An issue has arisen with respect to the rights of Mr. Rhude to obtain access to his property.over various private ways running from his property to Brittany Drive and then over Brittany Drive to the Santuit-Newtown Road.. I have conducted title research into this matter and in the following paragraphs I will set forth my opinion as to.the rights appurtenant.to the Rhude property in Brittany Drive: In the first place, I have obtained a sketch showing the location and layout'of various properties running from the Rhude property, labeled as."locus" over ancient roadways to Brittany Drive and then to the Santuit-Newtown Road (Exhibit "A"). The subject property owned by Mr. Rhude is part of a parcel of property described on a deed of David Crocker to Benjamin P. Winslow dated December 5, 1870, and recorded with the Barnstable County Registry of Deeds.in Book 103, Page 296. I have enclosed a copy of that deed and the plans attached thereto with this correspondence (Exhibit"B"). As you will note, the parcel was conveyed with a "Right of way 15 ft. wide from the S westerly corner of the said premises to the County Road through land of said D. .Crocker". In reviewing the sketch plans that were recorded as part of that deed as well as the plan recorded in Plan Book 35, Page 125, it is clear that David Crocker owned the land to the west of the property and that plan shows both a public Cartway and a Cartway running through the Crocker land to the County Road. The property owned by Mr. Rhude is shown as Lot 2 on Land Court Plan.No. 38714 (Exhibit. "C") prepared back in 1974 and that plan shows a number of cart paths around and through his property including one running southerly and another westerly around the cranberry bog. The cranberry bog property was sold by Mr. Rhude's predecessor in title, Elizabeth S. Curtis to the Middletown Cranberry Company, Inc. by deed dated June 17, 1965, recorded in Book 1302, Page 007. I have enclosed a copy of that deed for your reference (Exhibit `.`D"). As you will note, that property was conveyed together with a right of way over land of Elizabeth Curtis from the existing town road to the property to be used in common with Elizabeth Curtis and all those lawfully entitled thereto. That particular property was later shown on Land Court Plan No. 33877A and in the Decree of the Land Court registered as i Certificate.of Title No. 39186', both of which are enclosed (Exhibit "E"). As you will note, that.Decree clearly stated that so much of the land that was registered as lies within the,limits`of the Wood Road,the ancient town road, the vehicle tracks.and the:.way.was,subject to the rights of all: of those lawfully entitled thereto and over the same. Accordingly, the Rhude property continued.to have the right to use the ancient ways and cart paths over the registered,property,to the south: Also enclosed with this correspondence are copies of plans recorded in Plan Book 71, Page 91, and'Plan Book 247,:Page 50, which shows the parcel aocated to the south of the afore.mentioned Land . Court parcel over.which this Right of Way runs. As you will note,both of those plans.delineate the right of way and the plan in Plan Book 247 Page. 50 (Exhibits "IF" and "G"), for the first time shows a roadway labeled Brittany Drive located in the approximate location of the previous right of way running from this parcel to the County Road. Subsequently the plans recorded in Plan Book 226, Page 39 and Plan Book 250, Page 61 (Exhibits "H" and "I".), the location of Brittany Drive was relocated to run in a more northwesterly direction rather than a southwesterly direction but still running to Santuit-Newtown. Road. Based upon all of the foregoing record title information it is my opinion that the Rhude property continues to enjoy rights over Brittany Drive and the various private ways and Cartways running from the.house to the Santuit-Newtown Road. I believe it was for this reason that when the Planning Board approved the Brittany Drive Subdivision shown in Plan Book 563, Page 100, one.of the requirements was that a right of way over the pavement was to be granted to the owners to the southeast. It is important to note that Brittany Drive after it leaves the subdivision area continues in a southeasterly: direction before turning in a northeasterly direction running to the Rhude property. The requirement to keep this right of way open I believe, was predicated upon clear record title evidence and the Town has. no right to authorize Mr. Raspanti or anyone.else to close off Brittany Drive and prevent Mr.Rhude and others from accessing the same. Such any action constitutes a.violation of the terms of the Planning Board Subdivision Approval and should immediately be terminated. That the cul-de-sac and the paved portion of Brittany Drive be terminated.at least 10- 'J 15 feet short of the east property line and that the cul-de-sac be moved northwesterly a somewhat from it's present location, out of the area of severe slope.. Right of way over the pavement be granted to the owners to the southeast. s DEFINITIVE PLAN APPLICATION A public hearing was held May 22, 2000 on the above referenced Definitive Plan application. r Attorney Joseph Maruca,and Land.Surveyor Steve Doyle were present to represent the I applicant. Attorney. Maruca submitted a revised plan to the Board that addressed technical design issues raised in staff memos of the Planning Department dated May 18, 2000 and the .Engineering Division of DPW dated May .16, 2000. The subdivision entrance was re-drawn to comply with the minimum center line radius of 150 feet. i 1� 4 6 i ; `7 j?i I F, � 7 1 'ct i' #F 9 r' Corner rounding was achieved by an,easement over the lot 9. The cul-de-sac was, widened to 90 feet, three catch basins will be provided instead of two,, utility poles' locations were moved and the applicant will provide Form S, for Raspante.Way and the drainage re-calculated': The Board received testimony regarding drainage from the public regarding the condition of. Brittany Drive, outside the subdivision. The Board determined that a drainage problem is located on Westbury Way, a.side street. The applicant will.be installing new drainage systems at the entrance.to the subdivision, and the.Board also required the applicant to re-pave an additional 90 feet, which is necessary because of the deteriorated condition at the end of the existing paved surface of Brittany Road. The Board also required that.paving at the, end of Brittany Drive be extended to 'the property of the adjoining abutter to the east, to provide for a'potential road connection to developable lands., The cul-de-sac was located away from the area of steep slope. Both of these conditions were requirements of the Preliminary Plan approval. Attorney Maruca provided the Board with a list of waivers required from the Subdivision Rules and Regulations: Based upon the testimony received at the Planning Board hearing and upon testimony received at the public hearing,, and town staff reports,. the Planning Board voted unanimously to approve subdivision #779, Raspante Estates, subject to the following conditions of approval: 1. Subject to all the requirements of the Subdivision Rules and Regulations, including underground utilities. 