indicates that the present use of your property located at 52 Curlew Way is limited to that of a single-family
home;any other use is illegal.
You should know that I visited this site on March.1,2006 and found there to be a complete independent
living unit in the basement. Our files show this work was completed without the benefit of permits and
proper inspections. Because you did not obtain the necessary zoning relief you must now take immediate
action to restore the property to a single-family home.
Normally,we would offer you the opportunity to apply for the Amnesty program but because I am informed
that this property is not owner-occupied you are not eligible for consideration. Our records show that you
also*currently have a valid affordable-accessory unit in the residence at 8 Curlew Way. At this juncture,
you have no alternative but to completely comply with the restoration order for 52 Curlew Way. A
building permit is required in order to reconfigure the subject space to its original use and all work,
including the removal of the downstairs kitchen and bedroom shall be completed by April 14,2006.
You should be aware that you have the right to appeal this decision. If you choose to explore this option we
will be happy to discuss this matter with you but be assured that your failure to file for the appropriate
zoning relief with the Board of Appeals or otherwise comply with this notice will result in a$200.00 fine

Received a telephone call from Pam at HAC regarding Terry Villa. She is a tenant in a
house owned by her soon-to-be ex in-laws. Pam stated that Terry Villa pays the
Mortgage but the in-laws own the house. Ms Villa is currently going through a divorce.
Subsequently, I spoke directly to MS Villa. She claims there is an illegal apartment in the
basement of this house. She added that her future ex in-laws also have an illegal
apartment in their residence at 8 Curlew. (Later, I confirmed that this is a bona fide
Amnesty unit.)
It is my understanding from others that Ms Villa has been calling to complain to
everybody about her in-laws making her actual motive suspect. It's logic to assume if Ms
Villa was paying a mortgage payment to her in-laws and now she is divorcing their son,
this may very well be a property dispute. However, that's not to say that there is not
really an illegal apartment in# 52. With this in mind, I set up an appointment to see the
house on Wednesday morning 3/l/06.

Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from toe"law", an employee is defined as every person in the service of another under any contract
of hire, express or implied, oral or written.
An employer is defined as an individual, partnership, association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or
individual,Partnership,artnershi , association

dwelling house having not more than three apartments and who resides therein;'or the occupant of the dwelling house of
another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or

MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal
of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neitherthe'
commonwealth nor any of its political subdivisions shall enter into any contract for the perfonnance of public work until
acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting
authority.

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or
less and to allow homeowners to engage an individual for hire who does not possess a license,provided that
the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is
intended to be, a one or two-family dwelling,attached or detached structures accessory to such use and/or
farm structures. A person who constructs more than one home in a two-year period shall not be considered
a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15).This lack of awareness often.results in
serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the
unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit
application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a
form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community.

This office represents Mr. &Mrs. Albino J. Villa, who is seeking a building permit for the
above referenced property on Curlew Way in Cotuit. At Mr. Villa's request we have researched
contiguous ownership issues.relating to this lot. The subdivision known as "Sandalwood at
Santuit" was created in September of 1965 by Everett B. Jackson and Bernice D. Jackson. ,An
approved subdivision plan was recorded January 28, 1966 in Plan Book 199 Page 81.
The title history of our locus and the lots on either side of it, Lot 9 and Lot 11, is as follows:
On July 10, 1970, Cotuit Realty Associates, Inc., a Massachusetts corporation, deeded lots 1 - 12
(and others) to James H. Smith by deed recorded in Book 1478 Page 155.
Lot 11 was deeded to Joseph M. Saegh by deed recorded in Book 1478 Page 166 and dated
July 10, 1970. Joseph M. Saegh conveyed Lot 11 to F. Huntoon, Inc. February 15, 1985
recorded in Book 4419 Page 320 as Huntoon, Inc. deeds to Nancy R. Porter November 1, 1985
in Book 4784 Page 9.
Lots 9 and 10 were deeded to Purdy Foshay and Marguerite N. Foshay in Book 1478 Page
164 by deed dated July 10, 1970.
Lot 9 was deeded by Purdy Foshay and Marguerite Foshay to Barry D. Souza and Barbara