2. Subject to all the recommendations of the Board of Health in their letter dated July 10, 20.00. 3. Submission of security prior to endorsement of the Subdivision Plan by the Planning Board. Any security other than a standard covenant shall be subject to the Planning Board's approval. 4. Taxes shall be paid and subdivision inspection fees shall be submitted prior to endorsement of the.Subdivision Plan ($2,640). 5. Submission of the Inclusionary, Affordable Housing Fee prior to endorsement of the, Definitive Plan. ($500 X 8 additional lots = $4,000) 6. Entering into a Development Agreement with the Planning Board and recordation of the Development Agreement including covenant, at the Registry of Deeds, with the Definitive Plan.. Recorded documents shall be returned to the Planning Board within 30 days of the Board's endorsement of approval, or the decision shall.be null and void. The applicant should submit a returnable, $1,000 recordation fee to ensure compliance with this requirement. And to rant the following waivers of the Subdivision Rules and Regulations- g . 9 g 1. Section 4-2.2 Width, Alignment and Grades of Street, paragraph 1 and the Design Standards of the Appendix, to permit the ROW to be 40 feet wide instead of the required 50 feet. The existing ROW of Brittany;Drive is 40 feet. 2. The Board granted five years based on the.fact that this subdivision is being created primarily to provide lots for family members of.the owner/applicant. 4. MARISCAL, of Hyannis, MA do hereby on oath aver and say as follows: (1) I am the owner of land shown on Barnstable Assessor's Map 42, Parcel 5. (2) I purchased this land by deed dated December 19, 1986. At that time,the property consisted of a residential dwelling, a garage and two additional outbuildings. (3) The house on the subject property had been occupied as a residential dwelling until just before I purchased it. (4) Shortly after purchasing it, I personally occupied the residence a few times. I split my time between Providence, Rhode Island and the Hyannis area. (5) Not too long after purchasing the property, I experienced many incidents of vandalism. Some time, I believe in 1987, I boarded up windows that had been broken. (6) Until I recently put the property under agreement,I had always intended to renovate the property over time for use by myself as a summer cottage. (7) Over the 9+ years since the residence has been boarded up, I have openly,and continuously used a garage on the property for storage of items intended to go back into the house. (8) These items include a stove, a couch and a few chairs and several replacement windows and doors. . (9) I have spent many, many hours clearing out debris from the home as it was quite a mess. The house continued to be broken into over the years which necessitated additional cleaning and repair projects. (10) With regard to the garage structure,this has been used nonstop since I purchased the property. I have had to make several minor repairs to the garage and have set up for myself a workshop for this purpose. (11) The property is located just off a cranberry bog and as such, at times, a wind tunnel is created across from the bog which has caused damage to trees on my property. Every year since I owned this property, I have needed to spend days collecting and disposing of trees and tree limbs. (12) Over the years, I have pulled several burning permits from the Cotuit Fire Y Department. On each occasion but one, the burnings went without incident, and I was able to properly maintain my property. However, on one occasion, some unexpected wind coming across the cranberry bog caused the fire to spread out of my immediate control. I quickly contacted the Cotuit Fire Department who responded very quickly down the Ancient Town Road servicing my property. The Fire Department's ladder truck had no problem in accessing my property. (13) About a year ago,I again had a problem with vandalism where the plywood covering the previously broken windows was torn down. One or more persons entered my property and spray painted graffiti over the interior walls. I contacted the Barnstable Police Department and accompanied them down the road to my property. Again, they had absolutely no problem in accessing the property. (14) Over the years, I have had occasion to make several minor repairs to the property caused by squirrel infestation. (15) Over the last 10 years,I have worked in the construction field, operated the Barnacle restaurant on Craigville Beach Road in Centerville along with many other jobs. My busy work schedule and my constant traveling between Rhode Island and Cape Cod has unfortunately left me without sufficient time to complete my goal of renovating the residential dwelling on this property a little at a time as I have attempted. My main enjoyment of this property has been on a few occasions when I have had a few cookouts with friends. (16) The residential use of this property in terms of someone actually sleeping in the house ceased over nine years ago. However,I have openly and continuously sought to maintain the property,constantly using the garage thereon for storage of household items, replacement windows and doors and lumber, specifically sized for this building. I have also used the garage for storage of some personal belongings and other items related to my business endeavors.
